Varying the Determinations in respect of the Balance of £180,000 of
the Auckland City Council’s Loan of £540,000

ORDER IN COUNCIL

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by Order in Council made on the twenty-seventh day of February, one thousand nine hundred and forty-six (hereinafter referred to as the said Order in Council), and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Auckland City Council (hereinafter referred to as the said local authority) of a loan of one hundred and eighty thousand pounds (£180,000), to be known as Waterworks Extension Loan, 1943, £540,000 (issue of £180,000), (hereinafter referred to as the said loan):

And whereas the authority conferred by the said Order in Council has not yet been exercised, and it is expedient to vary the determinations aforesaid in respect of the said loan:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations aforesaid in respect of the said loan by prescribing as follows:—

(1) In lieu of a rate of interest not exceeding three pounds five shillings (£3 5s.) per centum per annum, as specified in clause two of the said Order in Council, the rate of interest that may be paid in respect of the said loan shall be such as shall not produce to the lender or lenders a rate exceeding three pounds two shillings and sixpence (£3 2s. 6d.) per centum per annum.

(2) In lieu of repayment by equal aggregate annual or half-yearly instalments of principal and interest, as specified in clause three of the said Order in Council, the said loan shall be repaid by the half-yearly redemption of debentures in the half-years set out in the First Column of the Schedule hereto of the amounts set opposite such half-years in the Second Column of the said Schedule.

Authorizing the Laying-off of a Street off Fraser Street and Morris Street, in the Borough of Tauranga, of a Width less than 66 ft., but not less than 50 ft., subject to Conditions as to the Building-line

ORDER IN COUNCIL

At the Government House at Wellington, this 14th day of August, 1946

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Municipal Corporations Act, 1933, and the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Tauranga Borough Council to permit the laying-off of the proposed street (described in the Schedule hereto) of a width less than sixty-six feet, but not less than fifty feet, subject to the condition that no building or part of a building shall at any time be erected on Lot 9 of a subdivision of Lot 17 and part Lot 16, D.P. 969, within a distance of thirty-two feet from the centre-line of the said street, or on Lot 17 of the said subdivision of Lot 17 and part Lot 16, D.P. 969, on Lots 10, 11, and 12 of a subdivision of Lots 1 and 9, D.P. 10603, and on Lots 18, 19, 20, and 21 of a subdivision of the land on D.P. 13623 within a distance of forty feet from the centre-line of the said street, or on Lots 6, 7, and 8 of the said subdivision of Lots 1 and 9, D.P. 10603, on Lots 13, 14, 15, 16, 17, and 25 of the said subdivision of the land on D.P. 13623, and on Lots 1, 2, 3, 4, 5, 6, 11, 12, 13, 14, 15, and 16 of the said subdivision of Lot 17 and part Lot 16, D.P. 969, within a distance of forty-eight feet from the centre-line of the said street, all such lots being shown on the plan referred to in the Schedule hereto.

THAT proposed street in the Auckland Land District, Borough of Tauranga, containing by admeasurement 1 acre 2 roods 28·4 perches, more or less, being parts Lots 16 and 17, D.P. 969, part of the land on D.P. 13623, and part Lot 9, D.P. 10603, being parts Section 29, Church Mission Reserve, Section 2, Town of Tauranga. As the same is more particularly delineated on the plan marked P.W.D. 123904, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Municipal Corporations Act, 1933, and the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Dunedin City Council to permit the laying-off of the proposed street described in the Schedule hereto of a width less than sixty-six feet, but not less than fifty-two feet eight inches, subject to the condition that no building or part of a building shall at any time be erected on the land fronting the said street within a distance of forty-eight feet from the centre-line of the said street.

As the same is more particularly delineated on the plan marked P.W.D. 123671, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

ORDER IN COUNCIL

At the Government House at Wellington, this 14th day of August, 1946

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the third day of June, one thousand nine hundred and forty-six, viz.:—

“ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to south-western side of the portion of Montrose Street adjoining Lots 51, 53, and 55, Township of Glenaven, being part Section 8, North-east Valley District, such land being comprised and described in Certificate of Title 131/131 ”;
