Consenting to the Raising of Loans by Certain Local Authorities and Prescribing the Conditions Thereof

At the Government House at Wellington, this 16th day of June 1954

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS the several local authorities enumerated in the Schedule hereto, being desirous of raising the respective loans stated opposite their names therein, have respectively complied with the provisions of the Local Government Loans Board Act 1926 (hereinafter called the said Act), and it is expedient that the precedent consent of the Governor-General in Council, as required by the said Act, should be given to the raising of the said loans:

Now, therefore, pursuant to section 11 of the said Act as set out in section 29 of the Finance Act 1932 (No. 2), His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the raising in New Zealand by the respective local authorities mentioned in the first column of the said Schedule of the respective loans set out in the second column of the said Schedule, up to the respective amounts specified in the third column of the said Schedule, and in giving such consent hereby determines as follows:

  1. The terms for which the said loans or any parts thereof may be raised shall not exceed the respective terms (in years) stated in the fourth column of the said Schedule.

  2. The rate of interest that may be paid in respect of the said loans or any parts thereof shall be such as shall not produce to the lender or lenders a rate or rates exceeding four per cent per annum.

  3. The said respective loans or any parts thereof, together with interest thereon, shall be repaid by equal aggregate annual or half-yearly instalments extending over the respective terms as determined in clause 1 hereof.

  4. The payment of all such instalments shall be made in New Zealand, and no such instalment shall be paid out of loan money.

  5. The rate payable for brokerage, underwriting, and procurement fees in respect of the raising of the said respective loans or any parts thereof shall not in the aggregate exceed one-half per cent of any amount raised.

  6. No money shall be borrowed under this consent after the expiration of two years from the date hereof.

The Scott’s Gap - Otatau Rabbit District Order 1954 (Notice No. Ag. 5659)

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Rabbit Nuisance Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. (1) This order may be cited as the Scott’s Gap - Otatau Rabbit District Order 1954.

(2) This order shall come into force on the day after the date of its notification in the Gazette.

  1. The boundaries of the Scott’s Gap - Otatau Rabbit District, which was constituted by Order in Council on the 20th day of November 1940,* are hereby altered and redefined; and as from the commencement of this order, the boundaries of the said district shall be those specified in the Schedule hereto.

SCHEDULE

BOUNDARIES OF THE SCOTT’S GAP - OTATAU RABBIT DISTRICT

ALL that area in the Southland Land District containing by estimation 92,800 acres, more or less, inclusive of roads, railways, and streams and bounded as follows:

Commencing at the northernmost corner of Section 101, Block XIII, Wairo Survey District; thence north-easterly generally along the north-western and north-eastern boundaries of Section 4, Block XIII aforesaid, across a public road and along the north-western boundary of Section 6, Block XIII aforesaid, again across a public road and along the north-western boundary of Section 176, Block XIII aforesaid, to the northernmost corner thereof; thence north-westerly and north-easterly generally along the eastern boundaries of the State forest in Block XIII aforesaid, and Run 133 to a public road, forming the southern boundary of Section 192, Block VI, Wairo Survey District; thence easterly along the southern side of the said public road to a point due south of the north-eastern boundary of the said Section 192 where it meets the aforesaid public road; thence north-westerly generally to and along the north-eastern boundaries of the said Section 192 and Run 133, to the easternmost corner of Section 15, Block VIII, Wairo Survey District; thence north-westerly and northerly along the eastern boundaries of Blocks VIII and II, Wairo Survey District, and the last-mentioned boundary produced to the right bank of the Morley Stream; thence easterly generally along the southern boundary of the Wairaki Survey District to the south-eastern corner of Section 12, Beaumont Settlement, Block XXIX, Wairaki Survey District; thence northerly and westerly along the eastern and northern boundaries of the said Section 12, to the south-eastern corner of Section 89, Block XXVIII, Wairaki Survey District; thence north-easterly generally along the eastern boundaries of the said Section 89 and Section 43, Blocks XXIII and XVII, Wairaki Survey District, and the boundary of the said Section 43 produced to and across the Etal Stream, to the left bank thereof; thence in a south-easterly direction generally along the left bank of the Etal Stream to its confluence with the Aparima River; thence due east across the said river to its left bank; thence south-westerly generally along the left bank of the Aparima River to a point in line with the southern boundary of the Scott’s Gap – Otatau Rabbit District as described in New Zealand Gazette No. 118 of 20 November 1940, page 3444; thence to and along the southern, western, and northern boundaries of the aforesaid Rabbit District, to the point of commencement.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by Order in Council dated the 31st day of May 1944, and published in the Gazette of the 8th day of the following month, at page 688, Arnold M. Dunning was licensed to occupy part of the foreshore at Motukaraka, Wairupe Creek, Hokianga Harbour, as a site for a piggery:

And whereas it is desirable to revoke the said Order in Council:

Now, therefore, pursuant to the provisions of the Harbours Act 1950, His Excellency the Governor-General hereby revokes, as from the 1st day of April 1954, the hereinbefore-recited Order in Council of the 31st day of May 1944.
