Taking Land for Public Purposes in the Island of Niue

ORDER IN COUNCIL

At the Government House at Wellington, this 4th day of October, 1949

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section three hundred and fifty-seven of the Cook Islands Act, 1915, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby take the lands described in the Schedule hereto for the following public purposes—namely, the building and grounds of a Residency.


SCHEDULE

ALL that area situated in the District of Alofi on the Island of Niue containing approximately 9 acres 36 perches, being those portions of the Hatavalalo, Hatava, Fuhai, and Tapeu Blocks bounded by a line commencing at a point on the eastern boundary of a road running from the main Coast Road to Fonuakula at its intersection with a right line bearing 144° 32′ 30″ from Old Survey Peg No. 1 (Bailey) in the centre of the said road ; thence south-easterly along the said right line bearing 144° 32′ 30″ for a distance of approximately 1165 links ; thence south-westerly along a right line on a bearing of 231° 26′ for a distance of approximately 1300 links to the eastern boundary of the aforesaid road between the main Coast Road and Fonuakula ; thence northerly generally along the eastern boundary of that road to the point of commencement. As the said area is more particularly delineated on a plan marked “Residency Site : Niue,” deposited in the office of the Registrar of the High Court of the Cook Islands at Niue.

Fuluasou Land for Public Purposes

At the Government House at Wellington, this 4th day of October, 1949

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section two hundred and seventy of the Samoa Act, 1921, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby set aside the Crown land in Western Samoa described in the Schedule hereto as a reserve for a public purpose—namely, the erection and provision of works, appliances, and conveniences for the generation of electrical energy (whether by water-power or otherwise), and the storage, transmission, use, supply, and sale of such electrical energy.

Declaring a Public Highway to be a Main Highway

ORDER IN COUNCIL

At the Government House at Wellington, this 28th day of September, 1949

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers and authorities vested in him by section three of the Main Highways Act, 1922, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that on and after the date of publication of this Order in Council in the Gazette, the road described in the Schedule hereto shall be a main highway within the meaning and for the purposes of the Main Highways Act, 1922.


SCHEDULE

HIGHWAY DISTRICT No. 2A

Hamlin’s Road.—All that road or portion of road in the Manukau County, commencing at a point on the McLennan Main Highway at the north-western corner of Lot 42, Block XV, Otahuhu Survey District, and proceeding thence generally in a north-easterly and south-easterly direction, and terminating at a point on the Papakura-Clevedon Main Highway at the south-western corner of Lot 1, of Allotment 60, Papakura Parish, being a distance of 2 miles 22 chains, more or less ; as the same is more particularly delineated on the plan marked P.W.D. 129906, deposited in the office of the Main Highways Board at Wellington, and thereon coloured green.

Determining Powers of a Commissioner of the Maori Land Court

ORDER IN COUNCIL

At the Government House at Wellington, this 28th day of September, 1949

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the provisions of section seven of the Maori Land Act, 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby determine that Norman William Smith, Esquire, a Commissioner of the Maori Land Court duly appointed under the said Act, shall possess and may exercise all the powers and functions of a Judge of the Maori Land Court save and except the following, that is to say :—

(1) The powers and functions of a Judge under Part II of the said Act (relating to the Maori Appellate Court) :
(2) The powers and functions of a Judge under Part IV of the said Act (relating to customary land) :
(3) The powers and functions of a Judge under Part V of the said Act (relating to the ascertainment of equitable owners) :
(4) The powers and functions of a Judge under paragraphs (a) and (b) of subsection one of section twenty-seven, section thirty-four, section one hundred and eighty-one, and section five hundred and sixty-four of the said Act.

Constitution of Rural Fire District

ORDER IN COUNCIL

At the Government House at Wellington, this 28th day of September, 1949

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Forest and Rural Fires Act, 1947, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby constitute and declare the area described in the Schedule hereto to be a rural fire district, to be known as the “Helensville - South Head Rural Fire District” ; and doth hereby specify the sand-dune areas and gum lands in the said area as the property for the protection of which the district is constituted ; and doth hereby specify the period between the first day of October in any one year and the thirtieth day of April in the following year (both days inclusive) as a closed fire season in the said district ; and doth hereby declare that this Order in Council shall come into force and that the Helensville - South Head Rural Fire District shall become a rural fire district on the day following publication of this Order in Council in the Gazette ; and doth hereby prescribe that the said Helensville - South Head Rural Fire District shall be administered for the purposes of the said Act by the Commissioner of State Forests.
