The Servicemen’s Settlement and Land Sales Act, 1943.—Notice Declaring Land Taken for the Settlement of a Discharged Serviceman

WHEREAS an application has been made for the consent of the Land Sales Court to a transaction which relates to the land described in the Schedule hereto and to which Part III of the Servicemen’s Settlement and Land Sales Act, 1943, applies:

And whereas the Land Sales Committee to which the application has been referred is of opinion that the land to which the application relates is farm land suitable or adaptable for the settlement of a discharged serviceman:

And whereas the said committee, not being satisfied that the Crown had decided not to acquire or arrange for the acquisition of the land, did on the 26th day of January, 1949, make an order determining the basic value of the land and no appeal from the said order was made within the time prescribed by the said Act or within any further time allowed by the Court:

And whereas the said land is not the land of any serviceman who is for the time being serving outside New Zealand in any of His Majesty’s Forces or in any British ship:

Now, therefore, the Minister of Lands, acting in pursuance of section 51 of the said Act, doth hereby declare that the said land is taken for the settlement of a discharged serviceman, and hereby specifies the 18th day of February, 1949, as the date on which the said land shall be deemed to be vested in His Majesty the King.

SCHEDULE

AUCKLAND LAND DISTRICT

ALL that area containing by admeasurement four hundred and ninety (490) acres two (2) roods twelve decimal one (12·1) perches, more or less, being portion Lot A on Deposited Plan No. 2474 and all the land on Deposited Plan No. 10034, and being portions Maungatautari Nos. 1 and 2 Blocks, the said area being all the land comprised in certificate of title, Vol. 321, folio 243 (Auckland Registry).

As witness my hand, this 15th day of February, 1949.

The Servicemen’s Settlement and Land Sales Act, 1943.—Notice Declaring Lands Taken for the Settlement of Discharged Servicemen

WHEREAS, pursuant to section 24 of the Servicemen’s Settlement and Land Sales Act, 1943, notice was given of the intention of the Minister of Lands to take under Part II of the said Act the lands described in the First Schedule hereto, and a copy of the said notice was published in the New Zealand Gazette No. 70 on the 27th day of November, 1947, at page 1837:

And whereas an objection was made by the owners in the manner prescribed by the said Act objecting to the taking of the said lands and claiming the right to retain part of the said lands:

And whereas the Minister of Lands did not revoke his notice of intention to take the said lands:

And whereas the Minister of Lands did agree to the retention by the owners of the area specified in the said objection:

And whereas the owners have withdrawn the objection to the taking of the lands described in the Second Schedule hereto:

And whereas the Land Sales Committee did on the 14th day of May, 1948, make an order determining that the lands described in the said Second Schedule are farm lands suitable or adaptable for the settlement of a discharged serviceman or of two or more discharged servicemen:

And whereas no appeal from the said order was made within the time prescribed by the said Act or within any further time allowed by the Court:

And whereas the lands described in the said Second Schedule are not the lands of any serviceman who is for the time being serving outside New Zealand in any of His Majesty’s Forces or in any British ship:

Now, therefore, the Minister of Lands, acting in pursuance of section 27 of the said Act, doth hereby declare that the lands described in the said Second Schedule are taken for the settlement of discharged servicemen, and hereby specifies the 21st day of February, 1949, as the date on which the said lands shall be deemed to be vested in His Majesty the King.

FIRST SCHEDULE

AUCKLAND LAND DISTRICT

ALL that parcel of land situated in Block XV, Komakorau Survey District, containing by admeasurement thirty-four (34) acres one (1) rood twenty-five (25) perches, more or less, being part of Allotment 273, Kirikiri roa Parish, and being the balance of the land described in certificate of title, Vol. 2, folio 259 (Auckland Registry).

Also all that parcel of land situated in Block XV, Komakorau Survey District, containing by admeasurement one hundred and thirty (130) acres, more or less, being Allotments 277, 278, and 279, Kirikiri roa Parish, and being all the land described in certificate of title, Vol. 16, folio 174 (Auckland Registry).

Also all that parcel of land situated in Block XV, Komakorau Survey District, containing by admeasurement twenty-one (21) acres, more or less, being part of Allotment 13, Tamahere Parish, on Deposited Plan 1719, and being all of the land described in certificate of title, Vol. 84, folio 122 (Auckland Registry).

Also all that parcel of land situated in Block XV, Komakorau Survey District, containing by admeasurement one thousand three hundred and thirty-two (1,332) acres, more or less, being Allotments 274, 275, 276, N. 281, and 301, Kirikiri roa Parish, and being all of the land described in certificate of title, Vol. 556, folio 229 (limited as to parcels), (Auckland Registry).

SECOND SCHEDULE

AUCKLAND LAND DISTRICT

ALL that parcel of land situated in Block XV, Komakorau Survey District, containing by admeasurement thirty-one (31) acres three (3) roods ten (10) perches, more or less, being part Allotment 273, Kirikiri roa Parish, on Deposited Plan 1719, and being the balance of the land described in certificate of title, Vol. 2, folio 259 (Auckland Registry).

Also all that parcel of land situated in Block XV, Komakorau Survey District, containing by admeasurement one thousand one hundred and seventy-two (1,172) acres, more or less, being Allotments 274, 275, and part 301, Kirikiri roa Parish, and being part of the land described in certificate of title, Vol. 556, folio 229 (limited as to parcels), (Auckland Registry).

Also all that parcel of land situated in Block XV, Komakorau Survey District, containing by admeasurement twenty-one (21) acres one (1) rood twenty (20) perches, more or less, being part of Allotment 13, Tamahere Parish, on Deposited Plan 1719, and being all of the land described in certificate of title, Vol. 84, folio 122 (Auckland Registry).

As the same are more particularly shown in Survey Office plan No. 34018, lodged in the office of the Chief Surveyor at Auckland, and thereon edged red.
