The South-western Side of Portion of Mataora Road, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

At the Government House at Wellington, this 21st day of July, 1948
Present:
His Excellency the Governor-General in Council

Pursuant to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the eighth day of June, one thousand nine hundred and forty-eight, viz. :—

“ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-western side of the portion of Mataora Road adjoining Lot 21, D.P. 1820, Township of Hawthorn Hill, being part Section 79, Block VI, Town District, such land being comprised and described in Certificate of Title 229/38 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of the portion of Mataora Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE

The south-western side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Mataora Road, fronting Lot 21, D.P. 1820, Township of Hawthorn Hill. As the same is more particularly delineated on the plan marked P.W.D. 127399, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The Northern Side of Portion of Station Road, in the City of Wellington, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

Pursuant to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wellington City Council on the twenty-first day of April, one thousand nine hundred and forty-eight, viz. :—

“ The Wellington City Council, being the local authority having control of the streets in the City of Wellington, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north side of that portion of Station Road fronting that part of Lot 21, D.P. 668, comprised in Certificate of Title 459/161 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of the portion of Station Road (described in the Schedule hereto) within a distance of thirty-five feet from the centre-line of the said portion of street.

SCHEDULE

The northern side of all that portion of street situated in the Wellington Land District, City of Wellington, known as Station Road, fronting part Lot 21, D.P. 668, being part Section 3, Porirua District. As the same is more particularly delineated on the plan marked P.W.D. 127408, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

“ (b) The south-eastern side of the portion of Gilmore Street adjoining Lots 6, 11, and 15, D.P. 51, Township of Broughton, being parts Sections 16 and 17, Block IV, Upper Kaikorai District;

“ (c) The north-western side of the portion of Pennant Street adjoining Lots 3, 10, and 14, D.P. 51, Township of Broughton, being parts Sections 16 and 17, Block IV, Upper Kaikorai District;

such land being comprised and described in Certificates of Title 17/261 and 32/136 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of Taieri Road, the south-eastern side of the portion of Gilmore Street, or the north-western side of the portion of Pennant Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.
