Vesting a Reserve in the Wellington City Council

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 1st day of November, 1950

Present:

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL

WHEREAS the land described in the Schedule hereto is a reserve for cemetery purposes:

And whereas, in the opinion of the Governor-General, it is expedient to vest the said reserve in the Mayor, Councillors, and Citizens of the City of Wellington:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section 9 of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby declare that from and after the day of the date hereof the reserve described in the Schedule hereto shall become vested in the Mayor, Councillors, and Citizens of the City of Wellington in trust, for cemetery purposes.

SCHEDULE

WELLINGTON LAND DISTRICT

ALL that area situated in Block VI, Port Nicholson Survey District, containing by admeasurement a total of 3 acres 2 roods 6·21 perches, more or less, being Lots 2 to 5, 7, 9 to 18, 33 to 36, and parts Lots 19 and 20 on a plan deposited in the Land Registry Office, at Wellington, under No. 9848, being part Sections 31 and 33, Karori District. As the same is more particularly delineated on the plans marked L. and S. 2/633A and B, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red.

Vesting the Control of a Reserve in the Owhango Public Hall and Library Board

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 1st day of November, 1950

Present:

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL

WHEREAS the land described in the Schedule hereto is a reserve duly set apart for a site for a public hall and library:

And whereas it is expedient that the control of the said reserve should be vested in a special Board as hereinafter provided:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section 17 of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby vest the control of the reserve described in the Schedule hereto, for the period of five years from the date hereof (unless previously amended or revoked under the said Act), in the undermentioned persons, namely,—

Ian Godfrey Hammond,
Ivan Henry Grattan,
Harry Grattan,
William Edward Warren,
John James Donald,
Terence Raymond Bennett, and
Thomas Newton Kitchener Somerville,

who are hereby constituted for that purpose a special Board by the name of the Owhango Public Hall and Library Board (hereinafter referred to as “the Board”), with the powers and subject to the conditions hereinafter contained, that is to say :—

  1. The first meeting of the Board shall be held on Wednesday, the 6th day of December, 1950, at 7.30 o’clock p.m. at the Owhango Public Hall, and thereafter, the Board shall meet for the transaction of business at such time and place as may from time to time be fixed by the Board.

  2. The members of the Board shall at their first meeting, and thereafter at the annual meeting hereinafter mentioned, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

  3. Special meetings may be convened by the Chairman, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

  4. Any four members of the Board shall form a quorum. Any meeting may be adjourned from time to time.

  5. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose one of their number to be Chairman of such meeting.

  6. If by resignation, death, incapacity, or otherwise the seat of any member shall be or become vacant, or if any member absents himself without reasonable cause from three consecutive meetings of the Board, the Governor-General shall have power to appoint any other person to be a member of the Board in his stead.

  7. All questions shall be determined by the majority of votes of the members of the Board present at the meeting.

  8. The Board shall have prepared and submitted at an annual meeting to be held in the month of April in each year a report of the proceedings of the Board for the previous year ending on the 31st day of March, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister of Lands as soon as possible after each annual meeting.

  9. The Board shall control the said reserve and the building erected thereon for the purposes of a public hall and library, and shall afford settlers and residents of Owhango and the surrounding district such facilities for meeting within the said hall as may from time to time be determined by the Board; provided that the Board shall have power to fix reasonable charges for the use of the said hall.

Land Reserved in the Marlborough Land District

WHEREAS by section 167 of the Land Act, 1948, it is enacted that the Governor-General may from time to time set apart as a reserve, notwithstanding that the same may be then held under pastoral lease or pastoral occupation licence, any Crown land for any purpose which, in his opinion, is desirable in the public interest, and notice thereof shall be published in the New Zealand Gazette.

Now, therefore, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon me by the said Act, do hereby reserve the land in the Marlborough Land District, described in the Schedule hereunder written, for a public hall site.

MARLBOROUGH LAND DISTRICT

SECTION 119, Village of Tuamarina (formerly part Section 6, Village of Tuamarina), situated in Block VII, Cloudy Bay Survey District: Area, 2 roods 10 perches, more or less. (S.O. plan 2092.)

As witness the hand of His Excellency the Governor-General, this 4th day of November, 1950.

Officer Authorized to Take and Receive Statutory Declarations

PURSUANT to the authority conferred upon me by section 301 of the Justices of the Peace Act, 1927, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby notify and declare that Vivain Theodore Chisholm, being an officer in the service of the Crown holding the office of Staff Clerk, Air Department, at Wellington, is authorized to take and receive statutory declarations under section 301 of the Justices of the Peace Act, 1927.

As witness the hand of His Excellency the Governor-General, this 3rd day of November, 1950.

Territorial Force—

Lieutenant N. S. Hopwood, 2nd Field Regiment, R.N.Z.A., is transferred to the Reserve of Officers, General List, The Royal N.Z. Artillery, with the rank of Lieutenant, with seniority from 6th February, 1948. Dated 27th September, 1950.

Lieutenant G. W. Ferguson, 13th Composite Anti-aircraft Regiment, R.N.Z.A., is transferred to the Reserve of Officers, General List, The Royal N.Z. Artillery, with the rank of Lieutenant, with seniority from 2nd March, 1947. Dated 25th September, 1950.
