Vesting the Control of a Scenic Reserve in the Willsheh Bay Scenic
Reserve Board

In pursuance and exercise of the powers and authorities conferred
upon him by section thirteen of the Scenery Preservation Act,
1908, His Excellency the Governor-General of the Dominion of
New Zealand doth hereby vest the control of the reserve described
in the Schedule hereto (being land reserved under the said Act) for
the period of five years from the date hereof (unless previously
altered or revoked under the said Act) in the undermentioned
persons, namely—
The Chairman, Clutha County Council, ex-officio,
The Member of Clutha County Council representing South
Molyneux Riding, ex officio,
James Balfour Campbell,
James Cunningham,
Cecil Marcus Jackman,
George Dyer Cunningham,
William Andrew Dabinett,
Frank Albert Barber, and
John James Howard,
who are hereby constituted for that purpose a special Board by the
name of the Willsheh Bay Scenic Reserve Board (herein referred to
as the Board), in trust, for the preservation of scenery, and with the
powers and subject to the conditions hereinafter contained, that is
to say :—
- The first meeting of the Board shall be held on Monday,
the fourth day of July, one thousand nine hundred and forty-nine,
at half-past seven o'clock p.m., in the Kaka Point Hall, and thereafter
the Board shall meet for the transaction of business at such time
or place as may from time to time be fixed by the Board. - The members of the Board shall at their first meeting, and
thereafter at the annual meeting hereinafter mentioned, elect one
of themselves to be Chairman, who may join in the discussion and
shall have an original as well as a casting vote. The Chairman shall
hold office until the election of his successor. - Special meetings may be convened by the Chairman, provided
that two days' notice of such meeting is given to each member,
specifying the business to be transacted at such special meeting;
and no other business than that so specified shall be transacted at
such meeting. - Any five members of the Board shall form a quorum. Any
meeting may be adjourned from time to time. - All questions shall be determined by the majority of votes
of the members of the Board present at the meeting. - If at any meeting the Chairman is not present at the time
appointed for holding the same, the members present shall choose
one of their number to be Chairman for such meeting. - If by resignation, death, incapacity, or otherwise the seat
of any member shall be or become vacant, or if any member absents
himself, without reasonable cause, from three consecutive meetings
of the Board, the Governor-General shall have power to appoint
any other person to be a member of the Board in his stead. - The Board shall prepare and submit at an annual meeting
to be held in the month of April in each year a report of the pro-
ceedings of the Board for the previous year ending on the thirty-first
day of March, together with a statement of the receipts and expendi-
ture of the Board for such year. A copy of every such report and
statement, certified by the Chairman to be correct, shall be sent to
the Minister in Charge of Scenery Preservation as soon as possible
after each annual meeting. - The Board shall control the said reserve in accordance with
the provisions of the said Act and of the regulations made thereunder.
SCHEDULE
OTAGO LAND DISTRICT.—WILLSHER BAY SCENIC RESERVE
ALL that area containing by admeasurement 121 acres 0 roods
22 perches, more or less, being part of Section 48, Block IV, Glen-
omaru Survey District; Bounded towards the north by a public
road, 1180 links; towards the east by another part of Section 48,
1800 links; towards the south-east by Karoro Stream, 5520 links;
across a public road and towards the south-east generally by that
stream, 6560 links; towards the west by Section 34, 1400·2 links;
towards the north and north-west by another part of Section 48,
2278·3 and 2473·1 links respectively; across a public road and
again towards the north-west and west by said part Section 48,
2679·7 and 2238·2 links respectively: be all the aforesaid linkages
more or less, and excepting out of the above-described area one
road-line 100 links wide. As the same is more particularly delineated
on the plan marked L. and S. 4/131B, deposited in the Head Office,
Department of Lands and Survey, at Wellington, and thereon
bordered red.

Exempting Land (State Coal Reserve) in the Westland Land District
from the Operation of Part III of the Coal-mines Act, 1925

IN pursuance and exercise of the powers and authorities conferred
upon me by subsection two of section one hundred and seventy-
one of the Coal-mines Act, 1925, and of all other powers and
authorities enabling me in this behalf, I, Lieutenant-General Sir
Bernard Cyril Freyberg, the Governor-General of the Dominion of
New Zealand, do hereby declare that the land described in the
Schedule hereto shall be exempt from the operation of Part III of
the Coal-mines Act, 1925, and do hereby further declare that this
notice shall take effect as from the date of the publication hereof
in the New Zealand Gazette.
SCHEDULE
ALL that area of land in the Westland Land District containing by
admeasurement 37·1 perches, more or less, being Section 1 and
formerly parts of Sections 1 and 2, Block XXI, Town of Runanga.
As the same is more particularly delineated on Hokitika Survey
Office Plan No. 4491, and thereon in outline edged red.
As witness the hand of His Excellency the Governor-General,
this 28th day of June, 1949.
