Appointing Members of the First and Second Divisions of the Court of Appeal

ORDER IN COUNCIL
At the Government House at Wellington, this 19th day of November 1952
Present:
HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL
WHEREAS by section 5 of the Judicature Amendment Act 1913 it is enacted that the Court of Appeal shall consist of two divisions, to be called respectively the First Division and the Second Division of the Court of Appeal; and that each division shall consist of five Judges of the Supreme Court, to be appointed to that division by the Governor-General in Council: Provided that whenever all the Judges of the Supreme Court are present in New Zealand and are available to act as members of the Court of Appeal one of the divisions may consist of six Judges:
And whereas the power conferred by the said Act upon the Governor-General in Council of appointing Judges as members of either division, or revoking any such appointment, shall be exercisable on the recommendation of not less than three Judges of the Supreme Court (of whom the Chief Justice shall be one), and not otherwise:
And whereas the Right Honourable the Chief Justice, the Honourable Mr. Justice Northcroft, the Honourable Mr. Justice Hutchison, the Honourable Mr. Justice Hay, and the Honourable Mr. Justice Cooke, have recommended that the two divisions of the Court of Appeal for the year 1953 shall be constituted as shown hereafter:
Now, therefore, His Excellency the Administrator of the Government, in exercise of the powers conferred by the said Act, and acting by and with the advice and consent of the Executive Council, doth hereby appoint

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL
WHEREAS by an Order in Council dated the 10th day of August 1949, and published in the New Zealand Gazette of the 18th day of that month, the control of the land described in the Schedule to that document, being a reserve for a site for a public hall, was vested in certain persons therein named, who were by the said Order in Council constituted a special Board, by the name of the Inangahua Junction Public Hall Board, pursuant to section 17 of the Public Reserves, Domains, and National Parks Act 1928:
And whereas it is desirable that Doreen May Harvey, Lawrence Timothy Magee, and Gilbert Victor Schroder should be appointed members of the said Board in place of Harry John McNeight, William Frederick Sidwell, and Edward Oswald Stowell, left the district:
Now, therefore, pursuant to section 17 of the Public Reserves, Domains, and National Parks Act 1928, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby appoints the said
Doreen May Harvey, Lawrence Timothy Magee,
and Gilbert Victor Schroder
to be members of the Inangahua Junction Public Hall Board, constituted by the Order in Council dated the 10th August 1949, hereinbefore referred to, in place of the said Harry John McNeight, William Frederick Sidwell, and Edward Oswald Stowell, left the district.

Authorizing the Construction of a Motor-way Between the County of Waimairi and the County of Paparua (Christchurch–Riccarton–Templeton Motor-way)

At the Government House at Wellington, this 26th day of November, 1952

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL
PURSUANT to the Public Works Act 1928 and section 44 of the Public Works Amendment Act 1948, His Excellency the Administrator of the Government, at the request of the Main Highways Board, and acting by and with the advice and consent of the Executive Council, hereby authorizes the construction of a motor-way between the County of Waimairi and the County of Paparua, such motor-way to commence at the junction of Halls Road and Hands Street, in the County of Waimairi, and adjacent to the City of Christchurch and the Borough of Riccarton, and to proceed in a generally south-westerly direction to junction with the Christchurch–Timaru Main Highway No. 58 at Robinson’s Road in the County of Paparua, 1¾ miles south of the township of Templeton.

Authorizing the Laying-off of McLeod Street, in the Borough of Upper Hutt, Subject to a Condition as to the Building-line

At the Government House at Wellington, this 26th day of November, 1952
Present:
HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL
PURSUANT to section 31 of the Municipal Corporations Amendment Act 1948 and section 125 of the Public Works Act 1928, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby authorizes the Upper Hutt Borough Council to permit the laying-off of the proposed street described in the Schedule hereto at a width for part of its length of less than 66 ft., but not less than 50 ft., subject to the condition that no building or part of a building shall at any time be erected on the land fronting the proposed street, within a distance of 48 ft. from the centre-line of the said street.
SCHEDULE
THAT proposed street in the Wellington Land District, Borough of Upper Hutt, to be known as McLeod Street, containing by admeasurement 1 rood 24·18 perches, more or less, being part Lot 1, D.P. 15198, and being part Section 117, Hutt District.
As the same is more particularly delineated on the plan marked P.W.D. 138825, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Authorizing the Laying-off of a Street (Hapua Street Extension) in the City of Auckland, Subject to a Condition as to the Building-line

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL
PURSUANT to section 31 of the Municipal Corporations Amendment Act 1948 and section 125 of the Public Works Act 1928, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby authorizes the Auckland City Council to permit the laying-off of the proposed street described in the Schedule hereto at a width for the whole of its length of less than 66 ft., but not less than 52 ft., subject to the condition that no building or part of a building shall at any time be erected on the land shown edged green on the plan marked P.W.D. 138808, referred to in the said Schedule, within a distance of 48 ft. from the centre-line of the said street.
