Consenting to the Raising of Loans by Certain Local Authorities and Prescribing the Conditions Thereof

At the Government House at Wellington, this 12th day of December 1951

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS the several local authorities enumerated in the Schedule hereto, being desirous of raising the respective loans stated opposite their names therein, have respectively complied with the provisions of the Local Government Loans Board Act 1926 (hereinafter called the said Act), and it is expedient that the precedent consent of the Governor-General in Council, as required by the said Act, should be given to the raising of the said loans :

Now, therefore, pursuant to section 11 of the said Act, as set out in section 29 of the Finance Act 1932 (No. 2), His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the raising in New Zealand by the respective local authorities mentioned in the first column of the said Schedule of the respective loans set out in the second column of the said Schedule, up to the respective amounts specified in the third column of the said Schedule, and in giving such consent hereby determines as follows :—

(1) The terms for which the said loans or any parts thereof may be raised shall not exceed the respective terms (in years) stated in the fourth column of the said Schedule.

(2) The rates of interest that may be paid in respect of the said loans or any parts thereof shall be such as shall not produce to the lender or lenders a rate or rates exceeding the respective rates per centum per annum stated in the fifth column of the said Schedule.

(3) The said respective loans or any parts thereof, together with interest thereon, shall be repaid by equal aggregate annual or half-yearly instalments extending over the respective terms as determined in (1) above.

(4) The payment of such instalments shall be made in New Zealand, and no such instalment shall be paid out of loan-moneys.

(5) The rate payable for brokerage, underwriting, and procurement fees in respect of the raising of the said respective loans or any parts thereof shall not in the aggregate exceed one-half per centum of any amount raised.

(6) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.

Boundaries of City of Timaru and County of Levels Altered

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS, at the request of the Levels County Council, the Local Government Commission, in pursuance of the provisions of the Local Government Commission Act 1946, has made inquiry into certain proposals for an alteration of the boundaries of the City of Timaru and the County of Levels :

And whereas, in pursuance of the provisions of the said Act, the Local Government Commission has approved as final a scheme bearing date the 23rd day of November 1951, providing for the exclusion of the areas described in the Schedule to the said scheme from the County of Levels and the inclusion of such areas in the City of Timaru.

And whereas it is deemed expedient to give effect to the final scheme as hereinafter appearing :

Now, therefore, in pursuance and exercise of the powers and authorities vested in him by the Local Government Commission Act 1946, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General acting by and with the advice and consent of the Executive Council, hereby declares that as on and from the 1st day of January 1952 the areas described in the Schedule hereto shall be excluded from the County of Levels and included in the City of Timaru, and, with the like advice and consent, hereby declares that the alteration of boundaries of the said county and the said city hereinbefore made shall be deemed to have been effected under the Municipal Corporations Act 1933.

SCHEDULE

AREAS EXCLUDED FROM THE COUNTY OF LEVELS AND INCLUDED IN THE CITY OF TIMARU

ALL that area in the Waimataitai Riding of the County of Levels, Canterbury Land District, containing 5½ acres, more or less, and bounded by a line commencing at a point on the northern boundary of the City of Timaru (N.Z. Gazette No. 58, 2 October 1947, page 1414) at the intersection of the south-eastern side of Macdonald Street with the south-western side of the Main North Road ; thence north-westerly along the south-western side of the Main North Road, being the city boundary, to the centre of Grants Road ; thence to a point on the north-eastern side of the Main North Road, the same being in line with the centre-line of Grants Road aforesaid ; thence generally in a northerly direction along the eastern side of the Main North Road to the Taitarakihī Creek ; thence in a south-easterly direction along the right bank of that creek, being the boundaries of Lots 84, 83, 82, 81, 80, 79, 78, and 77, D.P. 751, to and along the south-eastern boundary of said Lot 77, D.P. 751, to and along the north-eastern side of the Main North Road aforesaid to a point in line with the south-eastern side of Macdonald Street ; thence across the Main North Road to the intersection of the south-eastern side of Macdonald Street with the south-western side of the Main North Road, the point of commencement.

Also all that area in the Waimataitai Riding of the County of Levels, Canterbury Land District, containing 271 acres, more or less, and bounded by a line commencing at a point on the northern boundary of the City of Timaru (N.Z. Gazette No. 58, 2 October 1947, page 1414) in the middle of Pages Road in line with the middle of Kelvin Street ; thence in a southerly and westerly direction generally along the boundary of the City of Timaru aforesaid to the eastern boundary of Rural Section 5742 ; thence again westerly along the Waimataitai Creek to the middle of Morgans Road ; thence northerly along the middle of Morgans Road to the middle of Pages Road ; thence north-westerly along the middle of Pages Road to a point in continuation of a line parallel to and 300 links west of the middle-line of Morgans Road ; thence north-easterly at right angles to Pages Road for a distance of 300 links ; thence easterly along a line parallel to and 300 links distant from the middle line of Pages Road aforesaid to a point in line with the middle line of Kelvin Street ; thence southerly by a right line to the point of commencement.

Also all that area in the Claremont Riding of the County of Levels, Canterbury Land District, containing 291 acres, more or less, and bounded by a line commencing at a point on the western boundary of the City of Timaru (N.Z. Gazette No. 58, 2 October 1947, page 1414), the said point being on the eastern boundary of Rural Section 5742 at the Waimataitai Creek ; thence southerly and westerly generally along the boundary of the City of Timaru aforesaid to the north-eastern corner of Lot 3, D.P. 9476 ; thence northerly by a right line to a point in the middle of Wai-iti Road, 300 links west of the middle-line of Morgans Road ; thence northerly along a line parallel to and 300 links west of the middle-line of Morgans Road to a point in line with the middle-line of Coven Road ; thence westerly by a right line to a point on the western boundary of Lot 18, D.P. 2980, 17 chains south of the southern boundary of Lot 3, D.P. 12948 ; thence northerly along the western boundary of the said Lot 18, D.P. 2980, to the southern boundary of Lot 3, D.P. 12948 aforesaid ; thence easterly along the southern boundaries of Lot 3, D.P. 12948, Lot 4, D.P. 6012, Lot, 2 D.P. 13026, and Rural Section 6606 to a point 300 links south-west of the middle-line of Morgans Road ; thence in a northerly direction generally along a line parallel to and 300 links west of the middle-line of Morgans Road aforesaid to the middle of Pages Road ; thence south-easterly and southerly generally along the middle-lines of Pages Road and Morgans Road to the Waimataitai Creek ; thence easterly generally along the said Waimataitai Creek to the eastern boundary of Rural Section 5742, the point of commencement.

Also all that area in the Claremont Riding of the County of Levels, Canterbury Land District, containing 14½ acres, more or less, and bounded by a line commencing at a point on the western boundary of the City of Timaru on the southern side of Coonor Road and at the North-western corner of Lot 1 on D.P. 11027 ; thence in a southerly direction along the boundary of the City of Timaru (N.Z. Gazette No. 58, 2 October 1947, page 1414) to a point at the south-western end of St. George Street ; thence in a north-westerly direction along the north-eastern boundary of Rural Section 1690 to the southern side of Coonor Road ; thence easterly along the southern side of that road to the city boundary at the north-western corner of Lot 1, D.P. 11027, the point of commencement.
