NOTICE OF INTENTION TO TAKE LAND

In the matter of the Public Works Act, 1928, and of the Municipal Corporations Act, 1933.

NOTICE is hereby given, under the provisions of the Public Works Act, 1928, that the Dargaville Borough Council proposes, under the provisions of the above-mentioned Acts, to take the pieces of land described in the Schedule hereto for street :

And notice is hereby further given that a plan of the pieces of land required to be taken is deposited in the public office of the Town Clerk to the said Council, situate in Hokianga Road, Dargaville, and is open for inspection without fee by all persons during ordinary office hours.

All persons affected by the taking of such lands who have any well-grounded objections to the taking of the said lands must state their objections in writing, and send the same within forty days from the first publication of this notice to the Town Clerk at the Council Chambers, Hokianga Road, Dargaville.

NOTICE is hereby given that a petition for the winding-up of the above-named company by the Supreme Court was on the 17th day of August 1951 presented to the said Court by Gerald Samuel Bonnici, of Putaruru, in the Dominion of New Zealand, Timber-merchant, and that the said petition is directed to be heard before the Court sitting at Auckland on the 28th day of September 1951 at 10 o’clock in the forenoon ; and any creditor or contributory of the said company desirous to support or oppose the making of an order on the said petition may appear at the time of hearing in person or by his counsel for that purpose ; and a copy of the petition will be furnished to any creditor or contributory of the said company requiring the same by the undersigned on payment of the regulated charge for the same.

NOTICE OF REDUCTION OF CAPITAL

In the matter of the Companies Act 1933 and in the matter of A. DALLIMORE AND SONS, LIMITED, a company duly incorporated under the Companies Act 1933, having its registered office at 231 Hastings Street, Napier, and carrying on business there as a plastering contractor and manufacturer of fibrous plaster.

NOTICE is hereby given that an order of the Supreme Court of New Zealand, dated the 9th day of August 1951, confirming the reduction of the capital of the above-named company from three thousand seven hundred and fifty pounds (£3,750), to three thousand one hundred and twenty-five pounds (£3,125), and the minute approved by the Court showing with respect to the capital of the company as altered, the several particulars required by the above-mentioned Act was registered by the Registrar of Companies on the 31st day of August 1951. The said minute is in the words and figures following :—

“ The capital of A. Dallimore and Sons, Limited, henceforth is divided into £3,125 divided into 3,750 shares of 16s. 8d. each instead of the original capital of three thousand seven hundred and fifty pounds (£3,750) divided into 3,750 shares of £1 each. At the time of registration of this minute the sum of 16s. 8d. each is to be deemed paid up on each of the said shares, and that the difference between the said sum of £625 and £598—to wit, the sum of £27—be transferred to capital reserve and thus not to be available for distribution by way of dividends.”

Notice of Voluntary Winding-up Resolution

NOTICE is hereby given that, pursuant to section 222 of the Companies Act 1933, at an extraordinary general meeting of the above-named company duly convened and held on the 3rd day of September 1951, the following resolution was duly passed :—

“ That the company be wound up voluntarily, and that CLAUDE WHITNEY EVANS, of Christchurch, Public Accountant, be and is hereby appointed liquidator of the company.”

DUNEDIN CITY COUNCIL

RESOLUTION MAKING SPECIAL RATE

Northern Outlet Loan 1951 of £75,000

IN pursuance and exercise of the powers vested in it in that behalf by the Local Bodies’ Loans Act 1926, the Dunedin City Council hereby resolves as follows :—

“ That, for the purpose of providing the interest and other charges on a loan of £75,000, authorized to be raised by the Dunedin City Council under the above-mentioned Act for the purpose of meeting the Council’s share of the cost of acquiring land for and constructing the city section of a main highway through and to the north of the City of Dunedin via Leith Valley, the said Dunedin City Council hereby makes and levies a special rate of three farthings (¾d.) in the (£) upon the rateable value (on the basis of the annual value) of all rateable property of the City of Dunedin, comprising the whole of the City of Dunedin ; and that such special rate shall be an annually recurring rate during the currency of such loan, and be payable yearly on the first (1st) day of June in each and every year during the currency of such loan, being a period of twenty (20) years, or until the loan is fully paid off.”

I hereby certify that the above is a true and correct copy of the resolution passed by the Dunedin City Council on the above-mentioned date.
