Also all that parcel of land situated in Block XI, Hukerenui Survey District, containing by admeasurement two hundred and three (203) acres one (1) rood, more or less, being Allotments 89 and 90, Hikurangi Parish, and being all the land described in certificate of title, Vol. 56, folio 168 (Auckland Registry).

Also all that parcel of land situated in Blocks XI and XII, Hukerenui Survey District, containing by admeasurement seventy-eight (78) acres three (3) roods, more or less, being Allotment 82, Hikurangi Parish, and being all the land described in certificate of title, Vol. 57, folio 204 (Auckland Registry).

Also all that parcel of land situated in Blocks XI and XII, Hukerenui Survey District, containing by admeasurement one hundred and ninety-seven (197) acres two (2) roods twenty-seven (27) perches, more or less, being Allotments 83 and 84, Hikurangi Parish, and being all the land described in certificate of title, Vol. 58, folio 243 (Auckland Registry).

Also all that parcel of land situated in Block XI, Hukerenui Survey District, containing by admeasurement nineteen (19) acres three (3) roods twelve (12) perches, more or less, being Allotment 95, Hikurangi Parish, and being all the land described in certificate of title, Vol. 119, folio 233 (Auckland Registry).

Also all that parcel of land situated in Blocks XI and XV, Hukerenui Survey District, containing by admeasurement three hundred and eighty-three (383) acres three (3) roods, more or less, being Allotment 94, Hikurangi Parish, and being all the land described in certificate of title, Vol. 150, folio 2 (Auckland Registry).

Also all that parcel of land containing by admeasurement twenty-three decimal five (23·5) perches, more or less, being Lot 1 on Deposited Plan 11323, and being portion of Sections 2 and 29, Block XII, Hukerenui Survey District, and being all the land described in certificate of title, Vol. 340, folio 80 (Auckland Registry).

Also all that parcel of land situated in Block XII, Hukerenui Survey District, containing by admeasurement one hundred and thirty-four (134) acres twenty-six decimal eight (26·8) perches, more or less, being part Allotments W. 23, M. 23, N.W. 31, and S.E. 31, Hikurangi Parish, and being all the land described in certificate of title, Vol. 770, folio 213 (Auckland Registry), limited as to parcels.

The Servicemen’s Settlement and Land Sales Act, 1943.—Notice Declaring Lands Taken for the Settlement of Discharged Servicemen


WHEREAS, pursuant to section 24 of the Servicemen’s Settlement and Land Sales Act, 1943, notice was given of the intention of the Minister of Lands to take under Part II of the said Act the lands described in the First Schedule hereto, and a copy of the said notice was published in the New Zealand Gazette No. 12 on the 4th day of March, 1948, at page 248 :

And whereas objections were made by the owner of the said lands and by the occupiers of part of the said lands in the manner prescribed by the said Act, objecting to the taking of the said lands :

And whereas the owner did claim the right to retain a part of the said lands :

And whereas the Minister of Lands did not revoke his notice of intention to take the said lands and did not agree to the retention by the owner of the area specified in the said objection :

And whereas the Minister of Lands did make to the owner an offer of an area to be retained :

And whereas the owner did accept the offer of such area to be retained :

And whereas the owner and the occupiers did withdraw the objections to the taking of the land described in the Second Schedule hereto :

And whereas the Land Sales Committee did on the 9th day of July, 1948, make an order determining that the land described in the said Second Schedule is suitable or adaptable for the settlement of a discharged serviceman or of two or more discharged servicemen :

And whereas no appeal from the said order was made within the time prescribed by the said Act or within any further time allowed by the Court :

And whereas the owner has agreed to an amended vesting-date :

And whereas the land described in the said Second Schedule is not the land of any serviceman who is for the time being serving outside New Zealand in any of His Majesty’s Forces or in any British ship :

Now, therefore, the Minister of Lands, acting in pursuance of section 27 of the said Act, doth hereby declare that the land described in the said Second Schedule is taken for the settlement of discharged servicemen, and hereby specifies the 30th day of June, 1949, as the date on which the said land shall be deemed to be vested in His Majesty the King.


FIRST SCHEDULE

TARANAKI LAND DISTRICT

ALL those parcels of land containing seven hundred and twenty-two (722) acres thirty-five (35) perches, more or less, being :—

Seventeen (17) acres two (2) roods, being Section 12, Block XII, Cape Survey District, and being all of the land in certificate of title, Vol. 11, folio 213.

Twenty-five (25) acres, being Section 13, Block XII, Cape Survey District, and being all of the land in certificate of title, Vol. 24, folio 213.

Twenty-four (24) acres three (3) roods thirty (30) perches, being Section 22, Block XII, Cape Survey District, and being all of the land in certificate of title, Vol. 14, folio 96.

One hundred and thirty (130) acres three (3) roods, being Section 83, Block XII, Cape Survey District, and being all of the land in certificate of title, Vol. 28, folio 30.

One hundred and fifty-two (152) acres, being Section 28, Block XII, Cape Survey District, and being all of the land in certificate of title, Vol. 37, folio 71.

Three hundred and twenty (320) acres, being Section 78, Block VIII, Cape Survey District, and being all of the land in certificate of title, Vol. 22, folio 220.

Fifty-two (52) acres five (5) perches, being Pungarehu B 2 Block, formerly part Section 23, Block XII, Cape Survey District, and being all of the land in certificate of title, Vol. 91, folio 80 (Taranaki Registry).


SECOND SCHEDULE

TARANAKI LAND DISTRICT

ALL that area containing one hundred and fourteen (114) acres and ten (10) perches, more or less, being part Section 78, Block VIII, Cape Survey District, and being part of the land in certificate of title, Vol. 22, folio 220 (Taranaki Registry), and more particularly delineated on a plan lodged in the office of the Chief Surveyor at New Plymouth as S.O. 8330, and thereon bordered red.

The Servicemen’s Settlement and Land Sales Act, 1943.—Notice Declaring Land Taken for the Settlement of a Discharged Serviceman


WHEREAS an application has been made for the consent of the Land Sales Court to a transaction which relates to the land described in the Schedule hereto and to which Part III of the Servicemen’s Settlement and Land Sales Act, 1943, applies :

And whereas the Land Sales Committee to which the application has been referred is of opinion that the land to which the application relates is farm land suitable or adaptable for the settlement of a discharged serviceman :

And whereas the said committee, not being satisfied that the Crown had decided not to acquire or arrange for the acquisition of the land, did on the 26th day of November, 1948, make an order determining the basic value of the land and no appeal from the said order was made within the time prescribed by the said Act or within any further time allowed by the Court :

And whereas the said land is not the land of any serviceman who is for the time being serving outside New Zealand in any of His Majesty’s Forces or in any British ship :

Now, therefore, the Minister of Lands, acting in pursuance of section 51 of the said Act, doth hereby declare that the said land is taken for the settlement of a discharged serviceman, and hereby specifies the 20th day of December, 1948, as the date on which the said land shall be deemed to be vested in His Majesty the King.


SCHEDULE

OTAGO LAND DISTRICT

ALL that area containing ninety-nine (99) acres one (1) rood and nineteen (19) perches, more or less, being Section 12 and part of Section 10, Block LXV, Clutha Survey District, and being all the land in certificate of title, Vol. 170, folio 82 (Otago Registry).

Also all those areas containing together two hundred and one (201) acres two (2) roods and ten (10) perches, more or less, being Sections 3, 5, and parts of Sections 7 and 9, Block LXV, Clutha Survey District, shown on Deposited Plan No. 3814, and being all the land in certificate of title, Vol. 234, folio 215 (Otago Registry).

Also all those areas containing together two hundred and two (202) acres one (1) rood and thirty-four (34) perches, more or less, being part of Section 8, Block LXV, Clutha Survey District, and Lots 19 and 19A, Carterhope Estate, on Deposited Plan 933, being Section 11, Block LXV, and Sections 1, 3, and part of Section 5, Block LXVI, Clutha Survey District, and being all the land in certificate of title, Vol. 267, folio 18, limited as to parcels (Otago Registry).
