Authorizing the Laying-off of Carew Street (Extension) in the Borough of Kaiapoi, Subject to a Condition as to the Building-line

At the Government House at Wellington, this 23rd day of May, 1951

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 31 of the Municipal Corporations Amendment Act, 1948, and section 125 of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council, doth hereby authorize the Kaiapoi Borough Council to lay-off the proposed street described in the Schedule hereto at a width for part of its length of less than 66 feet, but not less than 49 feet 4 inches, subject to the condition that no building or part of a building shall at any time be erected on the land shown edged green on the plan marked P.W.D. 134179, referred to in the said Schedule, within a distance of 48 feet from the centre-line of the said street.

THAT proposed street in the Canterbury Land District, Borough of Kaiapoi, being an extension of Carew Street, containing by admeasurement 3 roods 5 perches, more or less, being part Lot 1, D.P. 12323, part Rural Section 321, and other part Rural Section 321. As the same is more particularly delineated on the plan marked P.W.D. 134179, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Authorizing the Acquisition of Land Notwithstanding the Provisions as to Limitation of Area

THE HON. W. SULLIVAN PRESIDING IN COUNCIL

PURSUANT to section 246 of the Maori Land Act, 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby authorize the disposition to and acquisition by the New Zealand Co-operative Dairy Company, Limited, by way of sale, of the land mentioned in the Schedule hereto or any portion thereof, notwithstanding the provisions of Part XII of the said Act.

ALL that area of land in the Rotorua Survey District containing by admeasurement 1 rood 28 perches, more or less, being part of the land called or known as Parawai 2D, being Lots 1 and 4 on Deposited Plan No. 26203, and being part of the land in Certificate of Title, Volume 213, folio 86 (Auckland Registry).

Authorizing the Exchange of Portion of a Reserve in Block I, Otahuhu Survey District, North Auckland Land District, for Other Land

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS the land described in the First Schedule hereto forms portion of a reserve vested in the Mayor, Councillors, and Burgesses of the Borough of Mount Roskill for recreation purposes pursuant to section 332 of the Municipal Corporations Act, 1933, and is portion of a reserve subject to the provisions of the Public Reserves, Domains, and National Parks Act, 1928 : And whereas it is expedient that the said land should be exchanged for the land described in the Second Schedule hereto, which the Governor-General deems of equal value and more suitable for the purposes of the reserve :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section 8 of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby declare that the land described in the First Schedule hereto may be exchanged for the land described in the Second Schedule hereto.

FIRST SCHEDULE

DESCRIPTION OF PORTION OF RESERVE AUTHORIZED TO BE EXCHANGED

North Auckland Land District

ALL that area situated in Block I, Otahuhu Survey District, containing by admeasurement 0·75 perches, more or less, being Lot 2, as shown on a plan deposited in the Land Registry Office at Auckland under No. 37829, being part of Allotment 8 of Section 13, Suburbs of Auckland, and being part of the land comprised and described in Certificate of Title, Volume 150, folio 245 (Auckland Registry). As the same is more particularly delineated on the plan marked L. and S. 16/2733B, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red.

DESCRIPTION OF LAND TO BE OBTAINED IN EXCHANGE THEREFOR

North Auckland Land District

All that area situated in Block I, Otahuhu Survey District, containing by admeasurement 4·12 perches, more or less, being Lot 1, as shown on a plan deposited in the Land Registry Office at Auckland under No. 37829, being part of Allotment 8 of Section 13, Suburbs of Auckland, and being part of the land comprised and described in Certificate of Title, Volume 920, folio 104 (Auckland Registry). As the same is more particularly delineated on the plan marked L. and S. 16/2733B, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged green.

Vesting a Reserve in the Weber County Council

WHEREAS the land described in the Schedule hereto has been duly set apart as a reserve for a site for a roadman’s cottage : And whereas, in the opinion of the Governor-General, it is expedient to vest the said reserve in the Chairman, Councillors, and Inhabitants of the County of Weber :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section 9 of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby declare that from and after the day of the date hereof the reserve described in the Schedule hereto shall become vested in the Chairman, Councillors, and Inhabitants of the County of Weber, in trust, for a reserve for a site for a roadman’s cottage.

WHEREAS the land described in the Schedule hereto is a reserve for a site for a police-station :

And whereas it is expedient that the purpose of the reservation over such land shall be changed to a reserve for a site for a roadman’s cottage :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by subsection (1) (a) of section 7 of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby declare that the purpose of the reserve described in the Schedule hereto is hereby changed from a reserve for a site for a police-station to a reserve for a site for a roadman’s cottage.
