THE south-western side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Montrose Street, fronting Lots 51, 53, and 55, D.P. 1590, Township of Glenaven. As the same is more particularly delineated on the plan marked P.W.D. 123680, deposited in the office of the Minister of Works at Wellington, and thereon edged red.

At the Government House at Wellington, this 14th day of August, 1946

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the sixth day of May, one thousand nine hundred and forty-six, viz. :

“ That the Dunedin City Council, being the local authority having control of the streets in the city of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the undermentioned portions of streets, viz. :

“ (a) The south-western side of the portion of Craigleith Street adjoining Lots 65, 66, 67, and 68, Township of Calton ;

“ (b) The north-western side of the portion of Maybank Street adjoining Lots 68 and 69, Township of Calton ;

“ (c) The north-eastern side of the portion of Montrose Street adjoining Lots 69, 70, 71, and 72, Township of Calton ” ;

such land being comprised and described in Certificates of Title 28/280 and 112/69 ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of the portion of Craigleith Street, the north-western side of the portion of Maybank Street, or the north-eastern side of the portion of Montrose Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.

“ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the undermentioned portions of streets, viz. :

“ (a) The south-western side of the portion of Maryhill Terrace adjoining Lot 29, Deeds Plan 253, Glen Estate, being part Section 70, Block VI, Town District ;

“ (b) The north-eastern side of the portion of Mitchell Avenue adjoining Lot 29, Deeds Plan 253, Glen Estate, being part Section 70, Block VI, Town District ;

such land being comprised and described in Certificate of Title 243/13 Ltd.” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of the portion of Maryhill Terrace or the north-eastern side of the portion of Mitchell Avenue (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Auckland City Council on the fourteenth day of March, one thousand nine hundred and forty-six, in so far as it affects the side and portion of street described in the Schedule hereto, viz. :

“ The Auckland City Council, being the local authority having control of the streets in the City of Auckland, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Exmouth Street fronting on subdivision of part of Allotment 1, Section 7, Suburbs of Auckland ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Exmouth Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
