The Gore Milk District Constitution Order 1949

ORDER IN COUNCIL
At the Government House at Wellington, this 24th day of August, 1949
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
IN pursuance and exercise of the powers conferred on him by the Milk Act, 1944, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby order and declare as follows:—

This order may be cited as the Gore Milk District Constitution Order 1949.

Those parts of New Zealand consisting of the Borough of Gore and parts of the County of Southland, described in the Schedule hereto, are hereby constituted and declared a milk district under the Milk Act, 1944, as from the first day of September, one thousand nine hundred and forty-nine, with the name of the “Gore Milk District.”

The Gore Borough Council shall be the Milk Authority of the said district.

The Southland County Council shall be entitled to have one representative on the Milk Committee of the Gore Borough Council and from time to time to nominate a person for that purpose.

The Gore Borough Council shall from time to time appoint to the Milk Committee of the Borough Council the person nominated by the Southland County Council pursuant to clause four hereof.

SCHEDULE
GORE MILK DISTRICT
ALL that area in the Southland Land District bounded as follows: Commencing at a point on the south-east boundary of Section 285, Block LXX, Hokonui Survey District, in line with the southern boundary of Section 13B, Block I, Waikaka Survey District; thence easterly to and along the southern boundaries of the said Section 13B and Sections 1, 13C, 9, and 17, Block I, aforesaid, to a point due north of easternmost corner of Section 16, Block XXV, Town of East Gore; thence due south along a right line to the Waikaka River; thence south-westerly generally along the right bank of that river to its confluence with the Mataura River and across the Mataura River to a point on its right bank in line with the southern side of Bury Street, in the Town of Gore; thence southerly along the right bank of the Mataura River to a point in line with the northern boundary of Lot 7, Block II, on the plan numbered 171, and deposited in the office of the District Land Registrar at Invercargill; thence westerly to and along the northern boundary of the said Lot 7, across a public road, and along the northern boundaries of Lots 6 and 20, Block I, on the plan numbered 171 aforesaid, and those boundaries produced to a point due south of the south-western corner of Lot 17 on the plan numbered 181 and deposited as aforesaid; thence due north along a right line to the said south-western corner of Lot 17; thence north-westerly along a right line to the north-west corner of Lot 1, on the plan numbered 2414 deposited as aforesaid; thence north-easterly along the south-eastern boundaries of Sections 496, 497, and 319, Block LXXXI, Hokonui Survey District, to the south-western side of a public road forming the north-eastern boundary of the said Section 319; thence north-westerly along the south-west side of the said public road to a point in line with the south-eastern boundary of Lot 3, Block III, on the plan numbered 70 and deposited as aforesaid; thence north-easterly to and along the south-eastern boundaries of the said Lot 3 and Lot 8, Block III, on the said plan numbered 70 to the south-western side of the Gore–Lumsden State Highway; thence north-westerly along the said State Highway to a point in line with the south-eastern boundary of Section 285, Block LXX, Hokonui Survey District; thence north-easterly to and along the said south-eastern boundary to the point of commencement.

Setting Apart Maori Land as a Maori Reservation

At the Government House at Wellington, this 17th day of August, 1949
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section five of the Maori Purposes Act, 1937, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby set apart and reserve the Maori freehold land described in the Schedule hereto as a Maori reservation for the use of the Maori people resident in Pamapuria as a tennis-court.

Revoking Rules Under the Judicature Act, 1908, Relating to Enforcement of Workers’ and Contractors’ Liens and Charges

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Judicature Act, 1908, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, and with the concurrence of the Right Honourable the Chief Justice and of all the other members of the Rules Committee constituted under the Judicature Amendment Act, 1930 (four of such other members being Judges of the Supreme Court), doth hereby revoke the rules relating to the enforcement of workers’ and contractors’ liens and charges made on the eighth day of September, one thousand nine hundred and nineteen, and published in the Gazette on the eleventh day of the same month at page 2813.

Boundaries of Borough of Rotorua and County of Rotorua Altered

At the Government House at Wellington this 24th day of August, 1949

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS, at the request of the Rotorua Borough Council, the Local Government Commission, in pursuance of the provisions of the Local Government Commission Act, 1946, has made inquiry into certain proposals for an alteration of the boundaries of the Borough of Rotorua and the County of Rotorua:
And whereas, in pursuance of the provisions of the said Act, the Local Government Commission has approved as final a scheme bearing date the eleventh day of May, one thousand nine hundred and forty-nine, providing for the exclusion of the area described in the Schedule to the said scheme from the Borough of Rotorua and the inclusion of such area in the County of Rotorua:
And whereas it is deemed expedient to give effect to the final scheme as hereinafter appearing:
Now, therefore, in pursuance and exercise of the powers and authorities vested in him by the Local Government Commission Act, 1946, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby declare that as on and from the first day of September, one thousand nine hundred and forty-nine, the area described in the Schedule hereto shall be excluded from the Borough of Rotorua and included in the County of Rotorua, and, with the like advice and consent, doth hereby declare that the alteration of boundaries of the said borough and the said county hereinbefore made shall be deemed to have been effected under the Municipal Corporations Act, 1933.

AREA EXCLUDED FROM THE BOROUGH OF ROTORUA AND INCLUDED IN THE COUNTY OF ROTORUA
ALL that area in the Auckland Land District situated in the Borough of Rotorua, containing approximately 127 acres, bounded by a line commencing at a point, being the northernmost corner of Tihi-o-Tonga C No. 1 Block, and running northerly generally along the eastern boundary of Section 65, Suburbs of Rotorua, and along the eastern boundaries of Lots 2 and 1 as shown on the plan numbered 26991, deposited in the office of the District Land Registrar at Auckland, being parts of Section 64, Suburbs of Rotorua, to the easternmost corner of the last-mentioned lot; thence south-easterly generally along the southern boundary of part Section 63, Suburbs of Rotorua as shown on the plan numbered 24263, deposited as aforesaid, to and along the generally southern boundary of part Lot 2 as shown on the plan numbered 23567, deposited as aforesaid, being part of Section 32, Suburbs of Rotorua, and part Section 10, Block I, Tarawera Survey District, and being that part of the Rotorua Domain as described in New Zealand Gazette No. 74 of the 18th day of December, 1947, page 1920, to and along the western side of the Old Tauranga–Taupo Road, and along the western side of the Rotorua–Taupo State Highway to a point due west of the northernmost corner of Whakarewarewa No. 2B Block; thence due east along a right line across the said State Highway and Lot 3 as shown on the plan numbered 23567 aforesaid, being part of Section 10 aforesaid, to the left bank of the Puarenga Stream; thence southerly generally up the said left bank to the Rotorua Borough Boundary as described in New Zealand Gazette No. 3 of the 24th day of June, 1948, page 791; thence north-westerly generally along that boundary to the point of commencement.
