Authorizing the Laying-off of a Street in the Borough of Whangarei
of a Width less than 66 ft., but not less than 50 ft., subject to
a Condition as to the Building-line

At the Government House at Wellington, this 12th day of
June, 1946

His Excellency the Administrator of the Government
IN COUNCIL
Pursuant to the Public Works Act, 1928, and the Municipal
Corporations Act, 1933, His Excellency the Administrator of
the Government of the Dominion of New Zealand, acting by and
with the advice and consent of the Executive Council of the said
Dominion, doth hereby authorize the Whangarei Borough Council
to permit the laying-off of the proposed street described in the
Schedule hereto of a width less than sixty-six feet but not less
than fifty feet, subject to the condition that no building or part of
a building shall at any time be erected on the land fronting the said
street within a distance of forty-eight feet from the centre-line of
the said street.
SCHEDULE
That proposed street in the North Auckland Land District, Borough
of Whangarei, containing by admeasurement 3 roods 37·5 perches,
more or less, being part of Allotment 2 of the Parish of Whangarei.
As the same is more particularly delineated on the plan marked
P.W.D. 123036, deposited in the office of the Minister of Works
at Wellington, and thereon coloured red.

The South-eastern Side of Portion of Rutland Street and the North-
eastern Side of Portion of Byron Street, in the City of Dunedin,
exempted from the Provisions of Section 128 of the Public Works
Act, 1928, subject to a Condition as to the Building-line

IN COUNCIL
Pursuant to section one hundred and twenty-eight of the
Public Works Act, 1928, His Excellency the Administrator
of the Government of the Dominion of New Zealand, acting by and
with the advice and consent of the Executive Council of the said
Dominion, doth hereby approve of the following resolution passed
by the Dunedin City Council on the eighth day of April, one thousand
nine hundred and forty-six, viz. :
“ (a) The south-eastern side of the portion of Rutland Street
adjoining Lots 4, 5, and 6, D.P. 200, Glen Estate,
being part Section 68, Block VI, Town District,
such land being comprised and described in Certificates
of Title 53/133, 77/45, and 60/87 ;
“ (b) The north-eastern side of the portion of Byron Street
adjoining Lot 6, D.P. 200, Glen Estate, being part
Section 68, Block VI, Town District, such land being
comprised and described in Certificate of Title
60/87 ” ;
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the south-eastern side of
the portion of Rutland Street or the north-eastern side of the portion
of Byron Street (described in the Schedule hereto) within a distance
of thirty-three feet from the centre-lines of the said portions of
streets.
SCHEDULE
The south-eastern side of all that portion of street situated in the
Otago Land District, City of Dunedin, known as Rutland Street,
fronting Lots 4, 5, and 6, D.P. 200, Glen Estate.
Also the north-eastern side of all that portion of street situated
in the said land district and city, known as Byron Street, fronting
Lot 6, D.P. 200, Glen Estate.
As the same are more particularly delineated on the plan
marked P.W.D. 123396, deposited in the office of the Minister
of Works at Wellington, and thereon edged red.

exempted from the Provisions of Section 128 of the Public Works
Act, 1928, subject to a Condition as to the Building-line

Pursuant to section one hundred and twenty-eight of the
Public Works Act, 1928, His Excellency the Administrator
of the Government of the Dominion of New Zealand, acting by and
with the advice and consent of the Executive Council of the said
Dominion, doth hereby approve of the following resolution
passed by the Wellington City Council on the thirteenth day of
February, one thousand nine hundred and forty-six, viz. :
“ The Wellington City Council, being the local authority
having control of the streets in the City of Wellington, by
resolution declares that the provisions of section one hundred
and twenty-eight of the Public Works Act, 1928, shall not
apply to that part of the northern side of Wade Street fronting
part Lot 23, D.P. 103, being land in Certificate of Title,
Volume 21, folio 242 ” ;
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the northern side of the
portion of Wade Street (described in the Schedule hereto) within a
distance of thirty-three feet from the centre-line of the said portion
of street.
SCHEDULE
The northern side of all that portion of street situated in the Wel-
ington Land District, City of Wellington, known as Wade Street,
fronting Lot 23, D.P. 103, being part Allotment 18, County Section
1, Harbour District. As the same is more particularly delineated
on the plan marked P.W.D. 123614, deposited in the office of the
Minister of Works at Wellington, and thereon coloured red.

New Plymouth, exempted from the Provisions of Section 128 of
the Public Works Act, 1928, subject to a Condition as to the
Building-line

Public Works Act, 1928, His Excellency the Administrator
of the Government of the Dominion of New Zealand, acting by and
with the advice and consent of the Executive Council of the said

by the New Plymouth Borough Council on the seventeenth day of
December, one thousand nine hundred and forty-five, viz. :
“ The New Plymouth Borough Council, being the local
authority having control of the streets in the Borough of New
Plymouth, by resolution declares that the provisions of section
one hundred and twenty-eight, subsection one, of the Public
Works Act, 1928, shall not apply to the western side of the
portion of Dawson Street adjoining Lot C, D.P. 1296, being part
Sections 251, 253, 278, and Sections 277 and 279, Town of
New Plymouth, Certificate of Title, Volume 36, folio 216
(Taranaki Registry) ” ;
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the western side of the
portion of Dawson Street (described in the Schedule hereto) within
a distance of thirty-three feet from the centre-line of the said
portion of street.
SCHEDULE
The western side of all that portion of street situated in the
Taranaki Land District, Borough of New Plymouth, known as
Dawson Street, fronting part Sections 278 and 279, Town of New
Plymouth. As the same is more particularly delineated on the
plan marked P.W.D. 123635, deposited in the office of the Minister
of Works at Wellington, and thereon coloured red.
