Amending a Licence Authorizing Leslie Arthur Johnson, of Maruia, Farmer, to Use Water for the Purpose of Generating Electricity

ORDER IN COUNCIL

At the Government House at Wellington, this 19th day of October, 1949

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby amend, as set forth in the Schedule hereto, the Order in Council dated the fourth day of April, one thousand nine hundred and thirty-eight, and published in the Gazette on the thirteenth day of the same month, at page 935, authorizing Albert Oscar Harris, of Minehaka, Murchison, Farmer, to use water for the purpose of generating electricity, the rights, powers, and privileges under the said Order in Council having been assigned to Leslie Arthur Johnson, of Maruia, Farmer, by the Order in Council dated the twenty-ninth day of January, one thousand nine hundred and forty-seven, and published in the Gazette on the thirtieth day of the same month at page 78.

SCHEDULE

  1. CLAUSE 3 of the Conditions is deleted, and the following clause is substituted therefor :—

“3. UTILIZATION OF WATER AND LOCATION OF HEADWORKS

“Water shall be used under this licence solely for the purpose of generating electricity and shall be taken from the said stream at the point in Section 3, Block XI, Maruia Survey District, indicated on the plan marked P.W.D. 98152, deposited in the Office of the Minister of Works.”

  1. Clause 4 of the Conditions is deleted, and the following clause is substituted therefor :—

“4 GENERAL DESCRIPTION OF WORKS

“The licensee is hereby authorized, subject to the conditions hereof, to construct, maintain, and use the following works for the purposes of this licence, the position of the said works being indicated on the said plan P.W.D. 98152 :—

“(a) Headworks consisting of an intake, water-race, and pipelines leading to the pelton wheel and power-house hereinafter referred to, giving a static head of approximately 34 ft.

“(b) Pelton wheel and power-house with all necessary equipment for generating electricity situated in Section 3, Block XI, Maruia Survey District :

“(c) Tail-race leading from the aforesaid power-house to the Maruia River.”

  1. Clause 5 of the Conditions is deleted, and the following clause is substituted therefor :—

“5. SYSTEM OF SUPPLY

“The system of supply shall be a direct-current system as described in paragraph (d) of clause 21-01 of the Electrical Supply Regulations 1935.”

  1. Clause 7 of the Conditions thereto is amended by deleting the words “one kilowatt,” and substituting therefor the words “2·2 kilowatts.”

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken for housing purposes.

APPROXIMATE area of the piece of land taken : 2 roods 29·9 perches. Being Lot 3, D.P. 8988, being portion of Allotment 181, Parish of Kirikiriroa, and Lots 5 and 6, D.P. 8988, being portions of Allotments 181 and 212, Parish of Kirikiriroa, and being the whole of the land comprised and described in Certificate of Title, Volume 355, folio 227 (Auckland Land Registry).

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the First and Second Schedules hereto being taken for housing purposes, subject, as to the land described in the Second Schedule hereto, to the interests reserved by Memorandum of Transfer registered in the Land Registry Office at Auckland under No. 14739, and comprised in Certificate of Title, Volume 32, folio 7, of the said Registry Office.

APPROXIMATE area of the piece of land permitted to be taken : 1 acre 1 rood 32 perches.

Changing the Purpose of Portion of a Reserve in Block VI, Town Survey District, Otago Land District

At the Government House at Wellington, this 19th day of October, 1949

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS the land described in the Schedule hereto forms portion of a reserve duly set apart for the purpose of an Industrial School: And whereas it is expedient that the purpose of the reservation over such land shall be changed to a reserve for recreation purposes :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by subsection one (a) of section seven of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby declare that the purpose of the reservation over the land described in the Schedule hereto is hereby changed from a reserve for the purpose of an Industrial School to a reserve for recreation purposes.
