ORDER IN COUNCIL

At the Government House at Wellington, this 27th day of
July, 1949

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Harbours Act, 1923, His Excellency the
Governor-General, acting by and with the advice and consent
of the Executive Council, doth hereby licence and permit Waikawa
Fisheries, Limited, of Dunedin (hereinafter called the company,
which term shall include its successors and assigns unless the context
requires a different construction), to use and occupy that part of
the foreshore and land below low-water mark in Waikawa Harbour,
shown on plans marked M.D. 8879 and 8906, and deposited in the
office of the Marine Department at Wellington, for the purpose
of erecting and maintaining thereon a freezer, packing shed, and
unloading ramp, such licence to be held and enjoyed by the company
upon and subject to the terms and conditions set forth in the Schedule
hereto.


SCHEDULE

CONDITIONS

  1. THIS licence is subject to the Foreshore Licence Regulations
    1940, and the provisions of those regulations shall, so far as appli-
    cable, apply hereto.

  2. The term of the licence shall be fourteen years from the
    1st day of August, 1949.

  3. The premium payable by the company shall be two pounds
    ten shillings (£2 10s.), and the annual sum payable by the company
    shall be three pounds (£3).

Company of New Zealand, Limited, of Dunedin (hereinafter called
the company, which term shall include its successors and assigns,
unless the context requires a different construction), to use and
occupy a part of the foreshore and land below low-water mark in
Waikawa Harbour, as shown on plan marked M.D. 8888, and de-
posited in the office of the Marine Department at Wellington, for
the purpose of erecting and maintaining a fuel oil pipe line and
staging thereon as shown on the said plan, such licence to be held
and enjoyed by the company upon and subject to the terms and
conditions set forth in the Schedule hereto.

Officer Authorized to Take and Receive Statutory Declarations

PURSUANT to the authority conferred upon me by the three-
hundred-and-first section of the Justices of the Peace Act,
1927, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-
General of the Dominion of New Zealand, do hereby notify and
declare that

Nicholas Brazendale,

being an officer in the service of the Crown holding the office of
Personnel Officer, Government Printing and Stationery Department,
Wellington, is authorized to take and receive statutory declarations
under the three-hundred-and-first section of the Justices of the Peace
Act, 1927.

As witness the hand of His Excellency the Governor-General
this 27th day of July, 1949.

Cancelling the Appointments of Five Non-elective Members of the
Poverty Bay Catchment Board

WHEREAS by a Warrant dated the twentieth day of December,
one thousand nine hundred and forty-seven, and published in
the New Zealand Gazette No. 3 of the fifteenth day of January, one
thousand nine hundred and forty-eight, Philip Athol Malcolm
Reveirs, Esquire, Clifford Lomas Cox, Esquire, Hugh de Orellana
Chamberlain, Esquire, B.Sc., Ernest Alexander Madden, Esquire,
H.D.A., and Edward Walpole McEnnis, Esquire, B.E. were appointed
non-elective members of the Poverty Bay Catchment Board in terms
of section forty-four of the Soil Conservation and Rivers Control
Act, 1941 :

Now, therefore, in pursuance of the powers vested in me by
section forty-four of the Soil Conservation and Rivers Control
Act, 1941, and of all other powers and authorities in anywise enabling
me in this behalf, I, Lieutenant-General Sir Bernard Cyril Freyberg,
the Governor-General of the Dominion of New Zealand, do hereby
cancel the appointments of the said Philip Athol Malcolm Reveirs,
Clifford Lomas Cox, Hugh de Orellana Chamberlain, Ernest Alex-
ander Madden, and Edward Walpole McEnnis as non-elective
members of the Poverty Bay Catchment Board.

As witness the hand of His Excellency the Governor-General,
this 27th day of July, 1949.

Esquire, B.Sc.(For.), Ivan Joseph Pohlen, Esquire, M.A.,
Frank Rupert Burnley, Esquire, Roland Phillip Hill, Esquire, and
Frederick William Lindup, Esquire, A.M.I.C.E., were appointed non-
elective members of the Hawkes Bay Catchment Board in terms of
section forty-four of the Soil Conservation and Rivers Control Act,
1941 :

Hamblyn, Esquire, B.Agr.Sc., and Thomas Strathallan Roe, Esquire,
were appointed non-elective members of the Manawatu Catchment
Board in terms of section forty-four of the Soil Conservation and
Rivers Control Act, 1941 :
