PURSUANT to the Agricultural and Pastoral Societies Act, 1908, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby incorporate the members of the Hutt Valley Pastoral and Agricultural Society and such persons as shall hereafter be admitted members of the said Society agreeably to the rules of the said Society and the provisions of the said Act, into a body corporate under the style and title of “The Hutt Valley Pastoral and Agricultural Society.”

Varying an Order in Council Vesting in the Poverty Bay Catchment Board Control of Watercourses in the Poverty Bay Catchment District

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section one hundred and thirty of the Soil Conservation and Rivers Control Act, 1941, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby vary the Order in Council made on the twentieth day of March, one thousand nine hundred and forty-six, and published in the New Zealand Gazette No. 16 of the twenty-first day of the same month at page 350, vesting in the Poverty Bay Catchment Board control of watercourses in the Poverty Bay Catchment District by inserting, after the words “under the control of any local authority”, the words “and any watercourse situated upon and used wholly or in part for the drainage of any road reserve or highway.”

Lands Reserved in the North Auckland, Gisborne, Nelson, and Otago Land Districts

WHEREAS by the one-hundred and sixty-seventh section of the Land Act, 1948, it is enacted that the Governor-General may from time to time set apart as a reserve, notwithstanding that the same may be then held under pastoral lease or pastoral occupation licence, any Crown land for any purpose, which, in his opinion, is desirable in the public interest, and notice thereof shall be published in the Gazette:
Now, therefore, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon me by the said Act, do hereby reserve the lands in the North Auckland, Gisborne, Nelson, and Otago Land Districts, described in the Schedule hereunder written, for the purposes specified at the end of the respective descriptions of the lands so intended to be reserved.

Vesting the Control of a Scenic Reserve in the North Shore Scenic Board

IN pursuance and exercise of the powers and authorities conferred upon him by section thirteen of the Scenery Preservation Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand doth hereby vest the control of the reserve described in the Schedule hereto, being land reserved under the said Act, for the period of five years from the date hereof, unless previously altered or revoked under the said Act, in the undermentioned persons, namely:—
The Commissioner of Crown Lands for the North Auckland Land District, ex officio,
The Mayor of Northcote, ex officio,
The Mayor of Birkenhead, ex officio,
The member of the Waitemata County Council representing the Birkenhead Riding, ex officio,
The Principal of the Northcote College, ex officio,
Robert Cecil Cooper,
Leonard Talmadge Hayman,
James Anderson Hunter,
who are hereby constituted for that purpose a special Board by the name of the North Shore Scenic Board (herein referred to as the Board), in trust, for the preservation of scenery, and with the powers and subject to the conditions hereinafter contained, that is to say,—

The first meeting of the Board shall be held on Tuesday, the sixth day of December, one thousand nine hundred and forty-nine, at half-past one o’clock p.m., at the Birkenhead Borough Council Office, Birkenhead, and thereafter the Board shall meet for the transaction of business at such time and place as may from time to time be fixed by the Board.

The members of the Board shall at their first meeting, and thereafter at the annual meeting hereinafter mentioned, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

Special meetings may be convened by the Chairman, provided that two days’ notice of such meeting is given to each member, specifying the business to be transacted at such special meeting, and no other business than that so specified shall be transacted at such meeting.

Any five members of the Board shall form a quorum. Any meeting may be adjourned from time to time.

All questions shall be determined by the majority of votes of the members of the Board present at the meeting.

If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose one of their number to be Chairman for such meeting.

If, by resignation, death, incapacity, or otherwise, the seat of any member shall be or become vacant, or if any member absents himself, without reasonable cause, from three consecutive meetings of the Board, the Governor-General shall have power to appoint any other person to be a member of the Board in his stead.

The Board shall prepare and submit at an annual meeting to be held in the month of April in each year a report of the proceedings of the Board for the previous year ending on the thirty-first day of March, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister in Charge of Scenery Preservation as soon as possible after each annual meeting.

The Board shall control the said reserve in accordance with the provisions of the said Act and of the regulations made thereunder.
SCHEDULE
NORTH AUCKLAND LAND DISTRICT.—LE ROY’S BUSH SCENIC RESERVE
All that area in the Borough of Birkenhead and the County of Waitemata, situated in Block XII, Waitemata Survey District, containing by admeasurement 14 acres 1 rood 14·51 perches, more or less, being parts of Allotments 56 and 57, Parish of Takapuna, Lot 13, as shown on a plan deposited in the Land Registry Office at Auckland under No. 18382; parts of Lots 2, 3, and 4 as shown on a plan numbered 98 deposited as aforesaid; and parts of Lots 13, 17, 18, 19, 20, and 21 as shown on a plan numbered 10208 deposited as aforesaid; all the aforementioned lots being parts of Allotments 56, 57, and 58, Parish of Takapuna, and being the whole of the lands comprised and described in Certificates of Title, Volume 500, folio 70, Volume 561, folio 207, and Volume 923, folio 85 (Auckland Land Registry). As the same is more particularly delineated on the plan marked L. and S. 4/1039, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red.
