Boundaries of Borough of Riverton and County of Wallace Altered

At the Government House at Wellington, this 2nd day of September 1953
Present:
His EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS, pursuant to section 136 of the Municipal Corporations Act 1933, a petition was presented to the Governor-General praying that a certain area of land be excluded from the County of Wallace and included in the Borough of Riverton;
And whereas, pursuant to section 24 of the Local Government Commission Act 1946, the said petition was referred to the Local Government Commission;
And whereas, pursuant to the Local Government Commission Act 1946, the Local Government Commission has approved as final a scheme bearing date the 5th day of June 1953 providing for the exclusion of the areas described in the Schedule to the said scheme from the County of Wallace and the inclusion of those areas in the Borough of Riverton;
And whereas it is deemed expedient to give effect to the final scheme as hereinafter appearing:
Now, therefore, pursuant to the Local Government Commission Act 1946, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby declares that as on and from the 1st day of April 1954 the areas described in the Schedule hereto shall be excluded from the County of Wallace and included in the Borough of Riverton, and with the like advice and consent hereby also declares that the alteration of boundaries of the said county and the said borough hereinbefore made shall be deemed to have been effected under the Municipal Corporations Act 1933.
SCHEDULE
AREAS EXCLUDED FROM THE COUNTY OF WALLACE AND INCLUDED IN THE BOROUGH OF RIVERTON
ALL that area in the Wallace County, Waimatuku Riding, containing by estimation 145 acres, more or less, and bounded as follows: Commencing at the north-west corner of Section 1, Block XXV, Jacobs River Hundred; thence north-easterly along the south-eastern side of Havelock Street to a point in line with the south-western boundary of Section 71, Block XXV aforesaid; thence south-easterly to and along the south-western boundary of the said Section 71 to a point in line with the north-western boundaries of Sections 63, 58, 55, and 52, Block XXV aforesaid; thence south-westerly to and along the north-western boundary of the said Sections to the north-western corner of the said Section 52; thence south-easterly along the south-western boundaries of Sections 52 and 51, Block XXV aforesaid, and the last-mentioned boundary produced to the coastline; thence south-westerly and north-westerly generally along the coastline and the north-eastern shore of the Jacobs River Estuary to the point of commencement.
Also all that portion of the Jacobs River Estuary containing by estimation 126 acres, more or less, and bounded as follows: Commencing at Talls Point, a point on the coastline opposite the north-east corner of Section 30, Block II, Jacobs River Hundred, at the junction of the coastline and the southern shore of the Jacobs River Estuary; thence north-westerly generally along the south-western shore of the Jacobs River Estuary to the centre line of the Tuatapere Branch Railway; thence easterly generally along the centre line of the said railway, to the south-eastern shore of the Jacobs River Estuary, being the boundary of the Borough of Riverton; thence south-westerly and south-easterly generally, along the south-eastern and north-eastern shores of the Jacobs River Estuary, to the southernmost corner of Section 38, Block XXV, Jacobs River Hundred; thence southerly along a right line to the point of commencement.

Present:
His EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS at the request of the Hamilton City Council the Local Government Commission, pursuant to the Local Government Commission Act 1946, has considered certain proposals for an alteration of the boundaries of the City of Hamilton and the County of Waipa;
And whereas, pursuant to the said Act, the Local Government Commission has approved as final a scheme bearing date the 5th day of May 1953 providing for the exclusion of the area described in the Schedule to the said scheme from the County of Waipa and the inclusion of that area in the City of Hamilton;
And whereas it is deemed expedient to give effect to the final scheme as hereinafter appearing:
Now, therefore, pursuant to the Local Government Commission Act 1946, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby declares that as on and from the 1st day of April 1954 the area described in the Schedule hereto shall be excluded from the County of Waipa and included in the City of Hamilton, and, with the like advice and consent, hereby also declares that the alteration of the boundaries of the said county and said city hereinbefore made shall be deemed to have been effected under the Municipal Corporations Act 1933.
SCHEDULE
AREA EXCLUDED FROM THE COUNTY OF WAIPA AND INCLUDED IN THE CITY OF HAMILTON
ALL that area of approximately 440 acres in the Rukuhia Riding of the Waipa County, bounded by a line commencing at a point on the right bank of the Waikato River, being the southern boundary of the City of Hamilton and being at the north-eastern end of a line bearing 45 degrees true from the middle of the mouth of the Mangakotukutu Stream, and running south-westerly generally along a right line, across the aforementioned river, to and up the middle of the Mangakotukutu Stream aforesaid to the north-eastern boundary of Lot 3 as shown on the Deeds Plan lodged in the Auckland Land Registry under No. 185, and being part of Allotment 48 of Te Rapa Parish; thence westerly generally along the north-eastern and north-western boundaries of the aforementioned Lot 3, to and along the south-western boundary of Lot 1 as shown on the plan numbered 35895 deposited in the aforementioned Land Registry and being part of Allotment 49 of the aforementioned Parish, and along the north-western boundary of Lot 1 as shown on this plan numbered 29789 deposited as aforementioned, and being all the aforementioned Allotment 49, to a point at right angles to and 250 links distant from the eastern side of the Great South Road; thence along right lines, parallel to and 250 links from the aforementioned eastern side to the north-eastern corner of Lot 1 as shown on the plan numbered 29761 deposited as aforementioned, being part of the aforementioned Allotment 49; thence along the northern boundary of the aforementioned Lot 1 and along a right line across Great South Road aforesaid to a point on its western side at right angles to and 250 links distant from the alignment of the southern side of Collins Road; thence along right lines parallel to and 250 links distant from the southern side of the aforementioned road to a point in line with the western boundary of Lot 3 as shown on the Deeds Plan numbered 258 lodged as aforementioned, being part of Allotment 29 of the Parish of Te Rapa aforementioned; thence northerly along a right line to and across Collins Road, to and along the aforementioned western boundary, and along another right line being the production of the western boundary aforementioned to the southern boundary of the City of Hamilton; thence easterly generally along the southern boundary of the City of Hamilton aforementioned as described in New Zealand Gazette No. 62 of the 27th day of October 1949, page 2500, to the point of commencement.

Consenting to Stopping Road in Block I, Maramarua Survey District, Franklin County

His EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 149 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the Franklin County Council stopping the road described in the Schedule hereto.

In the North Auckland Land District; as the same is more particularly delineated on the plan marked P.W.D. 141033, deposited in the office of the Minister of Works at Wellington, and thereon coloured green.
