Granting Control of Part of the Foreshore of Taipa Beach, Cable Bay, and Coopers Beach, in Mangonui Harbour, in Mangonui Harbour Board

ORDER IN COUNCIL

At the Government House at Wellington, this 28th day of April 1954

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby grants to the Mangonui Harbour Board (hereinafter called the Board) control of parts of the foreshore at Taipa Beach, Cable Bay, and Coopers Beach, in Mangonui Harbour, as described in the First Schedule hereto and subject to the terms and conditions set forth in the Second Schedule hereto.

FIRST SCHEDULE

DESCRIPTION OF AREAS

ALL those parts of the foreshore situated in the Mangonui Harbour as follows:

(a) Commencing at the northernmost point on the eastern side of Coopers Beach and extending northwards to the northernmost point of the western side of Coopers Beach.

(b) Commencing at a point at high-water mark opposite the longitudinal station site in Cable Bay and extending northwards to the western end of Cable Bay Beach.

(c) Commencing at the easternmost point of Taipa Beach and extending northwards to the northernmost point of the western side of Taipa Beach; as all such three areas are shown coloured red on plan marked M.D. 9645 and deposited in the office of the Marine Department at Wellington.

SECOND SCHEDULE

CONDITIONS

  1. In these conditions the terms—

‘‘Board’’ means the Mangonui Harbour Board.

‘‘Foreshore’’ means such parts of the bed, shore, or banks of a tidal water as are covered and uncovered by the flow and ebb of the tide at ordinary spring tides.

‘‘Low-water mark’’ means low-water mark at ordinary spring tides.

‘‘Minister’’ means the Minister of Marine as defined by the Shipping and Seamen Act 1952, and includes any officer, person, or authority acting by or under the direction of such Minister.

  1. The concessions and privileges conferred by this Order in Council shall extend and apply only to those parts of the foreshore as shown edged red on plan marked M.D. 9645 and deposited in the office of the Marine Department at Wellington.

  2. Her Majesty or the Governor-General, and all officers in the Government service acting in the execution of their duty, shall at all times have free ingress, passage, and egress out and over the said foreshore without payment.

  3. Nothing herein contained shall authorize the Board to do or cause to be done anything repugnant to or inconsistent with any law relating to the Customs, or with any regulation of the Minister of Customs, or with any provision of the Harbours Act 1950 or its amendments, or any regulations made thereunder, and that are or may hereafter be in force.

  4. The rights, powers, and privileges conferred by this Order in Council shall not apply to those portions of the foreshore required for securing the shore ends of any telegraph-cables that are at present or may be at any time laid down within the said areas of foreshore.

  5. The Board may, subject to the provisions of section 178 of the Harbours Act 1950, erect or license or permit the erection of baths, bathhouses, boatsheds, boat-building sheds, jetties, and slipways on the foreshore described in the First Schedule hereto, and may make by-laws regulating the use thereof, and may fix charges for such use, provided that the funds so received shall be expended in improving the foreshore for the benefit of the inhabitants of the district.

  6. The Board may enclose any part or parts of the shore described in the First Schedule hereto for the purpose of holding athletic sports or games, and may by by-law fix a charge for admission to such enclosed part or parts, provided that the total number of days on which such enclosures are made shall not exceed six in any one year.

  7. Nothing herein contained shall authorize the Board to move or cause to be removed any stone, sand, shingle, or shells without the consent of the Minister being first obtained.

  8. The Board shall prevent any nuisance being caused and shall not permit fish or fish offal to remain on or about the foreshore.

  9. By-laws made by the Board under the said Act in respect of the foreshore shall not have effect unless and until approved in writing by the Minister.

  10. The rights, powers, and privileges conferred by or under this Order in Council shall continue to be in force for twenty-one years from the date hereof unless in the meantime such rights, powers, and privileges shall be altered, modified, or revoked by competent authority.

  11. The said rights, powers, and privileges may be at any time resumed by the Governor-General, without payment of any compensation whatever, on giving to the Board six calendar months’ previous notice in writing. Any such notice shall be sufficient if given by the Minister, and delivered at or posted to the last known address of the Board in New Zealand.

Second Extension of the Time Within Which the Commission of Inquiry Into the Police Force May Report

To all to whom these presents shall come and to:

The Honourable Sir ROBERT KENNEDY, of Dunedin, lately a Judge of the Supreme Court of New Zealand;

GREETING

WHEREAS by Warrant issued on the 23rd day of October 1953 under the hand of the Governor-General, with the advice and consent of the Executive Council, you were appointed a Commission to inquire into and report upon certain matters relating to the conduct of the Police Force of New Zealand:

And whereas by the said Warrant you were required to report not later than the 18th day of December 1953 your findings and opinions on the matters thereby referred to you, together with such recommendations as you should think fit to make in respect thereof:

And whereas by Warrant dated the 15th day of December 1953 the time within which you were so required to report was extended until the 30th day of April 1954:

And whereas it is expedient that the time for so reporting should be further extended as hereinafter provided, but without prejudice to the power conferred upon you by the said Warrant of the 23rd day of October 1953 to submit an interim report if and so often as you shall deem it expedient or desirable so to do:

Now, therefore, I, Charles Willoughby Moke Norrie, the Governor-General of New Zealand, in exercise of the powers conferred on me by the Commissions of Inquiry Act 1908 and of all other powers and authorities enabling me in this behalf, and acting by and with the advice and consent of the Executive Council, do hereby extend until the 30th day of June 1954 the time within which you are so required to report:

Provided always that the further extension of time granted to you by these presents shall be without prejudice to the power conferred upon you by the said Warrant of the 23rd day of October 1953 to furnish to me an interim report or interim reports on any matter or matters arising in the course of your inquiry, together with such recommendations as you think fit to make in respect thereof:

And in further pursuance of the said powers and authorities and with the like advice and consent I do hereby confirm the said Warrant of the 23rd day of October 1953, and the Commission thereby constituted, save as modified by the said Warrant of extension dated the 15th day of December 1953 and by these presents.

Given in Executive Council, under the hand of His Excellency the Governor-General, this 30th day of April 1954.

PURSUANT to section 4 of the Dietitians Act 1950, I, Lieutenant-General Sir Charles Willoughby Moke Norrie, the Governor-General of New Zealand, do hereby reappoint

Joyce Martin, R.N., Registered Dietitian,

as a member of the Dietitians Board for a term of three years from the 1st day of April 1954, and do hereby appoint

John Oubridge Mercer, M.B., Ch.B.(N.Z.), M.R.C.P. (Lond.), F.R.A.C.P., and

Esme Stuart Ussher, B.H.Sc., Registered Dietitian,

as members of the Dietitians Board for a period of three years from the 1st day of April 1954.

As witness the hand of His Excellency the Governor-General, this 27th day of April 1954.
