Consenting to the Raising of the Balance (£718,000) of the Dunedin City Council’s Loan of £858,000 and Prescribing the Conditions Thereof.

Present:
THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL
WHEREAS by Order in Council made on the 12th day of March, 1947, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising by the Dunedin City Council (hereinafter called the said local authority) of a loan of eight hundred and fifty-eight thousand pounds (£858,000) to be known as “Transport and Streets Reconstruction Loan, 1946” (hereinafter called the said loan), for the purpose of (a) replacing the whole of the existing city passenger-transport systems with an electric trolley-bus system, £700,000; (b) paving tramway track areas and reconstructing streets on the trolley-bus routes, £72,000; and (c) widening and regrading Albert Street, £86,000:
And whereas by Order in Council made on the 2nd day of March, 1949, certain of the determinations aforesaid were varied:
And whereas the authority conferred by the Order in Council made on the 12th day of March, 1947, has lapsed in accordance with the provisions of clause (7) thereof and it is not now lawful or competent for the said local authority to raise the said loan or any portion thereof except in accordance with the provisions of a further Order in Council that may be issued pursuant to section 11 of the Local Government Loans Board Act, 1926 (hereinafter called the said Act):
And whereas an amount of one hundred and forty thousand pounds (£140,000) only has been raised, comprising portion, £130,000, of the amount of £700,000 specified in purpose (a) above and portion, £10,000, of the amount of £158,000 specified in purposes (b) and (c) above:
And whereas the said local authority is now desirous of raising the balance of the said loan amounting to seven hundred and eighteen thousand pounds (£718,000) (hereinafter called the said sum) and it is expedient to authorize the said local authority to raise the said sum on the conditions hereinafter set out:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section 11 of the said Act, as set out in section 29 of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising in New Zealand by the said local authority of the said sum up to the amount of seven hundred and eighteen thousand pounds (£718,000) for the purpose for which the said loan was authorized and in giving such consent doth hereby determine as follows:
(1) The term for which the said sum or any part thereof may be raised shall not exceed twenty (20) years.
(2) The rate of interest that may be paid in respect of the said sum or any part thereof shall be such as shall not produce to the lender or lenders a rate or rates exceeding three pounds five shillings (£3 5s.) per centum per annum.
(3) The said local authority shall, before raising the said sum or any part thereof, make provision for the repayment thereof by establishing a sinking fund under the Local Bodies’ Loans Act, 1926, or under such other statutory enactment as may be applicable, and shall thereafter make payments to such sinking fund at intervals of not more than one year at a rate or rates per centum calculated as follows:—
(a) In respect of that portion of the said sum amounting to five hundred and seventy thousand pounds (£570,000), being the balance of the amount of seven hundred thousand pounds (£700,000) specified in purpose (a) above, at a rate per centum which shall be not less than two pounds five shillings (£2 5s.) for the first ten (10) years of the term as specified in (1) above and not less than five pounds thirteen shillings and eleven pence (£5 13s. 11d.) over the remaining ten (10) years of the term.
(b) In respect of that portion of the said sum amounting to one hundred and forty-eight thousand pounds (£148,000), being the balance of the amount of one hundred and fifty-eight thousand pounds (£158,000) specified in purposes (b) and (c) above, at a rate or rates per centum which shall be not less than three pounds fourteen shillings and five pence (£3 14s. 5d.) over the whole term of twenty (20) years as specified in (1) above.
Such payments shall be made in respect of every part of the respective portions for the time being so borrowed and not repaid, the first such payment in each case to be made not later than one year after the first day from which interest to the lender or lenders is computed on the said respective portions or any parts thereof so raised.
(4) The payment of interest and the repayment of principal in respect of the said sum shall be made in New Zealand.
(5) No amount payable as either interest or sinking fund in respect of the said sum shall be paid out of loan-money.
(6) The rate payable for brokerage, underwriting, and procurement fees in respect of the raising of the said sum or any part thereof shall not in the aggregate exceed one-half per centum of any amount raised.
(7) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.

Varying the Determinations in Respect of the Dunedin City Council’s Loan of £39,600 by Extending the Term Within Which the Said Loan May be Raised

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL
WHEREAS by Order in Council made on the 27th day of April, 1949 (hereinafter called the said Order in Council), subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Dunedin City Council (hereinafter called the said local authority) of a loan of thirty-nine thousand six hundred pounds (£39,600) to be known as “Development Loan, 1946” (hereinafter called the said loan):
And whereas the authority conferred by the said Order in Council has not yet been exercised and it is expedient to extend the term as specified in clause (7) of the said Order in Council within which the said loan or any portion thereof may be raised:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section 11 of the Local Government Loans Board Act, 1926, as set out in section 29 of the Finance Act, 1932 (No.2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations aforesaid in respect of the said loan by prescribing that no moneys shall be borrowed under the consent given by the said Order in Council after the expiration of four (4) years from the date thereof.
