PURSUANT to section twelve of the Land Act, 1924, I, Sir Michael Myers, the Administrator of the Government of the Dominion of New Zealand, do hereby proclaim as road the land described in the Schedule hereto.

Authorizing the Laying-off of a Street in the Borough of Gisborne of a Width less than 66 ft., but not less than 40 ft., subject to Conditions as to the Building-line

At the Government House at Wellington, this 8th day of May, 1946
Present:
HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL
PURSUANT to the Public Works Act, 1928, and the Municipal Corporations Act, 1933, His Excellency the Administrator of the Government of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Gisborne Borough Council to permit the laying-off of the proposed street described in the Schedule hereto of a width less than sixty-six feet but not less than forty feet, subject to the conditions that no building or part of a building shall at any time be erected on Lots 4, 5, 6, 7, and 8 of a subdivision of parts of Sections 19A, 40A, and 41A, Town of Gisborne (as shown on the plan referred to in the Schedule hereto), within a distance of twenty-three feet from the south-western boundary of the said street, or on Lots 2 and 3 of the said subdivision within a distance of thirteen feet from the said south-western boundary of the said street.
SCHEDULE
THAT proposed street in the Gisborne Land District, Borough of Gisborne, containing by admeasurement 2 roods 10·4 perches, more or less, being parts Sections 19A and 41A, Town of Gisborne. As the same is more particularly delineated on the plan marked P.W.D. 122688, deposited in the office of the Minister of Works at Wellington, and thereon edged red.

The Northern Side of Portion of Elizabeth Street, in the Borough of West Harbour, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

ORDER IN COUNCIL
At the Government House at Wellington, this 8th day of May, 1946
Present:
HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Administrator of the Government of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the West Harbour Borough Council on the fifth day of March, one thousand nine hundred and forty-six, in so far as it affects the side and portion of street described in the Schedule hereto, viz.:—
“The West Harbour Borough Council, being the local authority having control of the streets in the Borough of West Harbour, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of street known as Elizabeth Street adjoining that piece or parcel of land being Lots 16, 18, 19, and 20, Block II, Herne Bay Township”; subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of the portion of Elizabeth Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE
THE northern side of all that portion of street situated in the Otago Land District, Borough of West Harbour, known as Elizabeth Street, fronting Lot 20, Block II, D.P. 1170, Township of Herne Bay. As the same is more particularly delineated on the plan marked P.W.D. 123193, deposited in the office of the Minister of Works at Wellington, and thereon edged red.
