Altering and Redefining the Boundaries of the Ohura North Rabbit District.—(Notice No. Ag. 4731)

ORDER IN COUNCIL

At the Government House at Wellington this 31st day of August, 1949

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by section thirty-one of the Rabbit Nuisance Act, 1928, it is enacted that the Governor-General, at the request of the Board of any rabbit district, may, by Order in Council, alter and redefine the boundaries of its district:

And whereas the district known as the Ohura North Rabbit District has been constituted under and for the purposes of the said Act:

And whereas the Board of the said district has, pursuant to the said section thirty-one of the said Act, requested that the boundaries of its district be altered and redefined by excluding an area therefrom:

And whereas it is deemed expedient to alter and redefine the boundaries of the said district accordingly:

Now, therefore, in pursuance and exercise of the powers and authorities conferred upon him by the said Act, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby—

(1) Alter and redefine the boundaries of the said district so constituted as aforesaid;

(2) Declare that the boundaries of the said district shall be those set forth in the Schedule hereto; and, further,

(3) Declare that this Order in Council shall come into force on the thirty-first day of August, one thousand nine hundred and forty-nine.

SCHEDULE

BOUNDARIES OF THE OHURA NORTH RABBIT DISTRICT

ALL that area situated in the Taranaki Land District, being portion of the Ohura County containing ninety-seven thousand seven hundred (97,700) acres approximately, and bounded as follows: Commencing at the northernmost corner of Section 3, Block X, Aria Survey District, and proceeding generally northerly and easterly along the northern boundary of the Ohura County to the middle of the Ongarue River; thence southerly down the middle of the said river to a point in line with the west side of the Okoroa Road; thence north-westerly to and along the said side of this road to the eastern boundary of Section 23, Block I, Rangi Survey District; thence south-westerly along the south-eastern boundaries of Sections 23, 9, and 8 of the said Block I, to and across the Opotiki Road; thence south-westerly along the southern side of the said road and the Ararimu East Road to a point in line with the northern boundary of Section 10, Block I, Rangi Survey District; thence across the last-mentioned road and westerly and southerly along the northern and western boundaries of the said Section 10 to the north-eastern corner of Section 9, Block IV, Ohura Survey District; thence generally westerly along the northern boundaries of the said Section 9, Section 14, Block VIII, Sections 8 and 2, Block IV, Ohura Survey District, to the northernmost corner of the last-mentioned section; thence southerly and westerly along the western boundary of the said Section 2 to the Waingongo Stream; thence generally westerly down that stream and the Waitangata Stream to and down the middle of the Ohura River to a point in line with the north side of Prentice Road; thence north-westerly to and along the north side of the said road to the western boundary of Section 19, Block II, Ohura Survey District; thence northerly along the western boundaries of Sections 19 and 20 of the said Block II, the western boundaries of Sections 20 and 24, Block XIV, Aria Survey District, to the eastern boundary of the said Block XIV; thence north-westerly along the said block boundary to a point 40 chains north-west of Section 26, Block XV, Aria Survey District; thence north-easterly along a right line to a point on the eastern boundary of Block X, Aria Survey District, distant 60 chains north-west of the northernmost corner of the said Section 26; thence generally northerly along the eastern boundary of Block X, Aria Survey District to the point of commencement.

Directing Sale of Railway Land at Whangarei Under the Public Works Act, 1928

At the Government House at Wellington, this 24th day of August, 1949

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers and authorities conferred upon him by the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby direct the sale of the land described in the Schedule hereto, such land being no longer required for the public work for which it was taken.

SCHEDULE

APPROXIMATE area of the piece of land directed to be sold: 11·97 perches.

Being Part Railway land comprised in Proclamation 5983.

Situated in Block XII, Purua Survey District, Borough of Whangarei.

In the North Auckland Land District; as the same is more particularly delineated on the plan marked L.O. 9926, deposited in the office of the Minister of Railways at Wellington, and thereon edged red.

Domain Board Appointed to Have Control of the Tenaumai Domain

IN pursuance and exercise of the powers conferred by section forty-four of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

Daniel Galvin,
Pekia Hauora,
Thomas Henderson,
John Mitchell,
Whakatere Totara,
Thomas Edward Walton,
Cora Zoe Henderson,
William James Evans, and
John Harvey Ralph Blong

to be the Tenaumai Domain Board, having control of the land, described in the Schedule hereto: and doth hereby appoint Saturday, the twenty-fourth day of September, one thousand nine hundred and forty-nine, at eleven o’clock a.m., as the time when, and the Naumai Public Hall, as the place where, the first meeting of the Board shall be held.

NORTH AUCKLAND LAND DISTRICT.—TENAUMAI DOMAIN

SECTION 70, Block XI, Tokatoka Survey District; Area 6 acres, 3 roods 10·7 perches, more or less.

Declaring Land in Block VI, Kawakawa Survey District, North Auckland Land District, Vested in His Majesty the King for a School Site, to be Crown Land Subject to the Land Act, 1948

At the Government House at Wellington, this 31st day of August, 1949

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by subsection five of section nine of the Education Reserves Amendment Act, 1948 (hereinafter referred to as the said Act), it is provided that the Governor-General may from time to time, by Order in Council gazetted, vary the trusts on which any land is for the time being held by His Majesty for educational purposes, and may in like manner declare any such land, which is not required for the purposes for which it is held by the Crown, to be Crown land subject to the Land Act, 1948, freed and discharged from every educational trust affecting the same; and whereas the land described in the Schedule hereto is vested in His Majesty as a school site, but it is no longer required for that purpose:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by the said subsection five of section nine of the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare the land described in the Schedule hereto, being land vested in the Crown as a school-site, to be Crown land subject to the Land Act, 1948, freed and discharged from every educational trust affecting the same.

NORTH AUCKLAND LAND DISTRICT.—BAY OF ISLANDS COUNTY

ALL that area of land situated in Block VI, Kawakawa Survey District, containing by admeasurement 2 roods 21·7 perches, more or less, being part Sarah Hutton’s grant, and being part of the land comprised and described in Certificate of Title, Volume 99, folio 158 (Auckland Registry). As the same is more particularly delineated on the plan marked L. and S. 6/6/901, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon coloured yellow. (S.Q. plan 35097.)
