Price Order No. 745 (Polishes manufactured by the Nugget Polish Co. of N.Z., Ltd.)

Pursuant to the powers conferred on it by the Control of Prices Emergency Regulations 1939,* the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, doth hereby make the following Price Order :—
Preliminary

  1. This Order may be cited as Price Order No. 745, and shall come into force on the 24th day of July, 1947.
  2. (1) Price Order No. 87t is hereby revoked.
    (2) The revocation of the said Order shall not affect the liability of any person for any offence in relation thereto committed before the coming into force of this Order.

Application of This Order

  1. This Order applies only with respect to boot and floor polishes manufactured by the Nugget Polish Company of New Zealand, Limited, and marketed under the trade name of "Nugget," "Poliflor," "Cardinal," "Rolfes," or "Tip Top."

Fixing Maximum Prices of Boot and Floor Polishes to Which This Order Applies

Wholesalers’ Prices

  1. (1) Subject to the following provisions of this clause, the maximum price that may be charged or received by any wholesaler for any boot or floor polish to which this Order applies shall be :—

(2) The maximum prices fixed by the foregoing provisions of this clause are fixed subject to the continuance of the practice with respect to cash and other discounts and with respect to freight arrangements existing immediately prior to the coming into force of this Order.

Retailers’ Prices

  1. The maximum price that may be charged or received by any retailer for any boot or floor polish to which this Order applies shall be determined as follows :—
When sold by a Retailer whose Premises are situate in any Area within which any Wholesaler normally undertakes the Free Delivery of Goods to Retailers. When sold by a Retailer whose Premises are situate Elsewhere.

Provision for Special Prices where Extraordinary Charges Incurred

  1. Notwithstanding anything in the foregoing provisions of this Order and subject to such conditions, if any, as it thinks fit, the Tribunal, on application by any wholesaler or retailer, may authorize special maximum prices in respect of any boot or floor polish to which this Order applies where for any reason extraordinary charges (freight or otherwise) are incurred by the wholesaler or retailer. Any authority given by the Tribunal under this clause may apply with respect to a specified lot or consignment of boot or floor polish or may relate generally to all boot and floor polish to which this Order applies sold by the wholesaler or retailer while the approval remains in force.

Price Order No. 744 (Amending Price Order No. 128) (Eggs)

Pursuant to the powers conferred on it by the Control of Prices Emergency Regulations 1939,* the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, doth hereby make the following amending Price Order

  1. This Order may be cited as Price Order No. 744, and shall be read together with and deemed part of Price Order No. 128† (hereinafter referred to as the principal Order).
  2. This Order shall come into force on the 28th day of July, 1947.
  3. The Second and Third Schedules to the principal Order, as set out in Price Order No. 741†, are hereby revoked, and the following Schedules substituted therefor respectively :—
