  1. The Returning Officer shall by advertisement publicly notify in respect of each election—
    (1) The day on which the election will be held and the hour at which the poll will be closed;
    (2) The respective classes of electors entitled to vote and the number of candidates for whom each such class is entitled to vote:
    (3) The day and hour for the closing of nominations and also of every roll relating to the election:
    (4) The total number of candidates to be elected.

  2. (1) Such advertisement shall be published in not less than three issues of some newspaper published or circulating in the Provincial District of Canterbury, or in the four main centres of New Zealand as may seem appropriate according to the classes of electors concerned. The first advertisement shall appear not later than the twenty-eighth day before the day of the election.
    (2) An interval of not less than three days shall elapse between each such issue and the next, and the last issue shall appear not later than the fourteenth day next preceding the day on which the election is to be held.

  3. Every candidate shall be nominated in writing by one or more electors entitled to vote for his election.

  4. Each such elector may nominate any number of candidates not exceeding the number to be elected by the electors belonging to the same class as the nominating elector.

  5. Every nomination-paper shall be in the form or to the effect following:—

A.B., or [as the case may be], the [set out the full name of the agricultural and pastoral society or other person], being an elector duly entered on the Parliamentary, or, as the case may be, Graduates’ and Diploma-holders’, or Agricultural and Pastoral Societies’ Electoral Roll of the Canterbury Agricultural College, hereby nominates [set out the full name and address of each candidate the elector wishes to nominate] as (a) candidate(s) for election to the Board of Governors by the electors on the aforesaid roll, at the election to be held on the . . . . . . . day of . . . . . . . , 194. . . .

Candidate’s consent to be subscribed at the foot of nomination-paper.

  1. If the nomination-paper does not bear the written consent of the candidate nominated, such consent may be given by him to the Returning Officer before the nominations are closed, and every nomination-paper shall be void in so far as concerns any candidate whose consent is not duly given as aforesaid.

  2. Nomination-papers may be signed in the name and on behalf of an agricultural and pastoral society by the Chairman or any two members of the governing body thereof and under the common seal (if any) of such body.

  3. Nominations shall close at noon on the fourteenth day before the day of the election.

  4. Forthwith after the nominations are closed the Returning Officer shall prepare and post to each elector at his address as appearing on the roll of electors entitled to vote a printed voting-paper containing in alphabetical order of surnames and stating occupations a printed list of all the duly nominated candidates for whom such elector is entitled to vote; and such voting-paper shall be in the form or to the effect following:—

VOTING-PAPER FOR USE AT ELECTION TO BE HELD ON THE . . . . . . . DAY OF . . . . . . . 194. . . , OF MEMBER(S) OF THE BOARD OF GOVERNORS OF THE CANTERBURY AGRICULTURAL COLLEGE BY [set out the class of electors].

Candidates.

[Set out in alphabetical order of surnames the full name of every duly nominated candidate, and state occupation.]

Directions

The number of candidates to be elected is [specify the number]. The voter must draw a line through the name of every candidate for whom he does not intend to vote, and the number of candidates whose names are left uncanceled must not exceed the total number of candidates for whom the voter is entitled to vote.

This voting-paper must be signed by the voter and enclosed in a sealed envelope, and if posted to the Returning Officer must be posted on or before the day of the election, or if delivered to him must be delivered before the day of the election or not later than five o’clock in the afternoon of that day.

If the voter is an agricultural and pastoral society the voting-paper may be signed in the name and on behalf of such society by the Chairman of the meeting at which the vote is given.

  1. The vote of an agricultural and pastoral society shall be given by resolution of the governing body thereof at a meeting held for the purpose at such time on or before the date of the election as will permit of sufficient time for the voting-paper reaching the Returning Officer within the time prescribed by the next ensuing clause hereof; and the Chairman of such meeting shall, in the name and on behalf of the society, mark and sign the voting-paper in accordance with such vote and forward the same to the Returning Officer in a sealed envelope.

  2. The voting-paper, if delivered to the Returning Officer, must be delivered in a sealed envelope before the day of the election, or not later than five o’clock on the afternoon of that day; and, if posted to him, must be posted in a sealed envelope on or before that day.

  3. The poll shall close at five o’clock in the afternoon of the day of the election; but all voting-papers shall be included and counted which are received by the Returning Officer in due course of post before the close of the sixth day after the day of election.

  4. A voting-paper shall be informal in any of the following cases, that is to say:—
    (1) If it is not duly signed by the elector; or
    (2) If the candidates whose names are left uncanceled exceed in number the total number of candidates for whom the elector is entitled to vote; or
    (3) If, being delivered to the Returning Officer, the sealed envelope containing the voting-paper is not delivered at his office before the close of the poll; or
    (4) If, having been forwarded by post, the sealed envelope containing the voting-paper is not received at the office of the Returning Officer before the seventh day after the day of election, or if, from the postmark on the envelope or otherwise, the Returning Officer is satisfied that it was not posted until after the day of the election.

  5. On the seventh day after the day of the election the Returning Officer shall open and examine all the voting-papers duly delivered to him or received by him through the post as aforesaid, and, after rejecting all informal voting-papers, shall ascertain the candidates (not exceeding the total number to be elected by each class of electors) who have received the greatest number of the votes of such electors, and shall declare such candidates to be elected.

  6. If by reason of an equality of votes given for two or more candidates the election is not complete, the Returning Officer shall give a casting-vote determined by lot in the presence of the Chairman or two members of the Board of Governors and thereby complete the election.

  7. Forthwith after the completion of the election the Returning Officer shall notify in the Gazette the names of the persons elected, and the respective classes of electors by whom they are elected.

  8. If any candidate is nominated for election to the same Board by more classes of electors than one, he shall, before the day of the election, notify to the Returning Officer the seat he desires to hold in the event of his receiving votes qualifying him for election to more seats than one on that Board; or, if he fails to duly give such notification, the Returning Officer shall himself, before the close of the poll, determine the seat which such candidate shall hold in such event as aforesaid, and post to him a written notification thereof; and, on the happening of such event, the Returning Officer shall declare him elected to that seat accordingly, whereupon every other seat for which he is so qualified shall be deemed to be vacant, as in the case of a casual vacancy.

  9. The respective regulations dated the 29th day of April, 1897, published in the supplement to the New Zealand Gazette of the 29th day of April, 1897, page 957, and the 12th day of May, 1898, published in the supplement to the New Zealand Gazette of the 19th day of May, 1898, page 865, are hereby revoked.

  10. All rolls, applications, appointments, and generally all documents, matters, and things, and all periods of time which originated under any regulation, under the Canterbury Agricultural College Act, 1930, or under the Canterbury College and Canterbury Agricultural College Act, 1896, and its amendments, and are or were of continuing effect at the time of the coming into force of these by-laws, shall enure for the purposes under the Canterbury Agricultural College Act, 1930, as if they had originated under regulations made under such Act, and shall, where necessary, be deemed to have so originated.

The above by-laws were duly made and adopted by the Board of Governors of the Canterbury Agricultural College this 31st day of October, 1945.

The corporate seal of the Canterbury Agricultural College was hereto affixed pursuant to a resolution of the Board of Governors at a meeting duly held on the 31st day of October, 1945, in the presence of—
