The Western Side of Portion of Tay Street and the Southern Side of Portion of Tweed Street, in the Borough of Oamaru, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

His Excellency the Administrator of the Government in Council
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anyway enabling him in this behalf, His Excellency the Administrator of the Government of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Oamaru Borough Council on the twentieth day of September, one thousand nine hundred and forty-five, viz.:—
“ That the Mayor, Councillors, and Burgesses of the Borough of Oamaru, being the local authority having control of the streets in the Borough of Oamaru, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the west side of Tay Street and the south side of Tweed Street abutting on Allotment Twenty-seven (27), Plan Number 387, Township of Newburgh, comprised in Certificate of Title, Register-book, Volume 65, folio 294”; subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of Tay Street or the southern side of the portion of Tweed Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.
SCHEDULE
THE western side of all that portion of street situated in the Otago Land District, Borough of Oamaru, known as Tay Street, fronting Lot 27, D.P. 387, Township of Newburgh, being part Section 4, Block I, Oamaru District.
Also the southern side of all that portion of street situated in the said land district and borough, known as Tweed Street, fronting Lot 27, D.P. 387, Township of Newburgh, being part Section 4, Block I, Oamaru District.
As the same are more particularly delineated on the plan marked P.W.D. 123203, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

PURSUANT to the Public Works Act, 1928, His Excellency the Administrator of the Government of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Bay of Islands County Council on the thirteenth day of March, one thousand nine hundred and forty-six, the sides and portions of roads affected by such resolution being more particularly described in the Schedule hereto, viz.:-
“ That this Council, being the local authority having control of the roads and streets hereinafter mentioned, hereby resolves that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south side of portion of Grey Street, the east side of portion of Vogel Street, and the north side of portion of Bowen Street fronting the subdivision of Lots 130-135, D.R.O. W. 46, being part Te Wharau Block, all of Kawakawa Town”; subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Grey Street, the eastern side of the portion of Vogel Street, or the northern side of the portion of Bowen Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of roads.
SCHEDULE
THE southern side of all that portion of road situated in the North Auckland Land District, Town District of Kawakawa, County of Bay of Islands, known as Grey Street, fronting Lots 133, 134, and 135, Township of Kawakawa, being a subdivision of part of Te Wharau Block, D.P. 14734.
Also the eastern side of all that portion of road situated in the said land district, town district, and county, known as Vogel Street, fronting Lots 132 and 133, Township of Kawakawa, being a subdivision of part of Te Wharau Block, D.P. 14734.
Also the northern side of all that portion of road situated in the said land district, town district, and county, known as Bowen Street, fronting Lots 130, 131, and 132, Township of Kawakawa, being a subdivision of part of Te Wharau Block, D.P. 14734.
As the same are more particularly delineated on the plan marked P.W.D. 122869, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

PURSUANT to the Public Works Act, 1928, His Excellency the Administrator of the Government of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Nelson City Council on the fourth day of April, one thousand nine hundred and forty-six, viz. :-
“ That the Nelson City Council, being the local authority having control of the streets in the City of Nelson, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply—firstly, to the eastern side of the portion of Stanley Crescent adjoining Sections 69 and 70 and part Section 68, City of Nelson (being the land comprised and described in Certificates of Title, Volume 54, folio 67, and Volume 31, folio 260, Nelson Registry), and, secondly, to the western side of the portion of Haven Road adjoining Sections 69 and 70 and part Section 68, City of Nelson (being the land comprised and described in Certificates of Title, Volume 54, folio 67, Volume 54, folio 68, and Volume 31, folio 260, Nelson Registry)”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the eastern side of the portion of Stanley Crescent or the western side of the portion of Haven Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.

PURSUANT to the Public Works Act, 1928, His Excellency the Administrator of the Government of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby direct the sale of the land described in the Schedule hereto, such land being no longer required for the purpose for which it was acquired.

APPROXIMATE area of the piece of land directed to be sold : 1 rood. Being part Allotment 33, Town of Grahhamtown.
Situated in Block XIII, Whangarei Survey District (Auckland R.D.). (S.O. 33871.)
In the North Auckland Land District ; as the same is more particularly delineated on the plan marked P.W.D. 123340, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
