CONDITIONS
1. IMPLIED CONDITIONS
The conditions directed to be implied in all licences by the Water-power Regulations 1934 and the Electrical Supply Regulations 1935 shall be incorporated in and shall form part of this licence, except in so far as the same may be inconsistent with the provisions hereof.
2. LICENCE SUBJECT TO REGULATIONS
This licence is issued under the Water-power Regulations 1934 and is subject thereto and to the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1935, and the Radio Interference Regulations 1934, and to all regulations hereafter made in amendment thereof or in substitution therefor respectively.
3. UTILIZATION OF WATER AND LOCATION OF HEADWORKS
Water shall be used under this licence solely for the purpose of generating electricity and shall be taken from the said stream at the point in Run 89, Block VII, Tasman Survey District, indicated on the plan marked S.H.D. 140, deposited in the office of the Minister in Charge of the State Hydro-electric Department.
4. GENERAL DESCRIPTION OF WORKS
The licensees are hereby authorized, subject to the conditions hereof, to construct, maintain, and use the following works for the purposes of this licence, the positions of the said works being indicated on the said plan S.H.D. 140 :—
(a) Headworks consisting of a dam and intake with a pipeline leading to the power-house hereinafter referred to, giving a static head of approximately 350 ft. :
(b) A Pelton wheel and power-house with all necessary equipment for generating electricity situated in Run 89, Block VII, Tasman Survey District :
(c) A tail-race leading from the said power-house to the Tasman River :
(d) An electric line leading from the said power-house and proceeding in a southerly direction across two streams, thence in a south-easterly direction to a transformer situated in the said Run 89, the said line being shown by means of a red line on the said plan S.H.D. 140 :
(e) Electric lines leading from the said transformer to a cookhouse, huts, a woolshed, two cottages, the homestead, and a store building, all being situated in the said Run 89, the said lines being more particularly shown by means of purple lines on the said plan S.H.D.140.
5. SYSTEM OF SUPPLY
The system of supply shall be a single-phase alternating current system. The generating voltage shall be 230 volts. The transmission system shall be classified under paragraph (j) of Clause 21–01 of the Electrical Supply Regulations 1935 and shall be a single-wire earth-return system at a voltage of 3,300 volts. The distribution system shall be as described in paragraph (d) of Clause 21–01 of the Electrical Supply Regulations 1935.
6. DURATION OF LICENCE
Unless sooner lawfully determined, this licence shall continue in force until the 31st day of March, 1972.
7. RENTAL
For the purpose of assessing the rental or annual sum payable in respect of this licence, the licensee may install a suitable maximum-demand indicator to the satisfaction of the Inspecting Engineer of the State Hydro-electric Department and failing such installation the rental shall be assessed on the maximum generating capacity of the plant installed. The present plant is rated at 12·5 kilowatts.
8. NO RIGHT TO WATER CONFERRED
Nothing in this licence shall of itself confer upon the licensees any right to water.

Authorizing William Manuel Turner, of Mayfield, Farmer, to Use Water for the Purpose of Generating Electricity and to Erect Certain Electric Lines

At the Government House at Wellington, this 6th day of June, 1951

His Excellency the Governor-General in Council
PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby grant to William Manuel Turner, of Mayfield, Farmer (hereinafter referred to as the licensee), a licence subject to the conditions hereinafter set forth, to take and use from a race (hereinafter referred to as the said race) leading from the Ashburton River, situated in R.S. 27050, Block VIII, Shepherds Bush Survey District, in the Land District of Canterbury, for the purposes hereinafter set forth, a stream of water not exceeding three cubic feet per second at any one time, and to lay, construct, put up, place, and use the electric lines hereinafter described.

(a) Headworks consisting of an intake, water-race, and pipelines leading to the waterwheel and powerhouse hereinafter referred to :
(b) Waterwheel and power-house with all necessary equipment for generating electricity, situated in R.S. 27050, Block VIII, Shepherds Bush Survey District :
(c) Tail-race leading from the said waterwheel to the said race :
(d) Electric lines leading from the said power-house across Hackthorne Road to a dwelling situated in R.S. 10982, Block VIII, Shepherds Bush Survey District.
5. DURATION OF LICENCE
This licence, unless sooner lawfully determined, shall continue in force until the 31st day of March, 1971, or until electrical energy is available from an Electric-power Board or other public source of supply, whichever is the earlier.
6. SYSTEM OF SUPPLY
The system of supply shall be classified under paragraph (j) of clause 21–01 of the Electrical Supply Regulations 1935, and shall be a direct current system with a generating voltage and a distribution voltage of 110 volts.
7. RENTAL
For the purpose of assessing the rental or annual sum payable in respect of this licence, the licensee may install a suitable maximum-demand indicator to the satisfaction of the Inspecting Engineer of the State Hydro-electric Department, and failing such installation, the rental shall be determined on the maximum capacity of the generating plant installed. The present plant is rated at 1·5 kilowatts.
8. NO RIGHT TO WATER CONFERRED
Nothing in this licence shall of itself confer upon the licensee any right to water.

Authorizing the Acquisition of Land Notwithstanding the Provisions as to Limitation of Area

At the Government House at Wellington, this 30th day of May, 1951

His Excellency the Governor-General in Council
PURSUANT to section 246 of the Maori Land Act, 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby authorize the disposition to and acquisition by Roger Felix Hutchinson, of Gisborne, Sheep-farmer, by way of sale, of all the land described in the Schedule hereto, notwithstanding the provisions of Part XII of the said Act.
SCHEDULE
ALL that parcel of land situated in Block V, Turanganui Survey District, containing 2 acres 20 perches, more or less, being the block called or known as Okahukurata A, and being the whole of the land in Certificate of Title, Volume 75, folio 183 (Gisborne Registry).
