The Southern Side of Portion of Lennie’s Road, in the County of Masterton, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

At the Government House at Wellington, this 15th day of October, 1947
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Masterton County Council on the ninth day of September, one thousand nine hundred and forty-seven, viz. :—
“ That the Masterton County Council, being the local authority having control of the roads in the County of Masterton, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the southern side of Lennie’s Road abutting on part Lot 5, D.P. 988, being also part Section 2 and part Section 56, Opaki Block, Block XIII, Kopuaranga Survey District, being the land comprised in Certificate of Title, Volume 103, folio 256 ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Lennie’s Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.
SCHEDULE
THE southern side of all that portion of road in the Wellington Land District, Masterton County, known as Lennie’s Road, fronting part Lot 5, D.P. 988, being also part Section 2 and part Section 56, Opaki Block. As the same is more particularly delineated on the plan marked P.W.D. 126190, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waitaki County Council on the twenty-second day of February, one thousand nine hundred and forty-six, viz. :—
“ The Waitaki County Council, being the local authority having control of the roads within the County of Waitaki, hereby resolves, pursuant to the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, that the provisions of that section shall not apply to the following portions of road within the said county, namely—
“ (a) The western side of the roadway abutting on part Allotment Four (4), Deposited Plan No. 5989, Otago Land Registry, being also parts of Section 1 of 30 and Section 1572R, Block IV, Oamaru Survey District ;
“ (b) Both sides of the roadway running through parts said Section 1 of 30 and Section 1572R, and abutting upon other part said Allotment Four (4) and Allotments Three (3), Five (5), Six (6), and Seven (7), said Deposited Plan No. 5989 ” ;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of the unnamed road or on the land fronting either side of a further portion of the said road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portions of road.
SCHEDULE
THE western side of all that portion of unnamed road situated in the Otago Land District, County of Waitaki, fronting part Section 1 of 30 and Section 1572R, Block IV, Oamaru District.
Also both sides of portion of the said road fronting parts Section 1 of 30 and Section 1572R, Block IV, Oamaru District.
As the same are more particularly delineated on the plan marked P.W.D. 123730, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Appointing a Non-elective Member of the Poverty Bay Catchment Board

WHEREAS by a Warrant dated the sixteenth day of May, one thousand nine hundred and forty-seven, and published in the New Zealand Gazette No. 26 of the twenty-second day of the same month, Cyril Thomas Sando, Esquire, was appointed a non-elective member of the Poverty Bay Catchment Board, in terms of section forty-four of the Soil Conservation and Rivers Control Act, 1941 :
And whereas the said Cyril Thomas Sando has resigned from membership of the said Board, and it is considered expedient to appoint another non-elective member in lieu of the said Cyril Thomas Sando :
Now, therefore, pursuant to section forty-four of the Soil Conservation and Rivers Control Act, 1941, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby cancel the appointment of the said Cyril Thomas Sando to be a non-elective member of the Poverty Bay Catchment Board, and do hereby appoint
Philip Athol Malcolm Reveirs, Esquire, Assistant Conservator of Forests, State Forest Service, Rotorua,
to be a non-elective member of the Poverty Bay Catchment Board for a term commencing on the sixteenth day of October, one thousand nine hundred and forty-seven, and terminating on the thirtieth day of November, one thousand nine hundred and forty-seven.
As witness the hand of His Excellency the Governor-General, this 14th day of October, 1947.

Cancelling the Reservation over a Portion of the Newmarket Domain and declaring it to be vested in the Corporation of the Borough of Newmarket, in Trust, as a Site for Municipal Buildings

IN pursuance and exercise of the powers and authorities conferred upon me by section four of the Reserves and other Lands Disposal Act, 1926, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby cancel the reservation for the purposes of recreation over that portion of the Newmarket Domain described in the Schedule hereto, and do further cancel the vesting of the control of such portion in the Newmarket Domain Board, and do hereby declare the land in the said Schedule to be vested in the Corporation of the Borough of Newmarket, in trust, without power of sale, as a site for municipal buildings.
SCHEDULE
NORTH AUCKLAND LAND DISTRICT
ALL that area in the Borough of Newmarket, situated in Block VIII, Rangitoto Survey District, containing by admeasurement 2 roods and 13·69 perches, more or less, being part Allotment 33, Section 4, Suburbs of Auckland : Bounded towards the north-east by railway land, 362·26 links ; towards the south-east by Manukau Road, 168·34 links ; towards the south by another part of the said Allotment 33, being the land comprised and described in Certificate of Title, Volume 51, folio 163, Auckland Land Registry, 241·14 links ; and towards the west by Davis Crescent, 263·69 links ; and as shown on S.O. plan 33625. As the same is more particularly delineated on the plan marked L. and S. 1/246, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red.
As witness the hand of His Excellency the Governor-General, this 9th day of October, 1947.

Land temporarily reserved in the Auckland Land District

WHEREAS by the three-hundred-and-fifty-ninth section of the Land Act, 1924, it is enacted that the Governor-General may from time to time set apart temporarily as reserves, notwithstanding that the same may be then held under pastoral licence, any Crown lands which in his opinion are required for any of the purposes in the said section mentioned :
Now, therefore, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon me by the said Act, do hereby temporarily reserve the land in the Auckland Land District, described in the Schedule hereunder written, for recreation purposes.
SCHEDULE
AUCKLAND LAND DISTRICT
SECTIONS 1 to 7 (inclusive) and 28 to 37 (inclusive), Whangamata Township, situated in Block XVI, Tairua Survey District : Area, 5 acres and 7·2 perches, more or less. (Auckland plan S.O. 31568.)
As witness the hand of His Excellency the Governor-General, this 14th day of October, 1947.
