Altering Boundaries of Counties of Matamata and Rotorua and Adding Area to Tokoroa Riding, County of Matamata

Present:
THE HON. K. J. HOLYOAKE PRESIDING IN COUNCIL
WHEREAS, at the request of the Matamata and Rotorua County Councils, the Local Government Commission, in pursuance of the provisions of the Local Government Commission Act, 1946, has made inquiry into certain proposals for an alteration of the boundaries of the County of Matamata and the County of Rotorua.
And whereas, in pursuance of the provisions of the said Act, the Local Government Commission has approved as final a scheme bearing date the twelfth day of May, one thousand nine hundred and forty-nine, providing for the exclusion of the area described in the Schedule to the said scheme from the County of Rotorua and the inclusion of such area in the County of Matamata:
And whereas, it is deemed expedient to give effect to the final scheme and to make supplementary provisions for giving full effect to such scheme:
Now, therefore, in pursuance and exercise of the powers and authorities vested in him by the Local Government Commission Act, 1946, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby declare that as on and from the first day of April, one thousand nine hundred and fifty, the area described in the First Schedule hereto shall be excluded from the County of Rotorua and included in the County of Matamata; that the boundaries of the Counties of Matamata and Rotorua as so altered shall be those set forth under the respective headings in the Second Schedule hereto; that the area added as aforesaid to the County of Matamata shall be included in the Tokoroa Riding of that county; that the boundaries of the Tokoroa Riding as so altered shall be those set forth in the Third Schedule hereto; and, with the like advice and consent, doth hereby also declare that the alteration of boundaries of the said counties hereinbefore made shall be deemed to have been effected under the Counties Act, 1920.
FIRST SCHEDULE
AREA EXCLUDED FROM COUNTY OF ROTORUA AND INCLUDED IN COUNTY OF MATAMATA
ALL that area in the Auckland Land District containing approximately 16,000 acres, bounded by a line commencing at a point on the boundary between Block V, Horohoro Survey District, and Block II, Horohoro West Survey District, being the westernmost corner of Section 9, Block V, aforesaid, and being a point on the Rotorua County boundary as described in New Zealand Gazette No. 37 of the 24th day of June, 1948, page 791, and running southerly generally along the south-western boundary of Section 9 aforesaid to its southernmost corner; thence along a right line, to and along the south-western boundary of Patetere South No. 183 Block, to and along the generally western boundaries of part of Lots 11 and 10 as shown on the plan numbered 12325, deposited in the office of the District Land Registrar at Auckland, being part of the Tikorangi and Whakamaru Maungaiti Blocks, along the western boundary of Lot 1 as shown on the plan numbered 20272, deposited as aforesaid, being part of the Whakamaru Maungaiti Block aforesaid, and Sections 3 and 4, Block III, Te Atiamuri Survey District, to the intersection of the last-mentioned boundary with the boundary of the Rotorua County aforesaid; thence westerly and northerly generally along that county boundary to the westernmost corner of Section 9, Block V, Horohoro Survey District, being the point of commencement.
SECOND SCHEDULE
COUNTY OF MATAMATA
ALL that area in the South Auckland Land District, bounded by a line, commencing at the southernmost corner of Section 3 of Block VI, Cambridge Survey District, and running north-easterly generally along the south-eastern boundary of the said Section 3 and the southern side of a public road to a point in line with the south-eastern boundary of Section 76s of the said settlement, a right line across the Te Miro Road, to and along the south-eastern boundaries of Section 6s of the said settlement, and Maungakawa B Nos. 1 and 2 Blocks, the southern boundaries of Tawawhakaporo Block, as shown on the plan numbered 27844, deposited in the office of the District Land Registrar at Auckland, the southern boundaries of Lot 7, and southern and eastern boundaries of part of Lot 8, as shown on the plan numbered 17890, deposited as aforesaid, being parts of Te Pae O Turawaru Nos. 2c 2 and 2c 1 Blocks, and a right line, being the last-mentioned boundary produced, through Section 7, Block IV, Cambridge Survey District, across a public road, and through Lot 13, as shown on the plan numbered 17891, deposited as aforesaid, being part of the said No. 2c 1 Block, and being part of Te Tapu B No. 2 Block to the middle of the Piakonui Stream; thence down the middle of that stream to a point in line with the south-western boundary of Lot 4, as shown on the plan numbered 14276, deposited as aforesaid, being part of Te Pae O Turawaru No. 2 Block; thence along a right line through Lot 10, as shown on the plan numbered 17890, deposited as aforesaid, being parts of Te Pae O Turawaru and Te Tapui Blocks, to and along the south-western boundary of the said Lot 4, a right line across a public road, to and along the south-western
easterly generally along the last-mentioned right line to the western boundary of the State forest, as described in the New Zealand Gazette No. 73, of the 12th day of October, 1922, page 2717; thence southerly generally along the western boundary of the State forest described as aforesaid, to and along the western boundaries of the State forests as described in the New Zealand Gazettes, No. 4 of the 21st day of January, 1926, page 130, No. 6 of the 10th day of February, 1944, page 120, No. 59 of the 18th day of August, 1927, page 2692, and No. 60 of the 21st day of August, 1930, page 2639, respectively, to the southernmost corner of Lot 2, as shown on the plan numbered 15253, deposited in the office of the District Land Registrar at Auckland, being part of the Kaingaroa No. 2 West No. 1 Block; thence northerly generally along the south-western boundary of the aforesaid Lot 2, to and down the middle of the Paetataramoa Stream, to and down the middle of the Waikato River, to and along the eastern boundary of the Matamata County, to the point of commencement; save and excepting thereout the Borough of Rotorua.
COUNTY OF TAUPO
All that area in the South Auckland, Hawke's Bay, and Wellington Land Districts, bounded by a line commencing at a point in Block XVI, Wharepapa Survey District, being the confluence of the Waikato River and the Waipapa Stream, and running easterly generally up the middle of the aforesaid Waikato River, being the southern boundary of the Matamata County, to and along the southern boundary of the Rotorua County, as hereinbefore described, to the south-eastern corner of the aforesaid Rotorua County; thence southerly generally along a right line to Trig. Station No. 78, Pekepeke, situated in Block III, Weao Survey District, along a right line to Trig. Station No. 76, Taupiri, situated in Block XII, Weao Survey District aforesaid, along a right line to Trig. Station F, Tiritiri, situated in Block III, Heruiwi Survey District, along a right line to Trig. Station B, Pukeroa, situated in Block XI, Heruiwi Survey District, along a right line to Trig. Station Te Taumutu, situated in Block XVI, Heruiwi Survey District aforesaid, and along another right line to a point, being the intersection of a right line from the northernmost point of Lake Waikaremoana and passing through a point 180 chains due north of Trig. Station Maungataniwha, situated in Block XIV, Tuatawhata Survey District, with a right line between Trig. Station No. 76A, Tawhiwhau, situated in Block XIV, Galatea Survey District, and Trig. Station No. 69, Tataraokino, situated in Block VIII, Tarawera Survey District; thence along a right line to a point in the middle of the Te Hoe River and in line with the south-western boundary of Heruiwi No. 4 Block; thence south-westerly generally down the middle of the said Te Hoe River, to and along the middle of the Mohaka River to a point in line with the production north-easterly of a right line between Trig. Station No. 68A and Trig. Station No. 65A; thence along the aforesaid right line to Trig. Station No. 65A aforesaid; thence westerly generally along a right line to Trig. Station No. 26, Tawheketewhango, along a right line to Trig. Station No. 27, along a right line to Trig. Station No. 28, Manukaipu, and along another right line to Trig. Station Ruapehu, situated in Block XI, Ruapehu Survey District; thence northerly generally along a right line to Trig. Station H, Paretetaitonga, situated in Block XI, aforesaid, along a right line to Trig. Station D, Ngaurohoe, situated in Block XVI, Tongariro Survey District, along a right line to Trig. Station Tongariro, situated in Block XII, Tongariro Survey District, aforesaid, and along another right line to the western shore of Lake Taupo at the mouth of the Waihi Stream; thence along the western shore of Lake Taupo aforesaid, to and along the western boundaries of Tihoi Nos. 1 and part 3B Blocks, along the southern and western boundaries of Tihoi No. 3B 8A Block, to and along another part of the western boundary of part Tihoi No. 3B Block aforesaid to Trig. Station No. 1390, Pureora, situated in Block III, Hurakia Survey District; thence along a right line to the source of the Ongarue River and along another right line in the direction of Trig. Station No. 1641, Rangitoto, situated in Block IV, Pakaumanu Survey District, to the south-eastern boundary of Maraeroa B No. 3B 2 Block; thence along the south-eastern and eastern boundaries of the aforesaid block to its northernmost corner; thence along the western boundary of part of Pouakani Block, to and down the middle of the Waiteti Stream and down the middle of the Waipapa Stream to the point of commencement; save and excepting thereout the Taupo Town District, as described in the New Zealand Gazette No. 16 of the 21st day of March, 1946, page 347.
THIRD SCHEDULE
SOUTH RIDING, COUNTY OF ROTORUA
ALL that area in the South Auckland Land District, situated in the Rotorua County, bounded by a line commencing at a point in Block X, Rotorua Survey District, being the intersection of the western boundary of the Rotorua County as hereinbefore described with the middle of the Cambridge-Rotorua State Highway, and running south-easterly generally along the middle of the said State highway, to and along the middle of the Auckland-Rotorua Railway to the middle of the Ngongotaha Stream; thence down the middle of that stream, to and along the shores of Lake Rotorua, to and along the western, southern, and eastern boundaries of the Rotorua Borough, again along the shores of Lake Rotorua aforesaid, to and along the south-western boundary of Whakapoungakau No. 16, Section 2B 2F Block, a right line across the Rotorua-Whakatane State Highway, to and along the south-western boundaries of Whakapoungakau No. 16, Section 2B 2G 1 Block Okataina, Nos. 6B and 6A Blocks, to the shores of Lake Tarawera; thence along the northern shores of the said lake, to and down the middle of the Tarawera River to the boundary of the Rotorua County aforesaid, thence southerly, westerly, and northerly generally along the said county boundary to the point of commencement.
