Consenting to the Raising of Loans by Certain Local Authorities and Prescribing the Conditions Thereof

ORDER IN COUNCIL
At the Government House at Wellington, this 31st day of October 1951.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS the several local authorities enumerated in the Schedule hereto, being desirous of raising the respective loans stated opposite their names therein, have respectively complied with the provisions of the Local Government Loans Board Act 1926 (hereinafter called the said Act), and it is expedient that the precedent consent of the Governor-General in Council, as required by the said Act, should be given to the raising of the said loans:
Now, therefore, pursuant to section 11 of the said Act, as set out in section 29 of the Finance Act 1932 (No. 2), His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the raising in New Zealand by the respective local authorities mentioned in the first column of the said Schedule of the respective loans set out in the second column of the said Schedule, up to the respective amounts specified in the third column of the said Schedule, and in giving such consent hereby determines as follows :—
(1) The terms for which the said loans or any parts thereof may be raised shall not exceed the respective terms (in years) stated in the fourth column of the said Schedule.
(2) The rates of interest that may be paid in respect of the said loans or any parts thereof shall be such as shall not produce to the lender or lenders a rate or rates exceeding the respective rates per centum per annum stated in the fifth column of the said Schedule.
(3) The said respective loans or any parts thereof, together with interest thereon, shall be repaid by equal aggregate annual or half-yearly instalments extending over the respective terms as determined in (1) above.
(4) The payment of such instalments shall be made in New Zealand, and no such instalment shall be paid out of loan-moneys.
(5) The rate payable for brokerage, underwriting, and procurement fees in respect of the raising of the said respective loans or any parts thereof shall not in the aggregate exceed one-half per centum of any amount raised.
(6) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.

Altering and Redefining the Boundaries of the Motunau and the Hurunui Rabbit Districts (Notice No. Ag. 5169)

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS by section 33 of the Rabbit Nuisance Act 1928 (hereinafter referred to as the said Act) it is enacted that the boundaries of two or more contiguous rabbit districts may from time to time be altered by the Governor-General in Council in accordance with a resolution proposing the alteration passed by the Board of each of the districts affected:
And whereas the districts known as the “Motunau Rabbit District” and the “Hurunui Rabbit District” (hereinafter referred to as the said districts) have been constituted under and for the purposes of Part II of the said Act:
And whereas a resolution was passed by the Board of the Motunau Rabbit District on the eleventh day of April, one thousand nine hundred and fifty-one, and a similar resolution was passed by the Board of the Hurunui Rabbit District on the thirteenth day of July, one thousand nine hundred and fifty-one, praying in each case for the alteration of the boundaries of the said districts in the manner described in the said resolutions and in the First Schedule hereto:
And whereas it is deemed expedient to alter and redefine the boundaries of the said districts in accordance with the said resolutions in manner hereinafter provided:
Now, therefore, in pursuance and exercise of the powers and authorities conferred upon him by the said Act, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby alters and redefines the boundaries of the said districts so constituted as aforesaid, and hereby declares—
(1) That the area described in the First Schedule hereto, being now part of the Hurunui Rabbit District, shall be added to and form part of the Motunau Rabbit District;
(2) That the boundaries of the Motunau Rabbit District shall be those set forth in the Second Schedule hereto; and
(3) That the boundaries of the Hurunui Rabbit District shall be those set forth in the Third Schedule hereto.
FIRST SCHEDULE
AREA EXCLUDED FROM THE HURUNUI RABBIT DISTRICT AND INCLUDED IN THE MOTUNAU RABBIT DISTRICT
ALL that parcel of land, situated in the Canterbury Land District, containing by admeasurement 75 acres 2 roods 4 perches, more or less, and being part of the land comprised in certificate of title, Volume 397, folio 166, and being Lot 1 on Deposited Plan 8423, part of Rural Section 32346, Block XVI, Stonyhurst Survey District.
SECOND SCHEDULE
BOUNDARIES OF THE MOTUNAU RABBIT DISTRICT
ALL that area in the Counties of Cheviot and Waipara of the Canterbury Land District, containing 57,875 acres 2 roods 4 perches, more or less, bounded by a line commencing at a point on the boundary of the Cheviot Rabbit District at the mouth of the Hurunui River; thence south-westerly along the sea-coast to the eastern boundary of the Hurunui Rabbit District (N.Z. Gazette No. 54, 15 September 1949, page 2298) at the south-western corner of Rural Section 30982; thence north-westerly along the south-western boundary of said Section 30982 to and along the north-western boundary of Lot 1, Deposited Plan 8423, to and northerly along the western boundary of R.S. 30983 to Vulcan Road; thence westerly along the north side of that road to and along the south-western boundaries of Lots 2 and 1, D.P. 13843, and along the north-western boundary of Lot 1 of the said D.P. 13843 to the road intersecting R.S. 10634; thence by that road in a north-easterly direction to a point opposite the south-western boundary of said R.S. 32936; thence to and along the south-western boundary of said R.S. 32936 and R.S. 27698 to and along the north-western boundary of said Section 27698, to and along the south-western boundary of Lot 1, Deposited Plan 8968, to and along the north-western boundary of R.S. 32935, to and along the southern boundary of Lot 2 and the northern boundary of Lot 3, Deposited Plan 8968, to and northerly along the western boundary of R.S. 10651, to and easterly along the Glendhu Road intersecting R.S. 10632, to and northerly along the Motunau Road intersecting Rural Sections 10632, 10650, &c., to and easterly along the Omih Valley Road (Main North Road) to the traffic bridge over the Hurunui River; thence to and easterly along the middle of the main stream of that river to its mouth at a point on the boundary of the Cheviot Rabbit District, being the point of commencement. Save and except from the above-described area Sections 9886, 9888, and 10585 in Block X, Stonyhurst Survey District.
THIRD SCHEDULE
BOUNDARIES OF THE HURUNUI RABBIT DISTRICT
ALL that area in the County of Waipara, Canterbury Land District, containing 253,024 acres 1 rood 36 perches, more or less, commencing at a point on the sea-coast at the mouth of the Waipara River; thence generally north-westerly up the middle of the main stream of that river to the confluence of the north and south branches of the said Waipara River; thence in a northerly direction along the eastern boundary of the Waitohi Rabbit District (N.Z. Gazette No. 54, 15 September 1949, page 2300) to the middle of the main stream of the Hurunui River; thence generally easterly along the middle of the main stream of that river to the traffic bridge at the Main Road North; thence generally in a southerly direction by the Main North Road and the western boundary of the Motunau Rabbit District hereinbefore described to the sea-coast; thence south-westerly along the sea-coast to the mouth of the main stream of the Waipara River, the point of commencement. Together with Rural Sections 9886, 9888, and 10585 in Block X, Stonyhurst Survey District.
