Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Motueka Borough Council on the ninth day of July, one thousand nine hundred and forty-six, viz. :—

“ The Motueka Borough Council, being the local authority having control of the roads in the Borough of Motueka, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the portion of southern side of Whakarewa Street fronting subdivision of Lots 6, 7, and 8, D.P. 1511, part Section 163, N.R., Motueka District, Block IV, Motueka Survey District, and contained in the Certificate of Title, Volume 76, folio 175 ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Whakarewa Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Auckland City Council on the twenty-third day of May, one thousand nine hundred and forty-six, in so far as it affects the sides and portions of street described in the Schedule hereto, viz. :—

“ The Auckland City Council, being the local authority having control of the streets in the City of Auckland, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of West View Road, Grey Lynn, adjoining Allotments 12 and 14, Section 9, Suburbs of Auckland ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side generally, the north-western, or the south-eastern sides of the portions of West View Road (described in the Schedule hereto) within a distance of thirty-seven feet from the centre-lines of the said portions of street.

SCHEDULE

THE western side generally and the north-western side of all those portions of street in the North Auckland Land District, City of Auckland, known as West View Road, fronting part Allotment 12 of Section 9, Suburbs of Auckland.

Also the south-eastern side of the portion of the said street fronting parts Allotments 12 and 14 of Section 9, Suburbs of Auckland.
