The Northern Side of Portion of Allen Street, in the City of Christchurch, Exempted From the Provisions of Section 128 of the Public Works Act, 1928

At the Government Buildings at Wellington, this 22nd day of November, 1950

Present:

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL

PURSUANT to section 128 of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Christchurch City Council on the 28th day of August, 1950, in so far as it affects the side and portion of street described in the Schedule hereto, viz. :—

“The Christchurch City Council, being the Local Authority having control of the streets in the City of Christchurch, by resolution declares that the provisions of section 128 of the Public Works Act, 1928, shall not apply to the northern side of the portion of Allen Street adjoining Town Reserve 94 and being all of the land in Certificate of Title, Volume 229, folio 289, Canterbury Registry.”


SCHEDULE

THE northern side of all that portion of street situated in the Canterbury Land District, City of Christchurch, known as Allen Street, fronting part Lot 94 of the Christchurch Town Reserves.

Cancelling a Condition as to Setting-back the Building-line of Portion of Cuba Street in the City of Wellington, Imposed by Memorandum of Acceptance Under Section 128 of the Public Works Act, 1928

PURSUANT to section 131 of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend the Memorandum of Acceptance registered in the Land Registry Office at Wellington under number K. 28543, exempting portion of the eastern side of Cuba Street in the City of Wellington from the provisions of section 128 of the Public Works Act, 1928, subject to a condition as to the building-line by cancelling the building-line condition imposed by the said Memorandum of Acceptance.

Varying a Condition as to Setting-back the Building-line of a Street Known as Alexander Road, in the Borough of Tauranga, Imposed by Order in Council, Under the Municipal Corporations Act, 1933, and the Public Works Act, 1928

PURSUANT to section 27 of the Public Works Amendment Act, 1948, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council, doth hereby amend the Order in Council dated the 3rd day of September, 1941, and published in the New Zealand Gazette No. 73 of the 4th day of the same month, at page 2716, and deposited in the Land Registry Office at Auckland under No. 10829, authorizing the Tauranga Borough Council to permit the laying-off of a street (now known as Alexander Road) between Hunter Street and Wrigley Street in the Borough of Tauranga, of a width less than 66 feet but not less than 50 feet subject to a condition as to the building-line, by varying the condition with regard to the building-line imposed by the said Order in Council, so that no building or part of a building shall at any time be erected on Lot 12, D.P. 29504, being the land comprised and described in Certificate of Title, Volume 842, folio 104 (Auckland Land Registry), within a distance of 32 feet 2 inches from the centre-line of the portion of Alexander Road fronting the said Lot 12, D.P. 29504.

Authorizing the Laying-off of a Street (Extension of Seaview Avenue), in the Borough of Northcote, Subject to a Condition as to the Building-line

At the Government Buildings at Wellington, this 22nd day of November, 1950

Present:

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL

PURSUANT to section 31 of the Municipal Corporations Amendment Act, 1948, and section 125 of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council, doth hereby authorize the Northcote Borough Council to permit the laying-off of the proposed street described in the Schedule hereto at a width for the whole of its length of less than 66 feet but not less than 40 feet, subject to the condition that no building or part of a building shall at any time be erected on the land shown edged green on the plan marked P.W.D. 132698, referred to in the said Schedule, within a distance of 48 feet from the centre-line of the said street.


SCHEDULE

THAT proposed street in the North Auckland Land District, Borough of Northcote, containing by admeasurement 16·3 perches, more or less, being parts of Allotment 54, Parish of Takapuna. As the same is more particularly delineated on the plan marked P.W.D. 132698, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Exempting Land in the South Auckland Land District From the Operation of Part III of the Coal-mines Act, 1925

IN pursuance and exercise of the powers and authorities conferred upon me by subsection (2) of section 171 of the Coal Mines Act, 1925, and all other powers and authorities enabling me in this behalf, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby declare that the land described in the Schedule hereto shall be exempt from the operation of Part III of the Coal Mines Act, 1925, and do hereby further declare that this notice shall take effect as from the date of the publication hereof in the New Zealand Gazette.


SCHEDULE

ALL that area of land in the South Auckland Land District containing by admeasurement 125 acres and 18 perches, more or less, being Lot 1 on a plan deposited in the Land Registry Office at Auckland under Number 34706, which said piece of land comprises:—

(a) Part of the southern portion of Section 158 and part of Sections 157, 210, and 214, Parish of Waipa, being part of the land in Certificate of Title, Volume 883, folio 298, Auckland Registry.

(b) Parts of the Northern portion of Section 158, Parish of Waipa, and southern portion of Section 159, Parish of Waipa, being part of the land in Certificate of Title, Volume 67, folio 180, Auckland Registry.

(c) Part of the north-eastern portion of Section 159, Parish of Waipa, part of the eastern portion of Section 160, Parish of Waipa, and the whole of Section 161, Parish of Waipa, being part of the land in Certificate of Title, Volume 72, folio 44, Auckland Registry.

(d) The whole of Section 162, Parish of Waipa, and the whole of the south-western portion of Section 163, Parish of Waipa, being the whole of the land in Certificate of Title, Volume 159, folio 166, Auckland Registry, subject to Part XIII of the Land Act, 1908.

As witness the hand of His Excellency the Governor-General, this 15th day of November, 1950.
