Altering and Redefining the Boundaries of the Marlborough Coast and Kekerangu Rabbit Districts (Notice No. Ag. 5328)

ORDER IN COUNCIL

At the Government House at Wellington, this 24th day of September 1952

Present:

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL

WHEREAS by section 33 of the Rabbit Nuisance Act 1928 (hereinafter referred to as the said Act) it is enacted that the boundaries of two or more contiguous rabbit districts may from time to time be altered by the Governor-General in Council in accordance with a resolution proposing the alteration passed by the Board of each of the districts affected:

And whereas the districts known as the Marlborough Coast Rabbit District and the Kekerangu Rabbit District have been constituted under and for the purposes of Part II of the said Act:

And whereas a resolution was passed by the Board of the Marlborough Coast Rabbit District on the 19th day of February 1952, and a similar resolution was passed by the Board of the Kekerangu Rabbit District on the 12th day of May 1952, praying in each case for the alteration of the boundaries of the said districts in the manner described in the said resolutions and in the First Schedule hereto:

And whereas it is deemed expedient to alter and redefine the boundaries of the said districts in accordance with the said resolutions in manner hereinafter provided:

Now, therefore, pursuant to the powers and authorities conferred upon him by the said Act, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby alters and redefines the boundaries of the said districts so constituted as aforesaid, and hereby declares:—

(1) That the area described in the First Schedule hereto, being now part of the Kekerangu Rabbit District, shall be added to and form part of the Marlborough Coast Rabbit District;

(2) That the boundaries of the Marlborough Coast Rabbit District shall be those set forth in the Second Schedule hereto; and

(3) That the boundaries of the Kekerangu Rabbit District shall be those set forth in the Third Schedule hereto.

FIRST SCHEDULE

AREA TO BE EXCLUDED FROM THE KEKERANGU RABBIT DISTRICT AND INCLUDED IN THE MARLBOROUGH COAST RABBIT DISTRICT

ALL that parcel of land in the Marlborough Land District containing approximately 1,800 acres and bounded as follows: Commencing at Trig. Station Mole Hill in Block XVIII, Whernside Survey District; thence proceeding due west by a right line to the middle of the Clarence River; thence northerly by the middle of the said Clarence River to a point due west of the junction of the Clarence River and the middle of Boundary Stream in Block XVIII, Whernside Survey District; thence north-easterly by a right line bearing 023° true, a distance of 100 chains, and by a right line bearing 041° true, a distance of 116 chains, to peg LXIII, D.P. 705, on the boundary between D.P. 705 and Lot 2, D.P. 1340; thence northerly by that boundary, a distance of 1200·1 links, to the western end of the boundary between Lots 1 and 2, D.P. 1340; thence generally easterly by that boundary to the watershed between Boundary Stream and the Kekerangu River; thence generally southerly along that watershed, being the Front Range and the Lady Range, to the point of commencement.

SECOND SCHEDULE

BOUNDARIES OF THE MARLBOROUGH COAST RABBIT DISTRICT

ALL that parcel of land in the Marlborough Land District containing approximately 58,650 acres and bounded as follows: Commencing at the middle of the mouth of the Clarence River in Block XI, Puhi Puhi Survey District; thence proceeding in westerly, northerly, and north-easterly directions by the middle-line of the Clarence River to a point due west of the junction of the said Clarence River and the middle of Boundary Stream in Block XVII, Whernside Survey District; thence north-easterly by a right line bearing 023° true, a distance of 100 chains, and by a right line bearing 041° true, a distance of 116 chains, to peg LXIII, D.P. 705, on the boundary between D.P. 705 and Lot 2, D.P. 1340; thence northerly by that boundary, a distance of 1200·1 links, to the western end of the boundary between Lots 1 and 2, D.P. 1340; thence generally easterly by that boundary to the watershed between the Boundary Stream and the Kekerangu River; thence northerly along that watershed to the Trig. Station P on Ragged Robin in Block VIII, Whernside Survey District; thence in a westerly and north-westerly direction by the south-western boundary of Small Grazing Run 187 to the north-western corner of part Section 3, Block VIII, aforesaid; thence in a westerly direction by a right line to the south corner of part Section 14, Block VIII, aforesaid; thence in a north-easterly, north-westerly, and again north-easterly direction by the south-eastern and north-eastern boundaries of part Section 14 aforesaid and the south-eastern boundary of part Section 8, Block VIII, aforesaid to the eastern corner of the said part Section 8; thence easterly by a right line to the Trig. Station W.H., Whernside, in Block VIII aforesaid; thence in a north-easterly direction by a right line to the north-west corner of Section 4, Block IX, Whernside Survey District; thence in a south-easterly, easterly, and southerly direction by the north-eastern boundaries of the aforesaid Small Grazing Run 187; thence in an easterly and north-easterly direction by the northern boundary of Section 1, Block IX, aforesaid, the western boundaries of Small Grazing Run 183A, and the southern and western boundaries of Section 281, Block XVI, Cape Campbell Survey District to the Ure River; thence in an easterly direction by the Ure River to a point due south to the westernmost corner of Section 1, Block X, Cape Campbell Survey District; thence due north to that corner; thence in an easterly direction by the northern boundary of the said Section 1 to peg V on that boundary; thence in an easterly direction by a right line to the Trig. Station on Single Hill and its prolongation to the sea; thence in a south-westerly direction by the sea to the point of commencement.

THIRD SCHEDULE

BOUNDARIES OF THE KEKERANGU RABBIT DISTRICT

ALL that parcel of land in the Marlborough Land District containing approximately 90,950 acres and bounded as follows: Commencing at a point in the middle of the Clarence River, due west of the junction of the middle of the Boundary Stream with the said Clarence River Block XVIII, Whernside Survey District; thence proceeding in north-westerly, westerly, and south-westerly directions by the centre-line of the said Clarence River to a point opposite the junction of the said Clarence River and the Red Hill Stream; thence in northerly and north-westerly directions by that stream and the western and north-western boundaries of the Bluff Run No. 121, the northern and north-western boundaries of Section 1, Block VII, Section 1, Block VIII, Tapuaenuku Survey District, Section 1, Block VI, Sections 1, 9, and 90, Block VII, and Section 10, Block III, Whernside Survey District, to the northernmost corner of the said section 10, Block III; thence south-easterly by the north-eastern boundary of the said section 10 to the Nidd Stream; thence north-easterly by the said stream to its source in Block III, Whernside Survey District; thence south-westerly by a right line to the Trig. Station W.H. on Mount Whernside in Block VIII, Whernside Survey District; thence westerly by a right line to the eastern corner of part Section 8, Block VIII, aforesaid; thence south-westerly by the south-eastern boundary of the said Section 8 to the northern corner of part Section 14, Block VIII, aforesaid; thence by the north-eastern and south-eastern boundaries of the said part Section 14 to the southern corner of the said part Section 14; thence in an easterly direction by a right line to the north-west corner of part Section 3, Block VIII, aforesaid; thence in a south-easterly direction by the north-eastern boundary of the said part Section 3 to Trig. Station P on Ragged Robin in Block VIII, Whernside Survey District; thence in a southerly direction by the watershed between Boundary Stream and the Kekerangu River to its intersection with the south boundary of Lot 1, D.P. 1340, in Block XIV, Whernside Survey District; thence westerly by the southern boundary of Lot 1 aforesaid to the western corner of the said Lot 1; thence southerly by the boundary between Lot 2, D.P. 1340, and D.P. 705, a distance of 1200·1 links, to peg LXIII, D.P. 705, in Block XIII, Whernside Survey District; thence south-westerly by a right line bearing 221° true for a distance of 116 chains; thence by a right line bearing 203° true for a distance of 100 chains to the point of commencement.

Boundaries of Borough of Geraldine and County of Geraldine Altered

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL

WHEREAS pursuant to section 136 of the Municipal Corporations Act 1933, petitions were presented to the Governor-General praying that certain areas of land be excluded from the County of Geraldine and included in the Borough of Geraldine:

And whereas, pursuant to section 24 of the Local Government Commission Act 1946 the said petitions were referred to the Local Government Commission:

And whereas, pursuant to the Local Government Commission Act 1946, the Local Government Commission has made inquiry into the proposals and has approved as final a scheme bearing date the 31st day of July 1952, providing for the exclusion of the areas described in the First Schedule to the said scheme from the County of Geraldine, and the inclusion of such areas in the Borough of Geraldine, and providing also for the exclusion of the areas described in the Second Schedule to the said scheme from the Borough of Geraldine and the inclusion of such areas in the County of Geraldine:
