Provisional State Forest Set Apart as a Permanent State Forest

A PROCLAMATION
BY virtue and in exercise of the powers and authorities conferred upon me by section eighteen of the Forests Act, 1921-22, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby set apart the provisional State forests described in the Schedule hereto as a permanent State forest.

SCHEDULE
WESTLAND LAND DISTRICT.-WESTLAND CONSERVANCY
ALL those areas in the Westland Land District, Grey County, containing by admeasurement 2,464 acres, more or less, and described generally as follows: All that area containing by admeasurement 417 acres, more or less, being part of Reserve No. 1596 (national endowment provisional State forest, Gazette 1919, page 1289), situated in Blocks I and II, Ahaura Survey District and bounded generally as follows: Towards the north by Section 35, Block I, aforesaid; towards the north-east and south-east by part of Reserve No. 1596 (permanent State forest, Gazette 1940, page 1785); towards the south-west generally by Reserve No. 1890 (permanent State forest, Gazette 1947, page 580), Reserve No. 1894 (permanent State forest, Gazette 1947, page 1832), again by Reserve No. 1890 aforesaid, Sections 2904, 3194, and 3018, Block I aforesaid, and by a public road; and towards the west by Section 32, Block I, aforesaid.
Also all that area containing by admeasurement 280 acres, more or less, being part of Reserve No. 1597 (national endowment provisional State forest, Gazette 1919, page 1289), situated in Block III, Ahaura Survey District, and bounded generally as follows: Towards the north-east by the left bank of the Waipuna Creek; towards the south and east by part of Reserve No. 1597 (permanent State forest, Gazette 1940, page 1785); towards the south by part of Reserve No. 1694 (provisional State forest, Gazette 1919, page 1283); towards the west generally by part of Reserve No. 1597, aforesaid; and towards the north by part of Reserve No. 1694 (permanent State forest, Gazette 1940, page 1785).
Also all that area containing by admeasurement 89 acres, more or less, being part of Reserve No. 1606 (national endowment provisional State forest, Gazette 1920, page 2367), situated in Block IV, Ahaura Survey District, and bounded generally as follows: Towards the north-west by Section 4, Block IV aforesaid; towards the north-east by the left bank of the Grey River; towards the south-east by a river-bank reserve and Section 3325, Block IV, aforesaid; and towards the south-west by part of Reserve No. 1606 (permanent State forest, Gazette 1940, page 1785).
Also all that area containing by admeasurement 473 acres, more or less, being part of Reserve No. 1606 (national endowment provisional State forest, Gazette 1920, page 2367), situated in Blocks VIII and XII, Ahaura Survey District, and bounded generally as follows: Towards the north-east by part of Reserve No. 1694 (permanent State forest, Gazette 1940, page 1785), part of Reserve No. 1694 (provisional State forest, Gazette 1919, page 1283), and part of Reserve No. 1606 (permanent State forest, Gazette 1940, page 1785); towards the south-east by Section 2375, Block XII, aforesaid; towards the south-west by the Ahaura-Kopara Road; and towards the west by part of Reserve No. 1738 (provisional State forest, Gazette 1935, page 1127). Save and excepting Reserves Nos. 1154, 1155, 1157, 1158, and 1164 and Section 650, Block XII, aforesaid.
Also all that area containing by admeasurement 314 acres, more or less, being part of Reserve No. 1694 (ordinary provisional State forest, Gazette 1919, page 1283), situated in Block XV, Mawheraiti Survey District, and bounded generally as follows: Towards the north-east generally by the Waipuna Road and Sections 3919 and 3372, Block XV, aforesaid; towards the south-east by Section 3937, Block XV, aforesaid, and Sections 169 and 170 of Square 122; towards the south by the block boundary between Block III, Ahaura Survey District, and Block XV, Mawheraiti Survey District; towards the south-west by the left bank of the Waipuna River; and towards the north-west by the crossing of the Waipuna River and by the right bank of that river.
Also all that area containing by admeasurement 259 acres, more or less, being part of Reserve No. 1694 (ordinary provisional State forest, Gazette 1919, page 1283), situated in Blocks II and III, Ahaura Survey District, and bounded generally as follows: Towards the north-east, east, and south by part of Reserve No. 1694 (permanent State forest, Gazette 1940, page 1785); towards the west by Reserve No. 1887 (permanent State forest, Gazette 1947, page 580), and a public road; towards the south by the Orwell Creek Road; and towards the west by Section 3082, Block II, Ahaura Survey District. Save and excepting Reserve No. 1901 (permanent State forest, Gazette 1947, page 482), part of Reserve No. 1887 aforesaid; part of Reserve No. 1897 (permanent State forest, Gazette 1947, page 872), and all public roads.
Also all that area containing by admeasurement 232 acres, more or less, being part of Reserve No. 1694 (ordinary provisional State forest, Gazette 1919, page 1283, and Gazette 1930, page 3125), situated in Block XIV, Mawheraiti Survey District, and bounded generally as follows: Towards the north by part of Section 2699, Block XIV, aforesaid, the crossing of a public road, and by Reserve No. 1889 (permanent State forest, Gazette 1947, page 580); towards the north-east by Reserve No. 1893 (permanent State forest, Gazette

1947, page 1832), Reserve No. 1889 aforesaid and part of Reserve 1694 (permanent State forest, Gazette 1940, page 1785); towards the south-east by part Reserve No. 1694 aforesaid; towards the south-west by Section 3363, Block XIV, aforesaid and a public road; towards the south-east by the crossing of a public road and by Section 3363 aforesaid; and towards the south-west by a public road. Save and excepting all public roads.
Also all that area containing by admeasurement 132 acres, more or less, being part of Reserve No. 1694 (ordinary provisional State forest, Gazette 1919, page 1283), situated in Block III, Ahaura Survey District, and bounded generally as follows: Towards the south-east, south-west, and north-west by part of Reserve No. 1694 (permanent State forest, Gazette 1940 page 1785); and towards the north by part of Reserve No. 1597 (provisional State Forest, Gazette 1919, page 1289).
Also all that area containing by admeasurement 18 acres, more or less, being part of Reserve No. 1694 (ordinary provisional State forest, Gazette 1919, page 1283), situated in Block VIII, Ahaura Survey District, and bounded generally as follows: Towards the north-east by part Reserve No. 1694 (permanent State forest, Gazette 1940, page 1785); and towards the east and south-west by part of Reserve No. 1606 (provisional State forest, Gazette 1920, page 2367).
Also all that area containing by admeasurement 250 acres, more or less, being part of Reserve No. 1738 (national endowment provisional State forest, Gazette 1935, page 1127), situated in Block VII, Ahaura Survey District, and bounded generally as follows: Towards the north-east by part of Reserve No. 1738 (permanent State forest, Gazette 1940, page 1785); towards the east by part of Reserve 1606 (provisional State forest, Gazette 1920, page 2367) and by Reserve No. 1154; towards the south generally by the Ahaura-Kopara Road; and towards the west by Reserve No. 1898 (permanent State forest, Gazette 1947, page 981. Save and excepting Reserve No. 1153.
As the same are more particularly delineated on plans Nos. 120/48, 120/49, and 120/50, deposited in the Head Office of the State Forest Service at Wellington, and thereon bordered red.
Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 15th day of October, 1949.

Licensing the Mount Cook and Southern Lakes Tourist Company, Limited, to Use and Occupy a Part of the Foreshore and Land Below Low-water Mark at Kawarau Rapids, Lake Wakatipu, as Sites for Two Jetties

ORDER IN COUNCIL
At the Government House at Wellington, this 12th day of October, 1949
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Harbours Act, 1923, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council doth hereby license and permit The Mount Cook and Southern Lakes Tourist Company, Limited, of Queenstown (hereinafter called the company), which term shall include its successors and assigns, unless the context requires a different construction, to use and occupy a part of the foreshore and land below low-water mark at Kawarau Rapids in Lake Wakatipu as shown on approved plan marked M.D. 5336, and deposited in the office of the Marine Department at Wellington, for the purpose of maintaining two jetties thereon as shown on the said plan, such licence to be held and enjoyed by the company upon and subject to the terms and conditions set forth in the Schedule hereto.

SCHEDULE
CONDITIONS

  1. This licence is subject to the Foreshore Licence Regulations 1940, and the provisions of those regulations shall, so far as applicable, apply hereto.
  2. The term of licence shall be fourteen years from the 1st day of October, 1949.
  3. The premium payable by the company shall be one pound (Β£1) and the annual sum so payable by the company shall be one pound (Β£1).
  4. The master of every vessel discharging ballast at the said jetties shall have all such ballast taken away and deposited above high-water mark at at such place as may be approved by the Minister or by any person appointed by the Minister for that purpose.
