Lands Reserved in the South Auckland, Wellington, and Nelson Land Districts

WHEREAS by section 167 of the Land Act 1948 it is enacted that the Governor-General may from time to time set apart as a reserve, notwithstanding that the same may be then held under pastoral lease or pastoral occupation licence, any Crown land for any purpose which in his opinion is desirable in the public interest, and notice thereof shall be published in the New Zealand Gazette:

Now, therefore, pursuant to section 167 of the said Act, I, Lieutenant-General Sir Charles Willoughby Moke Norrie, the Governor-General of New Zealand, hereby reserve, subject to the reservations and conditions imposed by section 59 of the Land Act 1948, the lands in the South Auckland, Wellington, and Nelson Land Districts described in the Schedule hereunder written, for the purposes specified at the end of the respective descriptions of the lands so intended to be reserved.

SOUTH AUCKLAND LAND DISTRICT

Lot 1, Deposited Plan No. 36127, being parts Waihi North No. 2 No. 1A 2A and No. 2 No. 1A 2B 1 Blocks, situated in Block II, Waihi North Survey District, and Section 24, Block III, Waihi North Survey District: Total area, 577 acres, 1 rood 28 perches, more or less. (S.O. plan 34176L.) Recreation.)

Commission to Inquire into and Report on the Cause of the Accident Leading to the Deaths of John William McClymont and Kenneth Andrew Charles Belworthy

To all to whom these presents shall come, and to JOHN GRAY WARRINGTON, Esquire, Stipendiary Magistrate: Greeting.

WHEREAS it has been deemed expedient that a Commission shall issue to inquire into the cause of and the circumstances surrounding the accident which occurred at the Half-way Bush Substation on the 24th day of February 1953 and led to the deaths of John William McClymont and Kenneth Andrew Charles Belworthy, and into the methods of work at and the administration of the said substation and the conduct of officers or other persons in the Public Service so far as they concern the circumstances of such deaths:

Now, therefore, pursuant to the Commissions of Inquiry Act 1908, I, Lieutenant-General Sir Charles Willoughby Moke Norrie, the Governor-General of New Zealand, acting by and with the advice and consent of the Executive Council, hereby constitute and appoint you, the said John Gray Warrington, to be a Commission to inquire into and report upon—

(1) The cause of the accident which led to the deaths of John William McClymont and Kenneth Andrew Charles Belworthy;

(2) Whether at any material time or times any person or persons in the Public Service failed to exercise reasonable care or to carry out any orders or instructions or procedure or to fulfil any duty or responsibility according to the standard reasonably to be expected of him or them in relation to the circumstances leading up to the said deaths;

(3) Whether the methods of work in operation at the Half-way Bush Substation at the time of and prior to the said deaths were proper and reasonable for the work being undertaken;

(4) Whether the instructions given or in force and the preparations made were proper and sufficient for the work intended to be done;

(5) Whether the deaths of the said McClymont and Belworthy or of either one of them might or could have been prevented by the exercise of reasonable care by, or the carrying out of any orders or instructions or procedure by, or by the fulfilment of any duty or responsibility resting upon, any person or persons in the Public Service;

(6) Whether the work intended to be done by them was suitable having regard to their knowledge and experience, and whether there was sufficient supervision of their actions;

(7) Whether any additional instructions should be issued, procedure laid down, or other precautions taken, to prevent the happening of similar accidents in the future—

and generally to inquire into and report upon such other matters arising thereout as may come to your notice in the course of your inquiries which you consider should be investigated in connection therewith, and upon any matters affecting the premises which you consider should be brought to the attention of the Government:

And you are hereby authorized to conduct any inquiry under these presents at such times and places as you deem expedient, with power to adjourn from time to time and place to place as you think fit, and to call before you and to examine on oath or otherwise such persons as you think capable of affording you information as to the matters aforesaid, and to call for and examine all such books, papers, writings, documents, and reports as you deem likely to afford you the fullest information on any such matters:

And using all due diligence, you are required to report to me not later than the 31st day of March 1954 your finding and opinion on the matter aforesaid, together with such recommendations as you think fit to make in respect thereof:

And you are hereby strictly charged and directed that you shall not at any time publish or otherwise disclose, save to me in pursuance of these presents or by my direction, the contents or purport of any report so made or to be made by you:

And it is hereby declared that this Commission shall continue in full force although the inquiry be not regularly continued by adjournments from time to time or from place to place:

And lastly, it is hereby further declared that these presents are issued under and subject to the provisions of the Commissions of Inquiry Act 1908.

Given under the hand of His Excellency the Governor-General, and issued under the Seal of New Zealand, this 10th day of February 1954.
