Principal Order No. 13 of the Government Service Tribunal

In the matter of section 8 of the Government Service Tribunal Act, 1948,
and in the matter of an application for a principal order dated the 6th
day of December, 1949, and duly lodged by the New Zealand Musicians’
Industrial Union of Workers.

THE Government Service Tribunal having heard and considered the
application of the applicant, doth hereby order that the following provisions
shall take effect on and from the dates respectively therein set out in
clause 1:—

APPLICATION OF ORDER

  1. (a) This Order shall apply to players of the National Orchestra of
    the New Zealand Broadcasting Service.

(b) For the purposes of this Order the term “player” shall be limited
to a player engaged under the provisions of Public Service Regulation 150.

(c) This Order with the exception of subclause 5 (a), shall be deemed
to have come into force on the 19th day of February, 1949.

(d) Subclause 5 (a) shall be deemed to have come into force on the 1st
day of July, 1948.

HOURS OF WORK

  1. (a) The ordinary hours of work shall be twenty-five a week and
    five a day, and shall be worked at any time on any five days of the week
    Thursdays to Wednesdays inclusive.

(b) Any call to a studio of the Department either for rehearsal or perform-
ance or both, shall count as a minimum of two hours. Any call outside a
studio of the Department for rehearsal only shall count as a minimum
of two hours. Any call outside a studio of the Department for a
performance shall count as a minimum of three hours.

(c) Players when in local groups may be required to rehearse before and
after a public performance or studio broadcast as part of the same call.

(d) The National Orchestra when functioning as a whole for school
concerts may be required to rehearse before and after such school concerts
as part of the same call.

(e) A rest period of fifteen minutes shall be allowed during every rehearsal
of not less than three hours.

OVERTIME

  1. (a) Overtime rates shall apply to all time worked in excess of five
    hours a day of outside the first five days worked in any week.

(b) Overtime shall be paid for at time and one-half rate for the first
three hours and double time rate thereafter.

(c) A player required to work on a Sunday shall be paid one day’s pay
at ordinary time rate in addition to the week’s normal wage.

HOLIDAYS

  1. (a) Provided he has worked for the Department at any time during
    the fortnight ending on the day on which the holiday occurs a player shall
    be allowed the following holidays on pay: New Year’s Day, Good Friday,
    Easter Monday, Anzac Day, Sovereign’s Birthday, Labour Day, Christmas
    Day, Boxing Day, and the Anniversary Day of the Province of Wellington
    (22nd January).

(b) At the discretion of the Director of Broadcasting and subject to the
needs of the Department, other provincial anniversary days may be taken
as days off by players for the time being in the centres concerned, provided
that normal work is performed on five other days of the week in which the
anniversary day occurs. Penal rate shall not be paid for time worked on any
anniversary day other than that of the Wellington Province.

(c) A player who has worked for more than one employer during the
fortnight ending on the day on which the holiday occurs is entitled to one
payment only for the holiday, and payment will be by arrangement between
the Department and the other employer or employers.

(d) When any of the above holidays, except Anzac Day, falls on a
Saturday or a Sunday it shall be observed on the following Monday, and in
the event of another holiday falling on such Monday, such other holiday
shall be observed on the next succeeding Tuesday.

(e) Time worked on any of the holidays prescribed in subclause (a)
above shall be paid for at double time rate in addition to the holiday payment.

(f) The principle of the Annual Holidays Act, 1944, shall be applied.
