Present:

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL

PURSUANT to section 31 of the Municipal Corporations Amendment Act 1948, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby authorizes the Whangarei Borough Council to lay-off the proposed street first described in the Schedule hereto at a width for the whole of its length of less than 66 ft. but not less than 59 ft. 5 in., and the proposed street secondly described in the said Schedule at a width for the whole of its length of less than 66 ft. but not less than 62 ft. 2 in.

THAT proposed street in the North Auckland Land District, Borough of Whangarei, being an extension of Hugh Avenue, containing by admeasurement 1 rood 22·8 perches, more or less, being Lot 52, D.P. 17077, and Lot 57, D.P. 34694, being parts Allotment 2, Whangarei Parish.

Situated in Block XII, Purua Survey District, and Block IX, Whangarei Survey District (Auckland R.D.). (S.O. 36671). As the same is more particularly delineated on the plan marked P.W.D. 138826, deposited in the office of the Minister of Works at Wellington, and thereon coloured yellow and blue.

Also that proposed street in the said land district and borough, being an extension of Churchill Street, containing by admeasurement 1 rood 31·1 perches, more or less, being Lot 12, D.P. 11618, being part Allotment 2, Whangarei Parish.

Situated in Block IX, Whangarei Survey District (Auckland R.D.). (S.O. 36675). As the same is more particularly delineated on the plan marked P.W.D. 138831, deposited in the office of the Minister of Works at Wellington, and thereon coloured blue.

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL

PURSUANT to section 31 of the Municipal Corporations Amendment Act 1948 and section 125 of the Public Works Act 1928, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby authorizes the Palmerston North City Council to permit the laying-off of the proposed street described in the Schedule hereto, at a width for part of its length of less than 66 ft. but not less than 50 ft. subject to the condition that no building or part of a building shall at any time be erected on the land shown edged green on the plan marked P.W.D. 138827, referred to in the said Schedule, within a distance of 48 ft. from the centre-line of the said street.

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL

PURSUANT to section 31 of the Municipal Corporations Amendment Act 1948 and section 125 of the Public Works Act 1928, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby authorizes the Palmerston North City Council to permit the laying-off of the proposed street described in the Schedule hereto at a width for the whole of its length of less than 66 ft., but not less than 50 ft., subject to the condition that no building or part of a building shall at any time be erected on Lots 37 to 46 inclusive of a subdivision of the land fronting the said street (as shown on the plan marked P.W.D. 135037 referred to in the Schedule hereto) within a distance of 48 ft. from the centre-line of the said street.

Revoking the Declaration of a Main Highway and Declaring a Public Highway to be a Main Highway

ORDER IN COUNCIL

At the Government House at Wellington, this 19th day of November 1952

Present:

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL

IN pursuance and exercise of the powers and authorities vested in him by section 3 of the Main Highways Act 1922, and of all other powers in anywise enabling him in this behalf, His Excellency the Administrator of the Government of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, hereby declares that, on and after the date of publication of this Order in Council in the New Zealand Gazette the main highway described in the First Schedule hereto shall cease to be a main highway, and further declares that the road described in the Second Schedule shall be a main highway within the meaning and for the purposes of the Main Highways Act 1922.

FIRST SCHEDULE

HIGHWAY DISTRICT NO. 10

Woodville–Masterton.—All that main highway or portion of main highway in the Masterton and Mauriceville Counties, declared as the Woodville–Masterton Main Highway, commencing at its junction with Hiwitoru Road, opposite part Section 22, Block IV, Miki Miki Survey District, and proceeding thence generally in a northerly direction, and terminating at a point opposite part Section 17, Block IV, Miki Miki Survey District, being a distance of 1 mile 10 chains, more or less, described in Order in Council dated 2 October 1940, and published in the New Zealand on 10 October 1940 ; as the same is more particularly delineated on plan P.W.D. 106803, deposited in the office of the Main Highways Board at Wellington, and thereon coloured green.

SECOND SCHEDULE

HIGHWAY DISTRICT NO. 10

Woodville–Masterton.—All that road or portion of road in the Masterton and Mauriceville Counties, commencing at the junction of Hiwitoru Road and the Woodville–Masterton Main Highway, opposite part Section 22, Block IV, Miki Miki Survey District, and proceeding thence generally in a northerly direction and terminating at its junction with the said Woodville–Masterton Main Highway opposite part Section 7, Block IV, Miki Miki Survey District, being a distance of 70 chains, more or less ; as the same is more particularly delineated on plan P.W.D. 138637, deposited in the office of the Main Highways Board at Wellington, and thereon coloured red.
