Proclaiming a Road-line laid off in Block V, Opuawhanga Survey District, North Auckland Land District, to be a Public Road

A PROCLAMATION

WHEREAS the land described in the Schedule hereto was, by an order of the Maori Land Court made on the sixteenth day of January, one thousand nine hundred and forty-six, duly laid off as a road-line in pursuance of section four hundred and eighty-two of the Maori Land Act, 1931:

And whereas the said Court is of the opinion that it is in the public interest that the said road-line should be proclaimed as a public road, and a notification to that effect has been forwarded to the Minister of Lands, in terms of section four hundred and eighty-six of the said Act:

And whereas one month's notice in writing of the intention to proclaim the said road-line as a public road has been given by the Surveyor-General to the local authority of the district concerned, in terms of subsection two of section four hundred and eighty-seven of the said Act:

And whereas it is now expedient that the said road-line should be proclaimed as a public road:

Now, therefore, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by section four hundred and eighty-seven of the Maori Land Act, 1931, do hereby proclaim as a public road the road-line described in the Schedule hereto.

The Southern Side of Portion of Faraday Street, in the Borough of Napier, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

At the Government House at Wellington, this 28th day of July, 1948

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Napier Borough Council on the thirty-first day of May, one thousand nine hundred and forty-eight, viz.:—

“ The Napier Borough Council, being the local authority having control of the streets in the Borough of Napier, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the southern side of the portion of Faraday Street adjoining all those pieces of land situate in the Borough of Napier containing—first, thirty-six perches (36 perches), being portion of Suburban Sections 40 and 41, Town of Napier, comprising the western moiety of Lot Thirty-three (33) on Deposited Plan No. 1335, and being all the land in Certificate of Title, H.B. Volume 71, folio 14, and, secondly, thirty-six perches (36 perches), being part of Suburban Sections 40 and 41, Town of Napier, comprising the eastern moiety of Lot Thirty-three (33) on Deposited Plan No. 1335, and being all the land in Certificate of Title, H.B. Volume 71, folio 26 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Faraday Street (described in the Schedule hereto) within a distance of thirty feet from the centre-line of the said portion of street.

SCHEDULE
THE southern side of all that portion of street situated in the Hawke’s Bay Land District, Borough of Napier, known as Faraday Street, fronting—first, the portion of Suburban Sections 40 and 41, Town of Napier, comprising the western moiety of Lot 33, D.P. 1335, and, secondly, the portion of Suburban Sections 40 and 41, Town of Napier, comprising the eastern moiety of Lot 33, D.P. 1335. As the same is more particularly delineated on the plan marked P.W.D. 127336, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

“ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-western side of the portion of Greenock Street adjoining Lot 30, D.P. 20, Township of Hawthorndale, being part Section 13, Block IV, Upper Kaikorai District, such land being comprised and described in Certificate of Title 25/32 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of the portion of Greenock Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE
THE south-western side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Greenock Street, fronting Lot 30, Township of Hawthorndale. As the same is more particularly delineated on the plan marked P.W.D. 127398, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
