The Servicemen’s Settlement and Land Sales Act, 1943.—Notice declaring Land taken for the Settlement of a Discharged Serviceman

WHEREAS an application has been made for the consent of the Land Sales Court to a transaction which relates to the land described in the Schedule hereto and to which Part III of the Servicemen’s Settlement and Land Sales Act, 1943, applies:

And whereas the Land Sales Committee to which the application has been referred is of opinion that the land to which the application relates is farm land suitable or adaptable for the settlement of a discharged serviceman:

And whereas the said committee, not being satisfied that the Crown had decided not to acquire or arrange for the acquisition of the land, did on the 19th day of September, 1945, make an order determining the basic value of the land:

And whereas an appeal was lodged by the owner against the order determining the basic value:

And whereas the Land Sales Court has dismissed such appeal:

And whereas the said land is not the land of any serviceman who is for the time being serving outside New Zealand in any of His Majesty’s Forces or in any British ship:

Now, therefore, the Minister of Lands, acting in pursuance of section 51 of the said Act, doth hereby declare that the said land is taken for the settlement of a discharged serviceman, and hereby specifies the 27th day of June, 1946, as the date on which the said land shall be deemed to be vested in His Majesty the King.

SCHEDULE

WELLINGTON LAND DISTRICT

ALL that area of forty-one (41) acres three (3) roods one decimal eight (1·8) perches, being Section 20, Greytown Small-farm Settlement, and being all the land comprised in certificate of title, Vol. 248, folio 87 (Wellington Registry).

Also all that area of two hundred and seven (207) acres three (3) roods twenty (20) perches, being Sections 22, 24, 34, and 93, and parts of Section 33 and 94, Greytown Small-farm Settlement, accretions from the Waiohine River, and a closed street, and being all the land comprised in certificate of title, Vol. 321, folio 129 (Wellington Registry).

As witness my hand, this 24th day of May, 1946.

Authorizing the Laying-off of Roads of less Width than 66 ft.

———

WHEREAS in the opinion of the Minister of Lands it is inexpedient, by reason of the fact that the land shown upon the plan of Town of Maitland Extension No. 7, affecting part Section 46, Suburban South, situated in Block III, Waimea Survey District, Nelson Land District, is intended to be used wholly for residential purposes, that Bledisloe Avenue, Newall Avenue, Freyberg Avenue, and that part of Louisson Avenue adjoining Lots 5 and 6 shown thereon should be of the width of 66 ft.:

Now, therefore, in pursuance of the power conferred upon him by section 17, subsection (1), of the Land Act, 1924, and of every other power him thereunto enabling, the Minister of Lands doth hereby authorize the laying-off of Bledisloe Avenue, Newall Avenue, Freyberg Avenue, and that part of Louisson Avenue adjoining Lots 5 and 6 of a width of not less than 50 ft.: Provided always that it shall not be lawful for any person to erect or cause to be erected any building at a less distance than 33 ft. from the middle of such roads.

Given under the hand of the Minister of Lands, this 27th day of May, 1946.

WHEREAS in the opinion of the Minister of Lands it is inexpedient, by reason of the fact that the land shown upon the plan of Town of Paraparaumu Beach Extension No. 16, affecting Ngarara West A Nos. 72 and 73, situated in Block III, Kapiti Survey District, Wellington Land District, is intended to be used wholly for residential purposes, that Maxwell Road, that part of Percival Road adjoining Lots 126 and 127, and that part of Fleming Road adjoining Lots 131, 132, 133, 138, 139, 140, and 141 shown thereon should be of the width of 66 ft.:

Now, therefore, in pursuance of the power conferred upon him by section 17, subsection (1), of the Land Act, 1924, and of every other power him thereunto enabling, the Minister of Lands doth hereby authorize the laying-off of Maxwell Road, that part of Percival Road adjoining Lots 126 and 127, and that part of Fleming Road adjoining Lots 131, 132, 133, 138, 139, 140, and 141 of a width of not less than 50 ft.: Provided always that it shall not be lawful for any person to erect or cause to be erected any building at a less distance than 33 ft. from the middle of such roads.

Now, therefore, in pursuance of the power conferred upon him by section 17, subsection (1), of the Land Act, 1924, and of every other power him thereunto enabling, the Minister of Lands doth hereby authorize the laying-off of Green Hill Road and that part of Douglas Road adjoining Lots 11, 20, 32, 38, 39, and 40 of a width of not less than 50 ft.: Provided always that it shall not be lawful for any person to erect or cause to be erected any building at a less distance than 33 ft. from the middle of such roads.

Declaring a Bobby Calf Marketing Pool Area

———

PURSUANT to the Bobby Calf Marketing Regulations 1946, I, Benjamin Roberts, Minister of Marketing, being satisfied that a sufficient majority of the producers in the area of land defined in the Schedule hereto are desirous that such area should be declared to be a pool area for the marketing of bobby calves, do hereby declare such area of land defined as aforesaid to be a Bobby Calf Marketing Pool Area for the purposes of the said regulations under the name set out in the said Schedule, and I do hereby further declare that this notice shall take effect on the 6th day of June, 1946.

SCHEDULE

MURCHISON BOBBY CALF MARKETING POOL AREA

ALL that area of land lying within the Murchison and Waimea Counties, and bounded by a line commencing at the point on the northern boundary of the Murchison County at the south-east corner of Block VII, Hope Survey District; thence following the eastern boundaries of Blocks VII and III, Hope Survey District, in a northerly direction to the north-eastern corner of the said Block III; thence in a westerly direction following the northern boundaries of Blocks III, II, and I, Hope Survey District, and Blocks IV, III, II, and I, Matiri Survey District, to the point where the said northern boundary of Block I, Matiri Survey District, intersects the western boundary of the Murchison County. From this point following along the Murchison County boundary in a generally southerly direction to Mount Victoria; thence in a straight line across country in an easterly direction to the eastern corner of Section 8, Block V, Matakitaiki Survey District; thence in a straight line across country in a generally north-easterly direction to Mount Male, situated in Block I, Sabine Survey District; thence in a straight line across country in a generally north-easterly direction to the south-east corner of Block VIII, Rotoroa Survey District; thence in a straight line across country in a generally northerly direction to Mount Mayfair, situated in Block V, Rotoroa Survey District; thence in a straight line across country in a north-easterly direction to the south-east corner of Block VII, Hope Survey District, being the original point of commencement.
