Consenting to the Raising of a Loan of £10,000 by the Timaru City Council and Prescribing the Conditions Thereof

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 15th day of November, 1950

Present:

THE HON. K. J. HOLYOAKE PRESIDING IN COUNCIL

WHEREAS the Timaru City Council (hereinafter called the said local authority) being desirous of raising a loan of ten thousand pounds (£10,000) to be known as “Timaru Housing Loan, 1950” (hereinafter called the said loan), for the purpose of erecting houses for sale or lease including the purchase of land for that purpose, has complied with the provisions of the Local Government Loans Board Act, 1926 (hereinafter called the said Act), and it is expedient that the precedent consent of the Governor-General in Council, as required by the said Act, should be given to the raising of the said loan:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section 11 of the said Act, as set out in section 29 of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising in New Zealand by the said local authority of the said loan for the said purpose up to the amount of ten thousand pounds (£10,000) and in giving such consent doth hereby determine as follows:—

(1) The term for which the said loan or any part thereof may be raised shall not exceed twenty-five (25) years.

(2) The rate of interest that may be paid in respect of the said loan or any part thereof shall be such as shall not produce to the lender a rate exceeding three pounds (£3) per centum per annum.

(3) The said loan or any part thereof, together with interest thereon, shall be repaid by equal aggregate annual or half-yearly instalments extending over the term as determined in (1) above.

(4) The payments of such instalments shall be made in New Zealand, and no instalments shall be paid out of loan-moneys.

(5) No amount shall be payable for brokerage, underwriting, or procurement fees in respect of the raising of the said loan or any part thereof.

(6) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.

Consenting to Stopping Road in Block VI, Komakorau Survey District, Waikato County

THE HON. K. J. HOLYOAKE PRESIDING IN COUNCIL

PURSUANT to section 149 of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the Waikato County Council stopping the portion of road described in the Schedule hereto.

SCHEDULE

APPROXIMATE area of the piece of road permitted to be stopped:

3 roods 13·1 perches.

Adjoining Lots 21, 22, 23, 24, and 25, D.P. 284, being part of the land granted to the New Zealand Loan and Mercantile Agency Company, Limited, in 1876.

Situated in Block VI, Komakorau Survey District (Auckland R.D.). (S.O. 34658.)

In the South Auckland Land District; as the same is more particularly delineated on the plan marked P.W.D. 132661, deposited in the office of the Minister of Works at Wellington, and thereon coloured green.

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL

PURSUANT to section 112 of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portions of road described in the Schedule hereto shall, on and after the date of this Order in Council, become Government road.

The South-eastern Side of Portion of Cuba Street in the City of Wellington, Exempted From the Provisions of Section 128 of the Public Works Act, 1928

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 22nd day of November, 1950

Present:

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL

PURSUANT to section 128 of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wellington City Council on the 15th day of March, 1950, in so far as it affects the side and portion of street described in the Schedule hereto, viz.:—

“The Wellington City Council being the local authority having control of the streets in Wellington City, by resolution declares that the provisions of section 128 of the Public Works Act, 1928, shall not apply to the eastern side of the portion of Cuba Street adjoining part Section 153, Town of Wellington, commencing at the northern corner of Section 153, Town of Wellington, and extending in a southerly direction for a distance of 64 links, being all (or part) of the land in Certificate of Title, Volume 191, folio 244, Wellington Registry.”

SCHEDULE

THE south-eastern side of all that portion of street situated in the Wellington Land District, City of Wellington, known as Cuba Street, fronting part Section 153, Town of Wellington, being all the land comprised and described in Certificate of Title, Volume 191, folio 244, Wellington Land Registry.

As the same is more particularly delineated on the plan marked P.W.D. 132925, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
