The Hutt Valley and Bays Metropolitan Milk District Constitution Order 1945

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 12th day of December, 1945

Present:

THE HON. W. NASH PRESIDING IN COUNCIL

IN pursuance and exercise of the powers conferred on him by the Milk Act, 1944 (hereinafter referred to as “the said Act”), His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby order and declare as follows:—

  1. This Order may be cited as the Hutt Valley and Bays Metropolitan Milk District Constitution Order 1945.

  2. Those parts of New Zealand comprising the City of Lower Hutt, the Boroughs of Petone, Eastbourne, and Upper Hutt, and the Mangaroa, Heretaunga, Epuni, and Wainui-o-mata Ridings of the Hutt County, all as at present constituted, are hereby constituted and declared a milk district under the said Act as from the twentieth day of December, one thousand nine hundred and forty-five, with the name of the “Hutt Valley and Bays Metropolitan Milk District.”

  3. The Milk Authority of the said milk district shall be a Metropolitan Milk Board, to be known as the “Hutt Valley and Bays Metropolitan Milk Board” (hereinafter referred to as “the Milk Board”).

  4. The Milk Board shall, subject to the provisions of section twenty of the said Act, consist of seven representatives of the constituent districts, of whom three shall be representatives of the City of Lower Hutt and one each shall be representatives of the Borough of Petone, the Borough of Eastbourne, the Borough of Upper Hutt, and the County of Hutt.

  5. The first election of members of the Milk Board shall be held on the twenty-third day of January, one thousand nine hundred and forty-six, and T. G. Richardson, Town Clerk, of Lower Hutt, shall be the Returning Officer to conduct the first election; and for the purposes of that election—

(a) The offices of the Lower Hutt City Council shall be deemed to be the offices of the Milk Board;

(b) Clause (1) of Regulation 7 of the Milk Board Election Regulations 1945 shall be read as if the words “twenty-eight days” were substituted for the words “forty-two days.”

The South-eastern Side of Portion of the Takaka–Tarakohe Main Highway, in the County of Takaka, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 5th day of December, 1945

Present:

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Takaka County Council on the ninth day of October, one thousand nine hundred and forty-five, viz.:—

“The Takaka County Council, being the local authority having control of the roads in the County of Takaka, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-eastern side of Takaka–Tarakohe Main Road fronting subdivision of part Section 1 of 5 (Reserve K), Takaka (Native District), Block X, Waitapu Survey District, and contained in the Certificate of Title, Volume 13, folio 142 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Takaka–Tarakohe Main Highway (described in the Schedule hereto) within a distance of thirty-five feet from the centre-line of the said portion of road.

SCHEDULE

THE south-eastern side of all that portion of road in the Nelson Land District, County of Takaka, known as the Takaka–Tarakohe Main Highway, fronting part of Subdivision 1 of Section 5 (Reserve K), District of Motupipi, Block X, Waitapu Survey District. As the same is more particularly delineated on the plan marked P.W.D. 122536, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of portion of the Nelson–Westport Main Highway (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.

THE south-eastern side of all that portion of the Nelson–Westport Main Highway, situated in the Nelson Land District, County of Waimea, fronting part Section 5, District of Waimea East, Block X, Waimea Survey District. As the same is more particularly delineated on the plan marked P.W.D. 121919, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Regulation under the Government Life Insurance Act, 1908

PURSUANT to the Government Life Insurance Act, 1908, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council,—

(1) Doth hereby direct that the following tables be no longer used in the issue of new policies:—

(a) The table designated Bs in the Schedule to the Order in Council made under the said Act on the nineteenth day of December, one thousand nine hundred and eight:

(b) The table designated Bs in the Schedule to the Order in Council made under the said Act on the twenty-fourth day of June, one thousand nine hundred and eighteen:

(c) The tables in the Third Schedule to the Order in Council made under the said Act on the seventeenth day of December, one thousand nine hundred and twenty-nine:

(d) The table designated B (Special) Single Payments in the Schedule to the Order in Council made under the said Act on the third day of May, one thousand nine hundred and thirty-four:

(2) Doth hereby accordingly revoke the said Third Schedule to the Order in Council made under the said Act on the seventeenth day of December, one thousand nine hundred and twenty-nine:

(3) Doth hereby approve and direct the use of the tables set forth in the Schedule hereto:

(4) Doth hereby order that this present Order in Council shall take effect on and after the first day of January, one thousand nine hundred and forty-six.
