Land Proclaimed as Street in the City of Christchurch

A PROCLAMATION

PURSUANT to section 29 of the Public Works Amendment Act 1948, I, Bernard Cyril, Baron Freyberg, the Governor-General of New Zealand, hereby proclaim as street the land described in the Schedule hereto.

SCHEDULE

APPROXIMATE area of the piece of land proclaimed as street: 7·5 perches.

Being part Lot 1, D.P. 1484, being part Rural Section 154.

Situated in the City of Christchurch (Canterbury R.D.). (S.O. 8410.)

In the Canterbury Land District; as the same is more particularly delineated on the plan marked P.W.D. 135961, deposited in the office of the Minister of Works at Wellington, and thereon coloured orange.

Given under the hand of His Excellency the Governor-General, and issued under the Seal of New Zealand, this 14th day of December 1951.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 5 of the Maori Purposes Act 1937, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby sets apart and reserves the Maori freehold land described in the Schedule hereto as a Maori reservation for the common use of the Tamakaimoana hapu of the Tuhoe Tribe as a meeting-house and dining-room reserve.

Revocation of Order in Council Declaring a Maori to be a European

At the Government House at Wellington, this 19th day of December 1951

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 525 of the Maori Land Act 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby revokes the Order in Council made pursuant to section 17 of the Maori Land Amendment Act 1912, on the 26th day of November 1923 and published in the Gazette of the 29th day of November 1923, at page 2895, declaring Abe Rarere, of Opoutama, Hawke’s Bay, to be a European.

Partial Revocation of Order in Council Vesting Land Owned by Maoris in a Maori Land Board for Non-payment of Rates

PURSUANT to section 63 of the Maori Purposes Act 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby revokes the Order in Council referred to in Part I of the Schedule hereto, in so far as it affects the land mentioned in Part II of the said Schedule.

Consenting to the Raising of Portion (£315,000) of the Otago Hospital Board’s Loan of £350,000

ORDER IN COUNCIL

At the Government House at Wellington, this 12th day of December 1951

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by Order in Council made on the 18th day of February 1948 (hereafter called the said Order in Council), and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising by the Otago Hospital Board (hereinafter called the said local authority) of a loan of three hundred and fifty thousand pounds (£350,000) to be known as “Hospital Loan No. 5 1947” (hereinafter called the said loan);

And whereas the authority conferred by the said Order in Council has not yet been exercised:

And whereas the aforesaid authority has lapsed in accordance with the provisions of clause (7) thereof and it is not now lawful or competent for the said local authority to raise the said loan or any portion thereof except in accordance with the provisions of a further Order in Council that may be issued pursuant to section 11 of the Local Government Loans Board Act 1926 (hereinafter called the said Act):

And whereas the said local authority is now desirous of raising portion of the said loan amounting to three hundred and fifteen thousand pounds (£315,000) (hereinafter called the said sum) and it is expedient to authorize the said local authority to raise the said sum on the conditions hereinafter set out:

Now, therefore, pursuant to section 11 of the said Act as set out in section 29 of the Finance Act 1932 (No. 2), His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the raising in New Zealand by the said local authority of the said sum up to the amount of three hundred and fifteen thousand pounds (£315,000) for the purpose for which the said loan was authorized, and in giving such consent hereby determines as follows:—

(1) The term for which the said sum or any part thereof may be raised shall not exceed twenty-five (25) years.

(2) The rate of interest that may be paid in respect of the said sum or any part thereof shall be such as shall not produce to the lender or lenders a rate or rates exceeding three pounds five shillings (£3 5s.) per centum per annum.

(3) The said sum or any part thereof shall be repaid by equal half-yearly instalments of principal extending over the term as determined in (1) above.

(4) The payment of interest and the repayment of principal in respect of the said sum shall be made in New Zealand.

(5) No amount payable as either interest or as principal in respect of the said sum shall be paid out of loan-moneys.

(6) The rate payable for brokerage, underwriting, and procurement fees in respect of the raising of the said sum or any part thereof shall not in the aggregate exceed one-half per centum of any amount raised.

(7) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.
