PURSUANT to section 149 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the Waitemata County Council stopping the road described in the Schedule hereto.

The Eastern Side of Portion of Cuba Street and the Western Side of Portion of Wigan Street, in the City of Wellington, Exempted from the Provisions of Section 128 of the Public Works Act 1928

At the Government House at Wellington this 1st day of December 1954
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 128 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby approves of the resolutions passed by the Wellington City Council on the 9th day of December 1953, and set out in the First Schedule hereto, in so far as they affect the sides and portions of streets described in the Second Schedule hereto.

FIRST SCHEDULE
THE Wellington City Council, being the local authority having control of the streets in Wellington City, by resolution declares that the provisions of Section 128 of the Public Works Act 1928 shall not apply to the eastern side of the portion of Cuba Street adjoining that part of Section 127, Town of Wellington, being all (or part) of the land in certificates of title, Volume 492, folio 140, and Volume 190, folio 4, Wellington Registry.
The Wellington City Council, being the local authority having control of the streets in Wellington City, by resolution declares that the provisions of Section 128 of the Public Works Act 1928 shall not apply to the western side of the portion of Wigan Street adjoining that part of Section 127, Town of Wellington, being all (or part) of the land in certificate of title, Volume 492, folio 140, Wellington Registry.

SECOND SCHEDULE
THE eastern side of all that portion of street situated in the Wellington Land District, City of Wellington, known as Cuba Street, fronting part Section 127, Town of Wellington. As the same is more particularly delineated on the plan marked P.W.D. 145108 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
Also the western side of all that portion of street situated in the Wellington Land District, City of Wellington, known as Wigan Street, fronting part Section 127, Town of Wellington. As the same is more particularly delineated on the plan marked P.W.D. 143779 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Kawau Island—Bon Accord Harbour—Jetty—Kawau Island Yacht Club Incorporated

ORDER IN COUNCIL
At the Government Buildings at Wellington this 11th day of November 1954
Present:
THE HON. W. J. BROADFOOT PRESIDING IN COUNCIL
PURSUANT to the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby licenses and permits Kawau Island Yacht Club Incorporated of Kawau (hereinafter called the licensee, which term shall include its successors, or assigns, unless the context requires a different construction) to use and occupy a part of the foreshore and land below low-water mark at Smelting Bay, Bon Accord Harbour, Kawau Island, as shown on plan marked M.D. 9778 and deposited in the office of the Marine Department at Wellington, for the purpose of erecting and maintaining a jetty thereon as shown on the said plan, such licence to be held and enjoyed by the licensee upon and subject to the terms and conditions set forth in the Schedule hereto.

SCHEDULE
CONDITIONS

This licence is subject to the Foreshore Licence Regulations 1940, and the provisions of those regulations shall so far as applicable apply hereto.

The premium payable by the licensee shall be two pounds (£2) and the annual sum so payable one pound ten shillings (£1 10s.).

The term of the licence shall be fourteen years from the 1st day of April 1954.

The master of every vessel loading at the said jetty shall deposit all ballast above high-water mark, or at such place as may be approved by the Minister or by any person appointed by the Minister for that purpose.
