Vesting the Control of a Reserve in the Hawkes Bay County Council

ORDER IN COUNCIL
At the Government House at Wellington, this 6th day of July, 1949
Present:
His Excellency THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS the land described in the Schedule hereto has been duly set apart as a reserve for a resting-place for travelling stock:
And whereas it is expedient that the control of the said reserve should be vested in the Hawkes Bay County Council:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section seventeen of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby vest the control of the said reserve in the Hawkes Bay County Council.

SECTION 25, Block VIII, Heretaunga Survey District : Area, 1 acre, more or less. (S.O. plan 2131, red.)

Vesting the Control of Recreation Reserves in the Heathcote County Council

His Excellency THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS the lands described in the Schedule hereto have been duly set apart as reserves for recreation purposes:
And whereas it is expedient that the control of the said reserves should be vested in the Heathcote County Council:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section seventeen of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby vest the control of the said reserves in the Heathcote County Council.
SCHEDULE
CANTERBURY LAND DISTRICT
ALL that area containing by admeasurement 3 roods 1ยท6 perches, more or less, being Reserve 4390 (formerly Lot 27, D.P. 11144, being part of Rural Section 138) situated in Block XV, Christchurch Survey District, and being subject to water easement appurtenant to Lot 8, D.P. 11273.
Also all that area containing by admeasurement 32ยท1 perches, more or less, being Reserve 4405 (formerly Lot 5, D.P. 11381, being part of Rural Section 138) situated in Block XV, Christchurch Survey District.
As the same are more particularly delineated on the plan marked L. and S. 25/183, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

The South-eastern Side of Portion of Portobello Road in the City of Dunedin, Exempted from the Provisions of Section 128 of the Public Works Act, 1928

ORDER IN COUNCIL
Pursuant to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the twenty-second day of November, one thousand nine hundred and forty-eight, in so far as it affects the side and portion of street described in the Schedule hereto, viz :-
That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-eastern side of the portion of Portobello Road adjoining part Section 73, Block VII, Town District, such land being comprised and described in Certificate of Title 296/131."
SCHEDULE
The south-eastern side of all that portion of street situated in the City of Dunedin, Otago Land District, known as Portobello Road, fronting part Section 73, Block VII, Town District. As the same is more particularly delineated on the plan marked P.W.D. 129214, deposited in the office of the Minister of Works at Wellington, and thereon edged red.

Authorizing Erection of a Public Hall on Rangiaohia Domain, South Auckland Land District

In pursuance and exercise of the power and authority conferred upon me by subsection one (d) of section fifty-two of the Public Reserves, Domains, and National Parks Act, 1928, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby authorize the Rangiaohia Domain Board to erect a public hall on that portion of the Rangiaohia Domain under its control described in the Schedule hereto.

SOUTH AUCKLAND LAND DISTRICT.-PORTION OF RANGIAOHIA DOMAIN
All that area in the County of Waipa containing by admeasurement 8 perches, more or less, being part Lot 1 as shown on the plan numbered 35050, deposited in the Office of the District Land Registrar at Auckland, being part Allotment 194, Puniu Parish. As the same is more particularly delineated on the plan marked L. and S. 1/1225A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red.
As witness the hand of His Excellency the Governor-General, this 5th day of July, 1949.

Notifying the Proposed Exchange of Crown Land in the Hawkes Bay Land District for Other Land

WHEREAS by section sixty-one of the Land Act, 1948, it is enacted that the Governor-General may, in any case where he deems it expedient in the public interest to do so, grant in fee-simple any area of Crown land in exchange for the fee-simple of any other land, and on any such exchange the Land Settlement Board may pay or receive any sum by way of equality of exchange:
And whereas, in the opinion of the Governor-General, it is expedient to exchange the Crown land described in the First Schedule hereto for the land described in the Second Schedule hereto, and the owner of the land described in the Second Schedule has agreed to such exchange, and has agreed to accept from the Crown a sum of money by way of equality of exchange:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in exercise of the aforesaid powers and authorities, doth hereby declare it is his intention to grant in fee-simple the area of Crown land described in the First Schedule hereto in exchange for the fee-simple of the land described in the Second Schedule upon payment by the Crown of the sum of money hereinbefore referred to by way of equality of exchange.
FIRST SCHEDULE
DESCRIPTION OF LAND AUTHORIZED TO BE EXCHANGED
Hawkes Bay Land District
All that area containing by admeasurement 43 acres 1 rood 5 perches, more or less, being Section 3, Block IV, Waipukurau Survey District, and being part of the land contained in limited Certificate of Title, Volume 115, folio 4 (Hawkes Bay Registry.)
SECOND SCHEDULE
DESCRIPTION OF LAND TO BE OBTAINED IN EXCHANGE THEREFOR
Hawkes Bay Land District
All that area containing by admeasurement 109 acres 2 roods 9 perches, more or less, being Lot 5, S.O. Plan 2308, being part Patangata 4A 5A and 4A 5B Blocks, and part Otane Block, situated in Block IV, Waipukurau and Block I, Oero Survey Districts, and being also part of the land contained in interim Certificates of Title, Volume 55, folio 33, and Volume 83, folio 264 (Hawkes Bay Registry).
As witness the hand of His Excellency the Governor-General, this 6th day of July, 1949.
