The Wellington Show and Industrial Fair Order 1952

At the Government Buildings at Wellington, this 17th day of March 1952

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL
P URSUANT to the Exhibitions Act 1910, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
ORDER

  1. This order may be cited as the Wellington Show and Industrial Fair Order 1952.
  2. In this order, unless the context otherwise requires,-- "The Act" means the Exhibitions Act 1910 : "The exhibition" means a public exhibition of works of industry and art, to be conducted by the Wellington Show Association (Incorporated) in the Show Building, John Street, Wellington, from the 8th day of May 1952 to the 31st day of May 1952 (both inclusive), and to be known as the Wellington Show and Industrial Fair.
  3. The exhibition is hereby authorized, and declared to be an exhibition within the meaning of the Act.
  4. Subject to the conditions set out in the Schedule hereto, the following provisions are hereby suspended in so far as they relate to work done or business conducted or services rendered in the said premises during the period of the exhibition by or on behalf of the bodies conducting the exhibition, or by or on behalf of any exhibitor at the exhibition, or by any person employed in or about he exhibition--namely, such of the provisions of--
    (a) The Industrial Conciliation and Arbitration Act 1925, and all awards and industrial agreements in force thereunder ;
    (b) The Shops and Offices Act 1921-22 ; and
    (c) The Factories Act 1946,--
    as relate to the hours of commencing or ceasing work, or to the issue of permits for overtime or extended hours, or to holidays and half-holidays, or to the closing of shops.
    SCHEDULE
  5. Eight hours shall constitute a day's work in or about the exhibition, and, with the exception set out in clause 2 hereof the hours shall be worked consecutively.
  6. No person shall be employed in or about the exhibition for more than four hours without an interval of at least three-quarters of an hour for a meal.
  7. Any person employed during any day in or about the exhibition who is employed on that day for more than eight hours, or before the hour of 8 a.m., or after the hour of 10.30 p.m. (whether the excess employment is in or about the exhibition or otherwise) shall be paid for the excess employment at not less than half as much again as the ordinary rate for the first two hours and at not less than twice the ordinary rate thereafter, and any person employed in or about the exhibition on any day that would, but for the provisions of this order, have been a whole holiday for that person by virtue of any Act or of any award or industrial agreement shall be paid for all work done on that day at not less than twice the ordinary rate, whether the work is performed wholly in or about the exhibition or otherwise.
  8. No male under eighteen years of age and no female shall be employed in or about the exhibition after the hour of 10.30 p.m.
  9. For the purposes of the enforcement of an award or industrial agreement any provision of which has been suspended by this order, any officer of the industrial union or association concerned who is authorized in writing in that behalf by the union or association shall be entitled to interview at his place of employment any person employed in or about the exhibition under that award or industrial agreement at such time or times as may be agreed upon between the officer and the employer of that person, and for this purpose any such officer shall be entitled at any time to have access to the Register of Passes issued by the Wellington Show Association (Incorporated).
  10. Nothing in this order shall be deemed to affect any provisions in an award or industrial agreement requiring workers subject to the award or industrial agreement to be members of a union.

Consenting to Land Being Taken, Subject to an Easement, for a City Depot and Workshops in the City of Palmerston North

P URSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the land described in the Schedule hereto being taken, subject to the sewerage easement created by Transfer No. 29372 (Wellington Land Registry), for a city depot and workshops.

SCHEDULE
APPROXIMATE area of the piece of land permitted to be taken : 2 roods 15 perchcs.
Being part Section 841, Town of Palmerston North, and being the whole of the land comprised and described in certificate of title, Volume 109, folio 17 (Wellington Land Registry).

Constituting Western Waiheke Secondary Urban Fire District

ORDER IN COUNCIL
At the Government Buildings at Wellington, this 24th day of March 1952
Present:
THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL
WHEREAS, pursuant to section 18 of the Fire Services Act 1949, the Western Waiheke Road Board requested that the Western Waiheke Road District be constituted a secondary urban fire district :
And whereas, pursuant to the said section 18, the Fire Service Council has certified that the appropriate standards for a secondary urban fire district have been complied with :
And whereas, pursuant to the said section 18, the request has been referred to the Local Government Commission :
And whereas, pursuant to the Local Government Commission Act 1946, the Local Government Commission has recommended that action be taken under the Fire Services Act 1949, to constitute the said Road District a secondary urban fire district :
Now, therefore, pursuant to section 18 of the Fire Services Act 1949, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby declares the Western Waiheke Road District a secondary urban fire district, by the name of the Western Waiheke Secondary Urban Fire District.

WHEREAS, pursuant to section 18 of the Fire Services Act 1949, the Horowhenua County Council requested that the urban area of Waikanae-Waimeha be constituted a secondary urban fire district ;
And whereas, pursuant to the said section 18, the Fire Service Council has certified that the appropriate standards for a secondary urban fire district have been complied with in respect of the said area :
And whereas, pursuant to the said section 18, the request has been referred to the Local Government Commission :
And whereas, pursuant to the Local Government Commission Act 1946, the Local Government Commission has recommended that action be taken under the Fire Services Act 1949, to constitute the said area a secondary urban fire district :
Now, therefore, pursuant to section 18 of the Fire Services Act 1949, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby declares the urban area of Waikanae-Waimeha to be a secondary urban fire district by the name of the Waikanae Secondary Urban Fire District.
