IN pursuance and exercise of the powers and authorities conferred on him by section twenty-five of the Naval Defence Act, 1913, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, with the advice of the Executive Council, doth hereby amend and supplement the regulations referred to in the Schedule hereto as shown therein.

The South-eastern Side of Portion of Shand Street, in the Borough of Green Island, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

At the Government Buildings at Wellington, this 21st day of November, 1945

Present :
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Green Island Borough Council on the second day of October, one thousand nine hundred and forty-five, in so far as it affects the side and portion of street described in the Schedule hereto, viz. :—

“That the Green Island Borough Council, being the local authority having control of the streets in the Borough of Green Island, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Shand Street fronting Allotments 48 and 50, D.P. 44, Block I, Township of Green Island ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Shand Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.


SCHEDULE

THE south-eastern side of all that portion of street situated in the Otago Land District, Borough of Green Island, known as Shand Street, fronting Lots 48 and 50, Block I, D.P. 44, Township of Green Island, being part Section 80, Block V, Lower Kaikorai District. As the same is more particularly delineated on the plan marked P.W.D. 122514, deposited in the office of the Minister of Works at Wellington, and thereon edged red.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the thirteenth day of August, one thousand nine hundred and forty-five, viz. :—

“That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the undermentioned portions of streets, viz. :—

“(a) The south-eastern side of the portion of Motu Street adjoining Lot 12, D.P. 293, Township of Allandale, being part Section VII, Ocean Beach District ;

“(b) The south-western side of the portion of Mavis Street adjoining Lot 12 and part Lot 11, D.P. 293, Township of Allandale, being part Section VII, Ocean Beach District ;

such land being comprised and described in Certificates of Title 213/117 and 118 ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Motu Street and the south-western side of the portion of Mavis Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.


SCHEDULE

THE south-eastern side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Motu Street, fronting Lot 12, D.P. 293, Township of Allandale, being part Section 7, Ocean Beach District.

Also the south-western side of all that portion of street situated in the said land district and city, known as Mavis Street, fronting part Lot 11 and Lot 12, D.P. 293, Township of Allandale, being part Section 7, Ocean Beach District.

As the same are more particularly delineated on the plan marked P.W.D. 121438, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
