Vesting the Control of a Reserve in the Hillsborough Public Hall Board

ORDER IN COUNCIL
At the Government House at Wellington, this 19th day of October, 1949
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS the land described in the Schedule hereto is a reserve duly set apart for a hall site: And whereas it is expedient that the control of the said reserve should be vested in a special Board as hereinafter provided:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section seventeen of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby vest the control of the reserve described in the Schedule hereto, for the period of five years from the date hereof (unless previously amended or revoked under the said Act), in the undermentioned persons, namely:—
Frank Neville Webb,
Verna Eliza Gunner,
Ian Cameron Baillie,
John Joseph MacDonald,
Ernest Jeffrey Thomas,
Henry William Douds,
Cyril Hugh Collins,
James Ronald Biscoe,
Lillian Myrtle Allen, and
Sheila Isabel McLaughlin
who are hereby constituted for that purpose a special Board by the name of the Hillsborough Public Hall Board (hereinafter referred to as the Board), with the powers and subject to the conditions hereinafter contained, that is to say:—

The Board shall meet for the transaction of business at the residence of Mr. I. C. Baillie, 3 Norval Road, Mount Roskill, or at such other place and at such time as may from time to time be fixed by the Board. The first meeting shall be held on Wednesday, the sixteenth day of November, one thousand nine hundred and and forty-nine, at half past seven o’clock p.m.

The members of the Board shall at their first meeting, and thereafter at the annual meeting hereinafter mentioned, elect one of themselves to be Chairman, who may join in the discussion and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

Special meetings may be convened by the Chairman, provided that two days’ notice of any such meeting is given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

Any six members of the Board shall form a quorum. Any meeting may be adjourned from time to time.

If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose one of their number to be Chairman of such meeting.

If by resignation, death, incapacity, or otherwise the seat of any member shall be or become vacant, or if any member absents himself without reasonable cause from three consecutive meetings of the Board, the Governor-General shall have power to appoint any other person to be a member of the Board in his stead.

All questions shall be determined by the majority of votes of the members of the Board present at a meeting.

The Board shall have prepared and submitted at an annual meeting to be held in the month of April in each year a report of the proceedings of the Board for the previous year ending on the thirty-first day of March, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister of Lands as soon as possible after each annual meeting.

The Board shall control the said reserve and any building that may be erected thereon for the purposes of a public hall, and shall also afford settlers and residents of Mount Roskill and the surrounding district such facilities for meeting within the said hall as may from time to time be determined by the Board: Provided that the Board shall have power to fix reasonable charges for the use of the said hall.

NORTH AUCKLAND LAND DISTRICT
ALL that area in the Borough of Mount Roskill, containing by admeasurement 1 rood 23·4 perches, more or less, being Lot 119, as shown on the plan numbered 17584, deposited in the office of the District Land Registrar at Auckland, being part of Allotment 10, Section 13, Suburbs of Auckland. As the same is more particularly delineated on the plan marked L. and S. 22/3630/117, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red.

Vesting the Control of a Recreation Reserve in the Tauranga Borough Council

WHEREAS the land described in the Schedule hereto has been duly set apart as a reserve for recreation purposes: And whereas it is expedient that the control of the said reserve should be vested in the Tauranga Borough Council:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section seventeen of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby vest the control of the said reserve in the Tauranga Borough Council.

ALL that area in the Borough of Tauranga situated in Block X, Tauranga Survey District, containing by admeasurement 1 acre 3 roods 2·2 perches, more or less, being part Lot 1 as shown on the plan numbered 29548, deposited in the office of the District Land Registrar at Auckland, being part Section 5, Block X, Tauranga Survey District aforesaid. As the same is more particularly delineated on the plan marked L. and S. 30/228/30, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red. Revoking the Vesting of the Control of a Reserve for a Resting-place for Travelling Stock in the Opotiki County Council

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS the control of the land described in the Schedule hereto was vested in the Opotiki County Council for a reserve for a resting-place for travelling stock by an Order in Council dated the sixth day of August, one thousand nine hundred and seventeen, and published in the Gazette of the ninth day of that month, in pursuance of section two of the Public Reserves and Domains Amendment Act, 1914:
And whereas it is expedient that the said Order in Council should be revoked:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred upon him by subsection two of section seventeen of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby revoke the Order in Council hereinbefore referred to:

IN pursuance and exercise of the powers and authorities conferred upon him by subsection one (b) of section seven of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the reservation for a site for a pound over the land described in the Schedule hereto; and doth hereby declare that the said land, being vested in the Crown, is Crown land available for disposal under the Land Act, 1948.
