Varying the Determinations in Respect of the Whangarei Borough Council’s Loan of £19,500

ORDER IN COUNCIL
At the Government House at Wellington, this 27th day of July, 1949
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS by Order in Council made on the third day of March, one thousand nine hundred and forty-eight (hereinafter called the said Order in Council), and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Whangarei Borough Council (hereinafter called the said local authority) of a loan of nineteen thousand five hundred pounds (£19,500), to be known as “Storm-water Drainage Additional Loan, 1947” (hereinafter called the said loan):
And whereas the authority conferred by the said Order in Council has not yet been exercised and it is expedient to vary certain of the determinations aforesaid in respect of the said loan:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary certain of the determinations aforesaid in respect of the said loan by prescribing that in lieu of repayment by the annual redemption of debentures as specified in clause three of the said Order in Council, the said loan or any part thereof, together with interest thereon, shall be repaid by equal aggregate annual or half-yearly instalments extending over the term of twenty (20) years as specified in clause one of the said Order in Council.

Varying the Determinations in Respect of the Balance (£74,000) of the Wellington City Council’s Loan of £104,000

At the Government House at Wellington, this 27th day of July, 1949
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS by Order in Council made on the fourteenth day of January, one thousand nine hundred and forty-eight (hereinafter called the said Order in Council), and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Wellington City Council (hereinafter called the said local authority) of a loan of one hundred and four thousand pounds (£104,000) to be known as “Wellington City Reserves Loan, 1948” (hereinafter called the said loan):
And whereas the sum of thirty thousand pounds (£30,000) has been raised and it is expedient to vary certain of the determinations aforesaid in respect of balance of the said loan amounting to seventy-four thousand pounds (£74,000) (hereinafter called the said sum):
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary certain of the determinations aforesaid in respect of the said sum by prescribing that in lieu of provision being made for the repayment of the said sum by the establishment of a sinking fund in respect thereof, as specified in clause three of the said Order in Council, the said sum or any part thereof, together with interest thereon, shall be repaid by equal aggregate annual or half-yearly instalments extending over the term of twenty (20) years as specified in clause one of the said Order in Council.

Varying the Determinations in Respect of Portion (£10,700) of the Christchurch City Council’s Loan of £120,730 by Extending the Term Within Which the Said Sum May be Borrowed

At the Government House at Wellington, this 20th day of July, 1949
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS by Order in Council made on the twenty-third day of July, one thousand nine hundred and forty-seven (hereinafter called the said Order in Council), and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Christchurch City Council (hereinafter called the said local authority) of a loan of one hundred and twenty thousand seven hundred and thirty pounds (£120,730), to be known as “Water-supply Extension Loan, 1947” (hereinafter called the said loan):
And whereas the authority conferred by the said Order in Council has not been exercised to the extent of ten thousand seven hundred pounds (£10,700) (hereinafter called the said sum), and it is expedient to extend the term as specified in clause seven of the said Order in Council within which the said sum or any portion thereof may be raised:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council, of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations aforesaid in respect of the said sum by prescribing that no moneys shall be borrowed under the consent given by the said Order in Council after the expiration of three (3) years from the date thereof.

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby direct the sale of the land described in the Schedule hereto, such land being no longer required for the purpose for which it was acquired.
