PURSUANT to the Milk Act, 1944, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby make the following Order.
ORDER
- (1) THIS Order may be cited as the Auckland Metropolitan Milk Board Constitution Order 1945, Amendment No. 1, and shall be read together with the deemed part of the Auckland Metropolitan Milk Board Constitution Order 1945* (hereinafter referred to as the principal Order).
(2) This Order shall have effect for the purpose of the election of the members of the Auckland Metropolitan Milk Board next following the making of this Order, and for the purpose of every subsequent election of any member or members of the Board.
- The principal Order is hereby amended by revoking the Schedule thereto, and substituting the following Schedule:—

Revoking Appointment of Houhora as a Place in Which a Magistrate’s Court May be Held

WHEREAS by an instrument dated the 15th day of December, 1948, published in the New Zealand Gazette on the 16th day of the same month at page 1541, Houhora was appointed, pursuant to section 4 of the Magistrates’ Courts Act, 1947, as a place in which a Magistrate’s Court might be held for the exercise of criminal jurisdiction:
And whereas by an instrument dated the 21st day of January, 1949, and published in the New Zealand Gazette on the 27th day of the same month at page 114, the Magistrate’s Court held at Houhora was authorized to deal with matters under the Destitute Persons Act, 1910, or under any rules and regulations made under that Act:
And whereas by an instrument dated the 18th day of January, 1950, published in the New Zealand Gazette on the 26th day of the same month at page 55, the said Magistrate’s Court held at Houhora was authorized to deal with matters arising under the Imprisonment for Debt Limitation Act, 1908, or under any rules made with respect to Magistrates’ Courts pursuant to section 2 of that Act:
And whereas it is expedient to revoke the said appointment and the said authorizations:
Now, therefore, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, acting pursuant to subsection (5) of section 4 of the Magistrates’ Courts Act, 1947, do hereby revoke the said appointment and the said authorizations and declare that this revocation shall take effect on and after the 1st day of January, 1951.
As witness the hand of His Excellency the Governor-General of the Dominion of New Zealand, this 21st day of December, 1950.

Vesting the Control of an Historic Reserve in the Hone Heke Memorial Board

IN pursuance and exercise of the powers and authorities conferred upon him by section 13 of the Scenery Preservation Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand doth hereby vest the control of the reserve described in the Schedule hereto (being land reserved under the said Act), for the period of five years from the date hereof (unless previously amended or revoked under the said Act), in the undermentioned persons, namely,—
His Worship the Mayor of Kaikohe, ex officio,
The Chairman of the Bay of Islands County Council, ex officio,
Tuhi Maihi, and
Hone Heke Rankin,
who are hereby constituted for that purpose a special Board by the name of the Hone Heke Memorial Board (herein referred to as the Board), in trust, for the preservation of scenery, and with the powers and subject to the conditions hereinafter contained, that is to say:—

The first meeting of the Board shall be held on Thursday, the 25th day of January, 1951, at 7.30 o’clock p.m., at the Kaikohe Council Chambers, Pausina’s Buildings, Broadway, Kaikohe, and thereafter the Board shall meet for the transaction of business at such time and place as may from time to time be fixed by the Board.

The members of the Board shall at their first meeting, and thereafter at the annual meeting hereinafter mentioned, elect one of themselves to be Chairman, who may join in the discussion and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

Special meetings may be convened by the Chairman, provided that two days’ notice of any such meeting is given to each member specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

Any two members of the Board shall form a quorum. Any meeting may be adjourned from time to time.

If at any meeting the Chairman is not present at the time appointed for holding the same the members present shall choose one of their number to be Chairman of such meeting.

If, by resignation, death, incapacity, or otherwise, the seat of any member shall be or become vacant, or if any member absents himself, without reasonable cause, from three consecutive meetings of the Board, the Governor-General shall have power to appoint any other person to be a member of the Board in his stead.

All questions shall be determined by the majority of votes of the members of the Board present at the meeting.

The Board shall prepare and submit at an annual meeting to be held in the month of April in each year a report of the proceedings of the Board for the previous year ending on the 31st day of March, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister in Charge of Scenery Preservation as soon as possible after each annual meeting.

The Board shall control the said reserve in accordance with the provisions of the said Act and of the regulations made thereunder.
SCHEDULE
NORTH AUCKLAND LAND DISTRICT
ALL that area in the Borough of Kaikohe, situated in Block XV, Omapere Survey District, containing by admeasurement 5 acres 2 roods 29 perches, being Lots 1 and 2 as shown on a plan deposited in the Land Registry Office at Auckland, under No. 30163, and being parts Taraire No. 1w 2b Block. As the same is more particularly delineated on the plan marked L. and S. 7/769c, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red.
As witness the hand of His Excellency the Governor-General, this 21st day of December, 1950.

Land Reserved in Southland Land District

WHEREAS by section 167 of the Land Act, 1948, it is enacted that the Governor-General may from time to time set apart as a reserve, notwithstanding that the same may be then held under pastoral lease or pastoral occupation licence, any Crown land for any purpose which, in his opinion, is desirable in the public interest, and notice thereof shall be published in the New Zealand Gazette.
Now, therefore, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon me by the said Act, do hereby reserve the land in the Southland Land District, described in the Schedule hereunder written, for an addition to a site for a boys’ high school.
SCHEDULE
SOUTHLAND LAND DISTRICT
ALL that area containing by admeasurement 1 rood 28·7 perches, more or less, being Lot 8 on a plan deposited in the Land Registry Office at Invercargill under No. 696, being part of Section 23, Block I, Invercargill Hundred. As the same is more particularly delineated on the plan marked L. and S. 6/6/220p, deposited in the Head Office, Department of Lands and Survey, at Wellington; and thereon edged red.
As witness the hand of His Excellency the Governor-General, this 21st day of December, 1950.
