Consenting to the Raising of the Balance (£4,100) of the Christchurch City Council's Loan of £120,730, and Prescribing the Conditions Thereof

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL

WHEREAS by Order in Council made on the 23rd day of July, 1947, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising by the Christchurch City Council (hereinafter called the said local authority) of a loan of one hundred and twenty thousand seven hundred and thirty pounds (£120,730) to be known as "Water-supply Extension Loan, 1947" (hereinafter called the said loan) :

And whereas by Order in Council made on the 20th day of July, 1949, the period within which the amount then unraised, amounting to ten thousand seven hundred pounds (£10,700), might be borrowed was extended to three (3) years from the date of the Order in Council made on the 23rd day of July, 1947 :

And whereas the authority conferred by the Order in Council made on the 23rd day of July, 1947, has still not yet been exercised to the extent of four thousand one hundred pounds (£4,100) :

And whereas the aforesaid authority has lapsed in accordance with the provisions of clause (7) of the Order in Council made on the 23rd day of July, 1947, as varied by the Order in Council made on the 20th day of July, 1949, and it is not now lawful or competent for the said local authority to raise the balance of the said loan or any portion thereof, except in accordance with the provisions of a further Order in Council that may be issued pursuant to section 11 of the Local Government Loans Board Act, 1926 (hereinafter called the said Act) :

And whereas the said local authority is now desirous of raising the balance of the said loan amounting to four thousand one hundred pounds (£4,100) (hereinafter called the said sum) and it is expedient to authorize the said local authority to raise the said sum or portion thereof on the conditions hereinafter set out :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section 11 of the said Act, as set out in section 29 of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth consent to the raising in New Zealand by the said local authority of the said sum up to the amount of four thousand one hundred pounds (£4,100) for the purpose for which the said loan was authorized and in giving such consent doth hereby determine as follows :—

(1) The rate of interest that may be paid in respect of the said sum or any part thereof shall be such as shall not produce to the lender or lenders a rate or rates exceeding three pounds two shillings and sixpence (£3 2s. 6d.) per centum per annum.

(2) The said sum or any part thereof shall be repaid by the annual redemption of debentures on the dates set out in the first column of the Schedule hereunder of the amounts stated opposite each such date in the second column of the said Schedule.

(3) The payment of interest and the redemptions in respect of the said sum shall be made in New Zealand.

(4) No amount payable either as interest or as a redemption in respect of the said sum shall be paid out of loan-moneys.

(5) The rate payable for brokerage, underwriting, and procuration fees in respect of the raising of the said sum or any part thereof shall not in the aggregate exceed one-half per centum of any amount raised.

(6) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.

The Southern Side of Portion of Currie Lane, in the City of New Plymouth, Exempted From the Provisions of Section 128 of the Public Works Act, 1928

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 128 of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the New Plymouth City Council on the 16th day of April, 1951, viz. :—

"The New Plymouth City Council, being the local authority having control of the streets in the City of New Plymouth, by resolution declares that the provisions of section 128 of the Public Works Act, 1928, shall not apply—

(a) To the southern side of the portion of Currie Lane adjoining Lot 1, Deposited Plan No. 4806, part Section 923, Town of New Plymouth, being part of the land in Certificate of Title, Volume 115, folio 150 (Taranaki Registry)."

such portion of street being described in the Schedule hereto.

SCHEDULE
THE southern side of all that portion of street situated in the Taranaki Land District, City of New Plymouth, known as Currie Lane, fronting Lot 1, D.P. 4806, being part Section 923, Town of New Plymouth. As the same is more particularly delineated on the plan marked P.W.D. 134105, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Authorizing the Laying-off of a Street off Botanical Road, in the City of Palmerston North, Subject to a Condition as to the Building-line

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 31 of the Municipal Corporations Amendment Act, 1948, and section 125 of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council, doth hereby authorize the Palmerston North City Council to permit the laying-off of the proposed street described in the Schedule hereto at a width for part of its length of less than 66 feet, but not less than 50 feet, subject to the condition that no building or part of a building shall at any time be erected on Lots 5 to 24, inclusive, of a subdivision of the land fronting the said street (as shown on the plan marked P.W.D. 134161 referred to in the Schedule hereto) within a distance of 48 feet from the centre-line of the said street, or on Lot 1 of the said subdivision within a distance of 29 feet 6 inches from the centre-line of the said street.

SCHEDULE
THAT proposed street in the Wellington Land District, City of Palmerston North, containing by admeasurement 3 roods 22.25 perches, more or less, being part Lots 56 and 57, D.P. 461, being part Rural Section 287, Township of Palmerston North. As the same is more particularly delineated on the plan marked P.W.D. 134161, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Authorizing the Laying-off of Lancaster Street (Extension) in the Borough of Levin, Subject to a Condition as to the Building-line

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 31 of the Municipal Corporations Amendment Act, 1948, and section 125 of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council, doth hereby authorize the Levin Borough Council to permit the laying-off of the proposed street, described in the Schedule hereto, at a width for the whole of its length of less than 66 feet, but not less than 50 feet, subject to the condition that no building or part of a building shall at any time be erected on the land fronting the proposed street within a distance of 48 feet from the centre-line of the said street.

SCHEDULE
THAT proposed street in the Wellington Land District, Borough of Levin, containing by admeasurement 1 rood 32.7 perches, more or less, being part Section 14, Levin Village Settlement, being also part Lot 7, D.P. 8303.
As the same is more particularly delineated on the plan marked P.W.D. 134210, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
